RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA AMENDING RULE IX, SECTION 3, OF THE CIVIL
SERVICE RULES RELATING TO SICKNESS AND DEATH LEAVE
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City Council has heretofore entered into
certain Memoranda of Understanding with various employee groups
in the City of Chula Vista resulting in modifications to Rule IX,
Section 3, of the Civil Service Rules of the City of Chula Vista
relating to sickness and death leave, and
WHEREAS, it is now necessary to amend said rule to con-
form with the terms and provisions of said Memoranda of Under-
standing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that Rule IX, Section 3, of the Civil
Service Rules of the City of Chula Vista be, and the same is
hereby amended as shown in Exhibit "A", attached hereto and
incorporated herein by reference as if set forth in full.

Rule IX, Section 3(a)(4)h - (Page 37c - Civil Service Rules)
h. Employees in the classifications listed as exceptions to Section
3(a)(4)f above will be eligible to receive twenty-five percent (25%)
payment for up to 120 days of unused sick leave upon honorable
separation from the City.
1. Employees in the classifications of Police Officer, Sergeant and
Lieutenant will be limited to pay for that portion of their sick
leave which has accumulated since January 1, 1970. All sick
leave accrued prior to that date will remain on the Officer's
balance and may be used as necessary.
2. Employees in the classifications of Associate, Assi stant and
Junior Civil Engineer, and Plan Checker II will be eligible for
the reimbursement only after the completion of five years service
to the City.
3. Employees listed as exceptions to Section 3(a)(4)f above, except
those in Police, Fire, and paragraph 2 above, are e ligible for
reimbursement only after ten years service to the C ity.
4. Employees listed as exceptions to Section 3(a)(4)f above, except
those in Police and Fire, will be eligible for the fifty percent
(50%) survivor's benefit as designated in Rule IX, Section 3(a)(4)e.

(4) When an employee with permanent status is compelled to be absent
from work because of the death of an immediate family member, an
immediate family member of the employee's spouse, or any other person
defined by the Internal Revenue Service as a dependent, and after
such employee makes written request and receives written department
head approval, such employee may be allowed the privilege to be
absent from work with full pay up to three (3) days, plus reasonable
travel time. Employees in the fire Department working a 60-hour
week shall be allowed to be absent from work with full pay for up to
two shifts, plus reasonable travel time. Travel time will be actual
time used not to exceed five (5) calendar days. Paid absence for
family death shall be charged to sick leave.
