RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING A POLICY ON MINUTES FOR
CLOSED SESSIONS
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby approve a policy on Minutes
for Closed Sessions, attached hereto as Exhibit "A" and
incorporated herein by reference as if set forth in full.

BACKGROUND
The Brown Act, contained in California Government Code Section
54950 et seq., authorizes a City Council to go into closed
session to discuss certain sensitive matters, including
personnel, salary negotiations, real property transactions and
litigation. Government Code Section 54957.2 authorizes a City
Council to designate an employee to keep and enter in a minute
book, a record of topics discussed and decisions made in closed
session, This minute book is not a public record and is kept
confidential. It is available only to members of the City
Council or to a court if a violation of the Brown Act is alleged
to have occurred.
PURPOSE
To direct that the City Attorney keep and enter in a minute book,
a record of topics discussed and decisions made in closed session.
POLICY
The City Council establishes the following policy in order to
keep minutes of closed sessions.
The City Attorney shall keep a minute book of closed sessions to
include the following information:
1. Date.
2. The time the meeting commenced and ended.
3. All persons in attendance at the meeting.
4. A record of the actions taken.
5. A record of the vote on the actions taken.
Records on the action taken shall be specific enough to identify
the issue before the City Council, but shall be stated in a way
designed to avoid disclosure of information which would be
harmful to the City's current or future interests.
Minutes of closed sessions 8hall be available only to members of
the City Council, the City Attorney and the City Manager. These
records may only be released to the public upon a majority vote
of the City Council.
