R~q~ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THAT CERTAIN MEMORANDUM OF UNDER- STANDING CONCERNING WAGES AND OTHER TERD4S AND CONDITIONS OF EMPLOYMENT BETWEEN THE CITY OF CHULA VISTA AND THE CHULA VISTA POLICE RELIEF ASSOCIATION FOR FISCAL YEAR 1976-77 (JULY 2, 1976 TO JUNE 30, 1977) The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planagement Negotiation Team representing the City Manager of the City of Chula Vista, acting for and on behalf of the City Council of the City of Chula Vista, have heretofore met and conferred with the Chula Vista Police Relief Association, an organization representing sworn members of the Chula Vista Police Department from Peace Officer up through the rank of Police Lieute- nant, in accordance with the provisions of Section 3500 et seq. of the Government Code of the State of California, and WHEREAS, the r7emorandum of Understanding jointly prepared by said parties as a result of meeting and conferring in good faith has been presented to the City Council and is contained in Exhibit "A" attached hereto and incorporated herein by reference as if set forth in full. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve and accept said Memo- randum of Understanding as contained in Exhibit "A" for fiscal year 1976-77 (July 2, 1976 to June 30, 1977). WHEREAS, as a result of meeting and conferring in good faith t•+ith said group, agreement has been reached on the follo~•+ing terms and conditions of employment as applied to those shorn employees who are members of and represented by the Chula Vista Police Relief Association, and said representatives of the City Manager and of the Chula Vista Police Relief Association do now jointly prepare a written tiemorandum of Understanding concerning said agreed terms and con- ditions of emplo~Rneni for presentation to the City Council of the City of Chula Vista for determination, to wit: I. WAGES A. The City of Chula Vista will make annual salary increases effective at the beginning of the first payroll period after July lst each year. B. Effective July 2, 1976, a five percent (5%) salary increase shall be granted for the classification of Peace Officer. C. D Effective July 2, 1976, a seven and one-half percent (7-1/Z%) salary increase shall be granted for the classifications of Sergeant and Lieutenant. The classification of Peace Officer shall be subject to a seven (7) step salary range. The additional tiro steps shall be added to the lower level of the established range. Step "1" shall be 10%Thess than "A" step and step "Z" shall be 5% less than "A" step. normal hire rate shall be step "1" provided, hoa+ever, that an exceptionally arell qualified candidate may be hired within the established range based upon the recommendation of the appointing authority and the Director of Personnel and the approval of the City Flanager. the established .Upon recommendation of the Chief of Police, the Director of Personnel and with the approval of the City 1lanager, to advance to Step "Z" after six ironths at Step "1", to advance to Step "A" after six months at Step "2", to Step "4" after six months at Step "A", to Step "C" after six months at Step "Q", to Step "D" after twelve months at Step "C", and to Step "E" after twelve months at Step "D". E. Peace Officers will be eligible for advancement within salary range as folloe+s: ~/O -~ ~' .: E. The City ~•rill make all step increases effective on the beginning of the payroll period falling closest to the employee's qualifying date. II. EDUCATION It1CENTIVE PAY The Education Incentive Program in effect on June 30, 1975, shall con- tinue only r`or those svrorn officers employed on or before June 30, 1975, which is as follows: Base Salary Plus 2-1/2% PEACE OFFICER AGENT SERGEANT L I EUTEPIANT AA AA BA/BS MASTERS Base Salary Plus 5% BA/BS BA/BS Those officers employed or reemployed on or after July 1, 1975, shall not be eligible to receive Education Incentive Pay. •. SlCI: LEAVE REIi~~6URSEh1ENT The City of Chula Vista will provide sick leave reimbursement for svrorn members of the Police Department for the classifications of Peace Officer through Lieutenant as follows: Twenty-five percent (25%) payment for up to 120 days of unused sick leave vrill be made upon honorable separation. Accumulation of sick leave subject to pay ~•rill commence January 1, 1970. All sick leave accrued prior to January 1, 7970, will remain on the Officers sick leave balance and may be used as necessary. IV. LONG TERt4 DISABILITY IFJSURANCE The City will pay the entire cost of an improved PORAC Long Term Disability Insurance coverage as follows: Maximum amount of monthly benefits shall increase to $1,000. Y. UNIFORM ALLO'r1ANCE The present uniform allo~•rarce of one-hundred dollars (5100) annual replacement will be increased to t~•ro-hundred dollars (5200). YI. PAYROLL DEDUCTION OF DUES The City of Chula Vista shall bill the Chula Vista Police Relief Association for costs incurred for dues deducted in behalf of the Association not to exceed 5.04 per member per pay period. VII CONTINUATION OF EXISTIi~G BENEFITS It is further understood and agreed that any other benef its and rrorking conditions and the terms and conditions thereof presently in effect shall remain unchanged (er.cept for amendrr•ents to the Civil Service Rules o-rhich liberalize employee benefits) unless and until said terms and conditions shad be modified as a result of meeting and conferring in good faith betv;een the City and the Chula Vista Police Relief Association, pursuant to the previsions of Section 3500 of the Govern- ment Code of the State of California. VIII. SAVINGS CLAUSE If any provision of this agreement, or the application of such pro- vision, should be rendered or declared invalid by any court action or by reason of any existing or subsequently enacted legislation, the remaining parts or portions of this agreement shall remain in full force and effect.
