HomeMy WebLinkAboutReso 1976-8436Revised 11-16-76 RESOLUTION NO. 8436 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DECLARING AND ESTABLISHING A POLICY FOR THE FUTURE DEVELOPMENT OF THE EL RANCHO DEL REY AREA The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the State Su: county or city from approving a unless the governing body shall together with the provision for sistent with applicable general county, and division T-Zap Act prohibits any tentative or final subdivision map find that the proposed subdivision its design and improvement is con- or specific plans of the city or WHEREAS, the City Council has adopted as a part of its General Plan a requirement that public facilities, in accordance with necessary and desirable levels of service, are required to satisfy needs in newly developed areas and further incorporated the policy of the City Council that any development plans include an implementation section which sets forth in detail the measures to be taken to insure that needed public services are provided concurrent with needs generated by the development, and ~^IHEREAS, it has now been determined that future develop- ments in that area known as E1 Rancho del Rey, being that area generally bounded by I-805 and Otay Lakes Road and Bonita Road and Telegraph Canyon Road, will require the installation or improvement of two major streets, "H" Street and Telegraph Canyon Road, and substantial sewer and storm drain improvements, and L~~iEREAS, it has further been determined that said improve- ments must be assured of completion prior to any further developments by the establishment of an assessment district or other financial arrangement to insure the full completion of said improvements prior to consideration of any further developments to provide necessary public services to both existing and future developments, and ~^]HEREAS, it has further been determined that proper evalu- ation of the level of public facilities required in the E1 Rancho del Rey area is dependent upon the resolution of the application of Hillside development standards through identification of hillside ridges and canyons to be preserved has been resolved. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby declare and establish in accordance with the State Subdivi- sion Map Act and the General Plan of the City of Chula Vista as a policy of the Council that the City will not approve any further plans for development in the El Rancho del Rey project, other than those already approved through the tentative stage, until the matter of the assessment reimbursement procedure or other financial arrangements for the installation of the improvements as indicated hereinabove and the application of Hillside development standards through identification of hillside ridges and canyons to be pre- served have been resolved.
