Seventh Payment, after presentation by the Consultant at one meeting of the Planning Commission and one meeting of the City Council. 10. Meetings and Liaison The Consultant shall maintain contact with the Director of Planning and Assistant Director of Planning of the City of Chula Vista and shall consult with them as frequently as may be necessary. At the end of Steps 1, 2, 3, 4, 5, and 6, the Consultant shall be prepared to make presentations to and have review sessions with the Citizens' Advisory Committee. At the end of Step 6 the Consultant shall be prepared to make presentations to the Planning Commission and City Council of the City of Chula Vista. At the option of the City, the number of presentations may be reduced to five (5}. Consultant shall participate in not more than eight (8) and not less than five (5} meetings with the Citizens'. Committee, Planning Commission and City Council under this agreement, to be set by the City with the concurrence of the Consultant. In the event that the Consultant is required to attend meetings in excess of this number, the Consultant will be additionally compensated in full by the City for the actual and reasonable travel costs incurred and for such additional expenses and personnel charges at the standard hourly rates set forth below. Principal $45.00 Senior Associate $35.00 Associate $30.00 -3- 11. Printing of Reports The actual printing of the final and interim reports shall be the respon- sibility of the City. Such printing shall be from camera ready text, documents and maps supplied by the Consultant. All reproducible masters shall become the property of the City provided that the Consultant may retain a duplicate set of reproducible masters. The City shall have the right to distribute such reports in whole or in part fora period of five (5) years from the date of completion of the contract. Thereafter, the City agrees to use its best efforts to prevent reproduction and distribution without prior consent of the Consultant. 12. Termination of Agreement Either party shall have the right to terminate this agreement by giving written notice of such termination and specifying the effective date thereof, at least thirty (30) days before the effective date of such termination, or such lesser period as may be necessary to conclude the work underway and to summarize findings. In that event, ,all finished or unfinished documents, data, studies, surveys, drawings, maps, models, photographs, and reports prepared by the Consultant shall, at the option of the City, become its property, and the Consultant shall be entitled to receive just and equitable compensation for work completed on such documents and other materials. The planning effort will be organized about a series of workshop meetings, each of which will focus on major issues related to the future of the Rice Canyon Area. Among the issues to be considered will be potential open space use, impacts of prospective development on roads, utilities and other public services and visual compatibility with adjoining residential areas. The study will serve as a means of discussing and resolving these major public interest issues. The final product will not constitute a plan in the conven- tional sense but will instead consist of a series of guidelines by which the City can determine if development applications for all or any portion of the area are acceptable. For example, the plan will indicate the types of land uses which are acceptable for portions of the area and the conditions under which these uses are permitted. Conditions specified may include such factors as design standards, compatibility with other proposed uses, and provisions of related off-site improvements. The study will include documentation of existing environmental conditions and identification and assessment of major alternatives suitable for use in future EIR's. SCOPE OF WORK The scope of work consists of six major steps each of which includes workshop meetings with the Citizens' Committee (ACCORD). STEP 1 - INITIAL DATA COLLECTIONS AND SURVEYS This step includes the identification and collection of existing data plus on- and off-site surveys were present data is insufficient. Data to be collected and mapped, when appropriate, includes the following: a) Site Conditions -- soils and geology; hydrology; vegetation; natural habitat; seismicity; archaeology; noise; topography by slope categories; visual features; roads and utilities. b) Off-Site Factors -- roads and other transportation networks; utilities; other public facilities and public services (e.g., schools, solid waste disposal); land uses adjoining the site; visual factors (aspects which might potentially be affected by site development). c) Public Sector Factors -- current zoning and subdivision regulations; City, County, and other governmental entity plans, including land use; trans- portation, and utility plans; current and projected City revenues; community attitudes (from previous hearing minutes and meetings with the Citizens' Committee). A meeting will be held with the Citizens' Committee to solicit their views as to major issues to be addressed during the study. 2 STEP 2 - OPEN SPACE EVALUATION This step will examine the question of whether all or portions of the site merit consideration for permanent retention as open space. (For subsequent EIR purposes this analysis will constitute the consideration of the non-development alternative.) Factors considered will include the following a) significant natural resource values; b) major constraints imposed by natural hazards or topography; c) scenic, recreation or archaeological values; and d) fiscal and administrative implications. The latter will investigate public acquisition and maintenance costs, methods of financing, and the implications thereof. Discussions will be held with the Citizens' Committee (ACCORD) to determine their attitude toward open space use based on the above analyses. STEP 3 - PUBLIC SERVICE APJALYSIS The next step will consist of an evaluation of the capacity of public facilities and services which serve the site. The analysis will include: a) effect of different levels of on-site traffic generation on the freeway and local streets connecting to the site; b) impact of off-site water, sewer and storm drain facilities which serve the site; and c) impacts on schools and recreation facilities. These investigations will serve to document the level of development which can be accommodated without major off-site improvement and the fiscal implications if the existing capacities are exceeded. Once again the Consultant will meet with the Committee to discuss the planning policy implications of these investi- gations. STEP 4 - LAND USE SUITABILITY At this point the study will examine the potential for accommodating alternative uses on the site or portions thereof. Factors considered will consist of: a) physical conditions including topography, geology, and soils which are either favorable or unfavorable for various types of uses; b) consistency with current public policy, i.e., would these uses complement or undermine other land use objectives of the City; c) prior findings as to open space values and public service factors. 3 The various land use choices will be identified as to type, potential site location, and possible levels of density or intensity. As a part of this step it will be necessary to prepare exploratory site plans for the site so as to determine road and utility requirements and provide estimates of developable land. A qualitative accounting will be made of the implications of these uses including discussion of development cost, and related market implications, fiscal conse- quences, and potential impacts on surrounding properties. The Committee's response to these land use choices will be obtained by use of a vaorkshop. STEP 5 - DESIGPJ COr1PATI6ILITY Following the Committee's consideration of land use options further investigation will be made of design implications of these uses and the conditions which should accompany uses to be permitted. The analysis will include on-site considerations such as relationship of buildings and roads to land forms, vegetation, views and visual impacts, as seen from adjoining residential areas and roadways, produced by grading; building siting, bulk, height and materials; road alignment and size; and the design and siting of other accompanying structures. A series of illustra- tive site plans and sketches will be prepared for key elements to help the Committee visualize the proposals under consideration. The results of this analysis will be combined with the previous analysis of land uses and the Commit- tee again consulted as to their opinions regarding development choices. STEP 6 - PREPARATION OF DEVELOPMENT GUIDE The final step in the program will be preparation of a development guide for the Rice Canyon Area. The guide will identify the types of uses which may be permitted and the conditions under vahich permission will be granted. The guide will establish buildable and unbuildable areas, points of vehicular access and egress, specific or general alignment of roads, siting requirements and building design requirements where applicable. The guide will be set up to consider either development of the site under a single application or a series of separate submittals for portions of the site. In the latter instance special consideration will be given to controlling accumulative effects, e.g., assurances that successive developments will not produce traffic generation beyond the existing or planned capacity of related roadways. The guide will also establish submittal requirements for future applications such as type and level of environmental data and assessment required and presentation methods to help ensure adequate City and citizen review of the proposals. ` ~ v _ ` __ I I t _ / ..
