AT?ETIDIRIG RESOLUTIOTQ NO. 8270 A.UTHOP~IZING THE DEFERRAL OF T~iE II.ISTA.T~LATIOTd OF CERTAIN Fi~PLIC I^?PROVEN1ET~dT5 OTd PROPERTY O[~1NED BY _LOUIS GL'ILLEP!CETTE LOCATED AT 167 SECOTdD AVETIUE The City Council of the City of Chula Vista does hereby resolve as follows: T~7IIEREAS, the City Council of the City of Chula Vista has heretofore by Resolution Tdo. 8270, adopted on July ?_0, 1976, approved the deferral of certain public improvements located at 167 Second Avenue secured by the property o~~ner's lien agreement on Parcels 1 and 2 of Chula Vista Parcel reap 5134, and L^IHEREAS, it is now desired to amend said agreement provid- ing that the lien on Parcel 1 of Chula Vista Parcel P•7ap 5134 may be released or exonerated, ar~d t^~IiEREAS, said Parcel 2 provides sufficient security to insure the installation of the public improvements listed in accor- dance with iesolution No. 8270. TdOLd, T~IEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that Resolution 8270 be, and the same is hereby amended releasing and exonerating the lien upon Parcel 1 of Chula Vista Parcel 1`~iap 5134. BE IT FURZ°HER RESOLVED that the ~Zayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said amendment to the agreement for the deferral of the installation of improvements upon property ovmed by Louis Guillermette located at 167 Second Avenue. BE IT FURTHER RESOLVED that the City Cler]c of the City of Chula Vista be, and she is hereby directed to record said lien agree- ment in the office of the San Diego County Recorder.. DATED City Clerk (SF,AL) CC-G60 2151 FIRS 1^ AA~IENDMENT TO AGREEb~EI~TT P'OR THE DEFERRAL OF THE IP,STALLATION OF CERTAIN PUBLIC Ir~PROVEMEIJTS Ir7 THE CITY OF CHULA VISTA A21D LIEN SECURIL?G FUTURE IIdSTALLATI0I1 OF SAID I>~1i'P.OVEA1EIuTS UPON PROPERTY OWNED BY LOLTIS GUILLED~4ET^lE LOCATED AT 167 SECOND AVENiTE THIS AP'LENDED AGREEMENT, made and entered into this 5th day of_ October , 1976, by and between THE CITY OF CHULA VISTA, a rnunicipal corporation, hereinafter referred to as "City", and LOUIS GUILLEP4ETTE, 1379 Fourth Avenue, Chula Vista, California, 92011, hereinafter referred to as "Property Ovaner"; W I T N E S S E T H WHEREAS, Property Owner has previously been granted a deferral of the installation of public improvements on a parcel located at 167 Second Avenue pursuant to the Chula Vista PRUnicipal Code Sections 12.24.040 and 12.24.070, and WHEREAS, said Property Owner, the undersigned, has requested that the lien applied to Parcels 1 and 2 located at 167 Second P.venue be modified to provide that that property known as Parcel 2 of Chula Vista Parcel Map 5134 constitute the Property Ov~~ner's pledcre of security for the installation of public improvements pursuant to Chula Vista - City Council Resolution No. 8270, and WIiEREP_S, said Parcel 2 as set forth on Chula Vista Parcel Nlap 5134 provides sufficient securit~,~ for the installation of public improvements as required by the previous agreement between Property Owner and the City of Chula Vista. IdOW, THEREFORE, IT 7S I'~LT'I'UAZLY AGREED by and between the parties hereto as follows: 1. That that certain agreement, dated July 20, 1°. 76 esta- blishina a lien securing the future installation of improvements, be, and the same is hereby modified solely as to the third Whereas con- tained in said agreement, which is amended to read as follows: "WHEREAS, the Planning Conunission, on June 14, 1976, did grant said request for an exemption to the provisions of Section 12.24.010 on the conditions set forth hereinafter, for the public alley between Second Avenue and Minot Avenue, adjacent to the property at 167 Second Avenue, more particularly described as Parcel 2 of Chula Vista Parcel Pap 5134, and did find that the grounds for said request for an exemption were reasonable and were in conformance with the requirements of Section 12.24.070." II1 WITNESS WHEREOF, the parties hereto have caused this agreement to be executed the day and year first hereinabove set forth.
