HomeMy WebLinkAboutReso 1976-8304 RESOLUTION NO. 8304 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING TENTATIVE SUBDIVISIOPI MAP FOR EL RANCHO DEL REY UNIT #4 The City Council of the City of Chula Vista does hereby resolve as follows: [~1HEREAS, the proponents of a project known as El Rancho del Rey, consisting of a multi-phased planned community north of Telegraph Canyon Road and west of Otay Lakes Road, wished to receive discretionary approval of said project, and WHEREAS, said project could have a possible significant effect on the environment, and WHEREAS, the proponents of said project retained an environmental consultant selected from a list of said consultants approved by the City Council of the City of Chula Vista, and WHEREAS, said consultant submitted an application for an environmental impact report to the Environmental Review Section of the Planning Department of the City of Chula Vista, and WHEREAS, after independent review and analysis of said application, the Environmental Review Committee of the City of Chula Vista issued a draft Environmental Impact Report, giving legal notice of the availability of_ said draft Environmental Impact Report and filing notice of completion with the Secretary for Resources of the State of California, and WHEREAS, said draft Environmental Impact Report was available for public review and scrutiny for a period in excess of thirty days, and WHEREAS, the Planning Commission of the City of Chula Vista held a public hearing on said draft Environmental Impact Report and adopted a final Environmental Impact Report, and WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as El Rancho del Rey Unit #4 and has recom- mended that the City Council approve said tentative map subject to the conditions as recommended in their Resolution No. PCS-76-4, adopted on the 9th day of August, 1976, a copy of which is attached hereto and by this reference made a part hereof, the same as though fully set for herein. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby certify that EIR-76-3 has been reviewed and the information considered, and that it has been pre- pared in accordance with CEQA, the California Administrative Code and the Environmental Review Policy of the City of Chula Vista. BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that said Council does hereby approve the tentative subdivision map of E1 Rancho del Rey Unit #4 in accordance with the recommendations of the Planning Commission of the City of Chula Vista. PCS-76-'1 RESOLUTION OF THE CITY PLANNING COMMISSIOfV ~ ~ ~ RECOiMENDING TO THE CITY COUNCIL THE APPROVAL OF TENTATIVE hiAP KNOblN AS EL RANCHO DEL REY OiJ.iT iJO. 4 WHEREAS, E1 Rancho del Rey submitted submitted a tentative subdivision map to subdivide 23.25 acres into II3 single family residential lots to be known as E1 Rancho del Rey Unit No. 4, and WHEREAS, Section 66473.5 of the Government Code provides that approval of a subdivision map shall be based upon findings of consistency between the subdivision map and the adopted General Plan of the local jurisdiction, and WHEP,EAS, tiie Pianniny Commission set the time and place for a public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by the publication in a newspaper of yeneral circulation in the City at least 10 days prior to i:he date o` said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. July 26 and August 9, 1976 in the Council Chamber, City tlall, before the Planning Commission and said i~~caring was thereafter closed, and WHEREAS, on July 26, 1976 the Plannirg Commission adopted and certified F'nvironmental imn,~ct Report E.IR-76-3 for th~.s projr'ct. NOW THEREFORE BE IT RESOLVED AS FOLLOi~JS: 1. From facts presented to the Planning Commission, the Commission finds that the subdivision map known as E1 Rancho del Rey Unit iio. 4 is consistent with the General Plan for the City of Chula Vista as follows: a. Land Use Element - compatible. The proposed project will be developed at a density of 3.6 dwelling units per acre. The General Plan designation is 13-26 units per acre for this area. b. Circulation Element - consistent. The proposed project will improve Telegraph Canyon Road adjacent to the subdivision, one of the City's major east-west streets. c. Housing Element - consistent. The project will provide additional housing and the applicant has indicated a willingness to make every effort to assist low and moderate income purchasers to qualify in acquiring a frome. d. Conservation, Open Space, and Parks & Recretation Elements - compatible. The developer has designed the subdivision in conformance with the open space plan, preserving the area adjacent to Telegraph Canyon Road in open space. The developer has already constructed and dedicated the required park land area. e. Seisn;ic Safety Element - consistent. The Environmental Impact Report f. Safety Element - consistent. The proposed project will extend the public improvements and provide fire hydrants in conformance with City standards. g. tdoise Element - consistent. The proposed project will not generate a substantial amount of noise pollution. The rroise generated by traffic on Telegraph Canyon Road will be mitigated by construction of a 42" high hlock wall at the top of a slope which is approximately 55 feet above Telegraph Canyon Road. h. Bicycle Routes Element - consistent. The applicant will construct a required bike path adjacent to Telegraph Canyon Road. The bike route is designated on the Bicycle Routes Element. i. Public Building Element - compatible. The prot~osed project vr~ill not result in the relocation of any existing or purposed public facilities. 2. The Planning Commission recommends to the City Council that Te~~tative Map PCS-76-4 for El Rancl7o del Rey Unit No. 4 be approved, subject. to the following conditions: a. All conditions specified in the Precise Plan FCt-76--13 shall be fulfilled. b. The lct area extending from the top of slope to Buena Uista 4Jay and Telegraph Canyon Road and the eastern subdivision boundary from Lots 47, 48, 50 through 67, and 83 shall be dedicated to the City and included within the Open Space Maintenance District. Tir° developer shall have the option of retaining the lots 'in private ownership and forming a home o~-,~ners association for slope maintenance. The app li- cant must indicate his preference prior to Council's action on the tentative reap. c. Landscaping shall be as folloars: (1) Existing slope banks along the Scenic Route (Telegraph Canyon P.oad) shall be enhanced with additional one gallon size spreading shrubs and one gallon trees at the rate of one for every 500 sq. ft., also ground cover shall b~ planted to fill in existing material and shall be chosen for its higar ornamental value. For purposes of this report the northerly boundary of the Scenic Route shall consist of a line drawn paralleling Telegrapt; Canyon Road from Buena Uista flay extending northeasterly t:o include all of the manufactured slope area. (2) Interior slopes shall be planted in accordance with the City Landscape Manual and all groundcover shall be a uniform ornamental species planted from rooted cuttinys, 1L" an center, or 8" on • center far unrooted cuttings. Hydroseed application'will not be accepted for these areas. (3) The easterly canyan shall have t:he bottom area cleared of brush, • debri and invasive plant material and planted in clusters with 30 five yallon size trees which are. easily acclimated to the na.tivc environment. A temporary irrigation system such as bubbler, trickle or dr°ip irrigation, shall be installed to insure a;~ adequate establishment period for the trees. (4) All plarrting and irrigation shall b2 installed and guaranteed according to ti;e standards and tim•as set fortl! in tl~e City Landscape ~•1anual. (5) All existing planted and irrigaeci slopes dernaged during construction shall be replanted and repaired to the satisfaction of the City Landscape Architect. (6) The ar°ea between the bicycle path and the curb clang Telegraph Canyon Road shall be planted with ground cover and 15 gallon street trees at 0 fet on center. d. All Gva17s and fencing siiaii be installed in conformance v~~ith the City's subdivision r-eyrala.tions and t:he requirements set forth in the Precise Plan. e. The applicant shall r!ot be required to pay any par{< fees since credit from previous park land dedication covers this development. However, no further extension of credit will be granted for other units. f. The tentative map shall be revised to show the following corrections: (1) Typical street sections shall be revised by replacing streets "A", "B", and "C" t',~ith La Mancha Place, Tierra Bonita Place and Mesa Grande Place. (2) The street tree deposit ordinance should be changed fram Ordinance No. 1684 to Ordinance fvo. 1687. g. In accordance with condition 9 of Planned Unit Development PUD-71-2, the developer shall be financially responsible for improving Telegraph Canyon P,oad between Buena Vista Way and the easterly subdivision boundary to praovide four lanes of traffic (two 16' lanes and two 12' lanes) plus one-half of the median island. Improvements sha'il consist of, but not be limited to, 5G feet of pavement, curb and gutter, bike path, street lights, and drainage facilities. Improvements in Telegraph Canyon Road shall also include safe and adequate transition to the existing improverirents west of Buena Vista Way and east of the subdivision. The method in which this is to be accomplished will be subject to the approval of the City Engineer at the time the developer submits . improvement plans and final map. The typical section for Telegraph Canyon Road shall be revised on the tentative subdivision map to conform to these requirements. The developer shall also acquire any additianal right of way necessary to construct these improvements vrithin Telegraph Canyon Road. h. The intersections of La Mancha Place and Tierra 6onita Place with Buena Vista Way shall be designed as to provide safe turning movements and safe stopping sight distance. i. All grading shall be done in accordance vrith City of Chula Vista Ordinance No. 1455 and the City of Chula Vis%a Landscape t~1anual. Special attention will be given to blending manmade slopes into existing topography. All lots shall b~ gr°aded so as to drain to tlrU abutting streets. j. The developer shall pay the sevrer connection charge to the Telegraph Canyon trunk sewer line. k. Any changes as to assessment or in the areas f;o be maintained by Open Space District No. 1 shall be approved by the City Council in accordance vaith Chapter 17.03 of the Municipal Code prior to approval of the final map by the City Council. 1. The onstreet parking in the center of the cral-de-sac at tine end of Mesa Grande Place, as shown cn the precise plan, shall be eliminated. If the developer wishes to gain additional onstreet parking, then he should submit a revised tentative map whictr includes a cul-de-sac conforming to City of Chula Vista STandard Dra;~~ing No. 114. m. The developer shall comply vdith all sections or the Chula Vista Municipal Code which apply and are in effect on the date the City Council approves the tentative map. The preparation of the final map and improvement plans shall be in accordance with the provisions of the Subdivision h1anual. 3. That this resolution be transmitted, along with tP~e Tentative h1ap, to the City Council, and a copy of this resolution be transmitted to the applicant.
