RESOLUTION NO, 8421
RESOLUTION OF THE CITY COUPICIL OF THE CITY OF CHULA
VISTA APPROVING TENTATIVE SUBDIVISION MAP PCS-76-8
FOR SWEETHEART MAPdOR
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Ken Green, proponent of a project revision con-
sisting of a plan modification changing three duplex lots to a 14
unit apartment structure at the northeast corner of Quintard Street
and Tobias Drive, wishes to receive approval of a tentative subdi-
vision map and precise plan, and
WHEREAS, the proponent provided the Planning Department
staff with the necessary data for the preparation of a draft Environ-
mental Impact Report, and
WHEREAS, the Environmental Review Committee of the City
of Chula Vista issued for public review a draft Environmental Impact
Report, and
WHEREAS, legal notice of the availability of the said
draft Environmental Impact Report was given, and a notice of com-
pletion was filed with the Secretary of Resources for the State of
California, and
WHEREAS, said draft Environmental Impact Report was avail-
able for public review and scrutiny for a period in excess of 30
days, and
WHEREAS, the Planning Commission of the City of Chula Vista
held a public hearing on said draft Environmental Impact Report and
adopted a final Environmental Impact Report, and
~tiTIIEREAS, the Planning Commission of the City of Chula Vista
has heretofore approved that certain tentative map of a subdivision
to be known as Sweetheart Manor and has recommended that the City
Council approve said tentative map subject to the conditions as
recommended in their Resolution No. PCS-76-8, adopted on the 25th
day of October, 1976, a copy of which is attached hereto and by this
reference made a part hereof, the same as though fully set forth
herein.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Chula Vista does hereby certify that EIR-76-1A has been re-
viewed and the information considered, and that is has been prepared
in accordance with CEQA, the California Administrative Code and the
Environmental Review Policy of the City of Chula Vista,
BE IT FURTHER RESOLVED that the City Council of the City of
Chula Vista does hereby approve the tentative subdivision map of
Sweetheart Manor in accordance with the recommendations of the Plann-
ing Commission of the City of Chula Vista as contained in their
Resolution No. PCS-76-8, providing further that the drainage problem
shall be resolved prior to approval of the final map,

RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO
THE CITY COUNCIL THE APPROVAL OF TENTATIVE MAP KNOWN AS
SWEETHEART MANOR
WHEREAS, Sweetheart Construction Company submitted a tentative subdivision
map to subdivide 1.95 acres into 13 residential lots, to be known as Sweetheart
Manor, and
WHEREAS, Section 66473.5 of the Government Code provides that approval of a
subdivision map shall be based upon findings of consistency between the subdivision
map and the adopted General Plan of the local jurisdiction, and
WHEREAS, the Planning Commission set the time and place for a public hearing
to consider said tentative map, and notice of said hearing, with its purpose, was
given by the publication in a newspaper of general circulation in the City at least
10 days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.,October 25,
1976 in the Council Chamber, City Hall, before the Planning Commission and said
hearing was thereafter closed, and
WHEREAS, on June 28, 1976 the Planning Commission adopted and certified Environ-
mental Impact Report EIR-76-1A for residential development of the subject property,
and upon application for the tentative subdivision map the Environmental Review
' Committee, meeting on October 7, 1976, determined that the proposed subdivision
would not result in any adverse environmental impacts not addressed in FIR-76-1A.
NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
• From facts presented to the Planning Commission, the Commission finds that the
subdivision map known as Sweetheart Manor is consistent with _the Chula Vista General
Plan, based on the following evidence:
Land Use Element - compatible. The proposed project will be developed at a
.. density of 6.66 dwelling units per acre. The General Plan designates 4 to 12
dwelling units per acre_for this area.
Circulation Element - consistent. The project fronts onto two existing streets
and the developer will provide required improvements.
Housing Element - consistent. The project will provide small residential lots
for single family homes. The project is in an area suitable for the development of
moderate cost homes.
Conservation Element - compatible. The project will involve development of
unused land within an existing urbanized area. No loss of significant natural habitat
is involved.
Open Space Element - compatible. The Open Space Element of the General Plan
does not designate the subject property as warranting preservation as open space.
Parks & Recreation Element - compatible. The proposed project is in a park
district which is identified as being deficient in parks. By recent action of the
City Council, a new park is to be created near this site, across Quintard Street.
The developer will pay park fees in accordance with the City's adopted fee schedule.
Seismic Safety Element - compatible. The Environmental Impact Report indicated
the presence of an inferred fault in the vicinity of the subject property and
recommended that a geologist be present during grading so that the matter can be
given further study. If this investigation should lead to actual discovery of a
fault trace, appropriate mitigating actions can be taken at that time.
Noise Element - consistent. The proposed project will not generate a significant
amount of noise pollution and is not adjacent to any major streets or highways iden-
tified in the Noise Element as a major ground transportation noise source.
Safety Element - consistent. The proposed project is located within a mile of
an existing fire station on Melrose north of Palomar Street and will be served by a
fire hydrant to be located on Tobias Drive. No comments were received from the Police
Department which would indicate any unusual law enforcement problems.
Scenic Highway Element - compatible. The project area is not near any scenic
highway and would not constitute an adverse impact thereon.
'. Bicycle Routes Element - consistent. Neither Quintard Street nor Tobias Drive
is designated as a bike route.
Public Buildings Element - compatible. The proposed project will in no way
interfere with or contravene the Public Building Element since no public buildings
are proposed for this site.
BE IT FURTHER RESOLVED that the City Planning Commission recommends to the
City Council that Tentative Map PCS-76-8 for Sweetheart Manor be considered as the

precise plan for the 1.95 acres and be approved, subject to the following conditions:

1. The developer shall provide all requirement improvements for the private
street indicated on the map, meeting the requirements for a 24 foot wide ~ '
alley section designed to meet the standards of the Department of Public
Works of the City of Chula Vista with concrete paving. Improvement drawings
shall be subject to approval by the Director of Public Works. The
developer shall suggest a street name, to be approved by the City Council.

2. Guest parking required for interior lots, Nos. 2, 3, 4, and 6, 7, 8, shall
be provided through the provision of concrete paved driveways of lengths
not less than 23 feet from face of garage to edge of street and a minimum
width of 16 feet. Guest parking for remaining lots may be accommodated by
onstreet parking on Tobias Drive and Quintard Street• no parking shall
be permitted on the private access street; the developer shall install
appropriate signs and street markings. The developer shall have stated in
the Covenants, Conditions and Restrictions that no conversion of garages
to other uses shall be permitted.
3. All proposed street vacations must be approved prior to approval of final
map.
4. The developer shall be responsible for the installation of all public
improvements on Quintard Street and Tobias Drive. The improvements on
public streets shall include but are not limited to curb, gutter, sidewalk,
drainage structures, 28 feet of pavement, shoulder grading and street
lights.
5. The developer shall be responsible for onsite as well as offsite drainage.
Since an increase in run-off will be caused by development, the developer
shall participate in the solution of downstream drainage problems. The
• amount of developer participation, the technical solution and the coopers-
; tion of adjacent property owners shall be determined prior to the approval
of the tentative map by the City Council. All drainage improvements shall
shall be subject to approval by the Director of Pubr'lfic Works.
6. The developer shall be responsible for construction =of a storm drain under
Tobias Drive with proper inlets, junction boxes and +outlet structures as
required by the Director of Public Works.
7. The extent of paving required on Quintard Street sh~Al be determined by
~, appropriate tests, performed at the developer's expeinse, prior to approval
of improvement plans.
8. Lots 1 through 8 shall be served by an 8 inch sewer main, located off the
centerline of the private street, terminated at a marrihole and connected
to the main in Tobias Drive at a manhole. Existing sewer lines and manhole
locations shall be accurately shown on the revised tmntative map.
9. All overhead utilities and utility service to existimg structures shall
be undergraunded. ,
10. A geologist shall be present during grading and shaT11_, together with soils
and structural engineers, recommend mitigating measurres should any fault

race be discovered. Grading plans, including landscaping and irrigation
plans, shall be approved prior to approval of the final map. All lots shall
be graded to drain to a street.
11. Where possible, grading of adjacent lots with the consent of adjacent
property owners is strongly recommended to eliminate drainage problems,
unnecessary retaining walls (at Lot No. 1) and similar conditions. Further,
it is recommended that upward sloping areas of lots backing on proposed
Lots 3 and 4 be acquired for permanent maintenance by the owners of Lots
3 and 4.
12. Slopes facing Tobias Drive shall be planted and permanent irrigation shall
be installed in accordance with the municipal grading ordinance and the
Landscape Manual. Maintenance of these slopes shall be the responsibility
of the owners of the adjacent lots.
13. Decorative walls, 5 to 6 feet in height, with masonry pilasters and solid
wood fencing between, shall be installed by the developer at the top of the
slope bank facing Tobias Drive; the design to be approved by the Director
of Planning.
14. One fire hydrant will be required at Tobias Drive and the private street,
requiring extension of the water main. Fire flow requirements are for
1,000 gallons per minute or 1500 gallons per minute if wood shingles are
used for roofing.
15. The applicant shall comply with City Council Resolution No. 6792 regarding
the provision for public facilities, including park fees. The City's
park dedication ordinance (No. 1668) requires that determination of "fair
market" value for purposes of in lieu fees to be paid, must be determined
as of the time of filing the final map. Payment of fees are required
prior to the acceptance of any final map.
16. An association shall be formed, subject to the approval of the City
Attorney, for the perpetual maintenance of the private street, sewer,
and lighting along the private street.
17. Abutters rights of access to Tobias Drive from Lots 1, 5 and 9 shall be
relinquished on the final map.
18. The developer's engineer shall be required to set vault type street
monuments at the intersection of Quintard Street and Tobias Drive.

19. The developer shall comply with all sections of the Chula Vista Municipal
Code which apply and are in effect on the date the City Council approves
the tentative map. Preparation of maps and plans shall be in accordance
with the provisions of the Subdivision Manual.
20. The developer shall submit a revised tentative subdivision map showing the
following changes and additions, and addressing the conditions of approval
stated above:
a. Proposed method of sewer service for all lots.
b. Cross-section and name for the private street.
c. Correct assessor's numbers.
d. All driveway locations.
e. Correct location of sewer mains.
f. Existing street elevations.
g. A'30 foot curb return radius with a 22 foot property line radius at
Quintard and Tobias.
h. Trees to remain.
i. Grading of lots to indicate drainage to streets or alternative proposals
to handle run-off from each lot.
j. Grading of slopes adjacent to intersection of the private street and
Tobias Drive to indicate safe sight lines for automobile traffic exiting
the subdivision.
21. A 7.5 foot wide strip alo~~g Quintard Street and Tobias Drive shall be
dedicated as an easement for street tree purposes.
22. All monumentation shall be performed pursuant to State Map Act requirements.
23. All lighting plans for public and private streets shall be approved by
the City Traffic Engineer prior to approval of the final map.
24. Note 6 on the tentative subdivision map shall read:
"Sanitary sewers to be provided and connected to City of Chula Vista
sewers. Such connections shall be made only after adequate capacity
of all downstream systems is assured to handle the increase in flow
generated by this subdivision."
