HomeMy WebLinkAboutReso 1976-8376RESOLUTION N0. 8376 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AUTHORIZING THE APPRAISAL OF CERTAIPd PROPERTIES FOR THE PROPOSED ACQUISITION OF RIGHT OF WAY FOR TELEGRAPH CANYON ROAD AND CHANNEL AND DIRECTING THE STAFF TO UNDERTAKE NECESSARY LEGAL STEPS PRECEDENT TO THE ACQUISITION OF SAID PROPERTIES The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City of Chula Vista proposes to undertake a widening of Telegraph Canyon Road and the drainage channel adjacent thereto and preliminary plans have been prepared showing said pro- posed right of way, and WHEREAS, the owners of two adjacent parcels propose the construction of improvements within the area contemplated for acquisi- tion, and WHEREAS, no Environmental Impact Report has been prepared as required by law to proceed with the formal acts of eminent domain, and WHEREAS, it is now desired to take such preliminary steps as may legally be authorized in order to protect the mutual interests of both the City and the property owners. rdOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the City Manager of the City of Chula Vista be, and he is hereby authorized to retain an independent appraiser for the appraisal of the subject properties as shown on Exhibit "A", attached hereto and incorporated herein by reference as if set forth in full, and further that the amount of $1,000 be, and the same is hereby appropriated from the Gas Tax Fund to cover the cost of said appraisal. BE IT FURTHER RESOLVED that the City Council does hereby direct the staff to undertake all legal steps necessary precedent to formal declaration of an intent to acquire said properties includ- ing the preparation of an Environmental Impact Report, a finding of consistency with the City's General Plan and set an appropriate time for a public hearing regarding the City's intent to acquire said property through condemnation. To this end, it is further recommended that: 1. Council direct Staff to retain an independent appraiser for an appraisal of the value of the subject property and appropriate $1,000 from the Gas Tax Fund to cover the anticipated maximum cost of such an appraisal. 2. Council direct Staff to undertake all legal steps necessary precedent to the formal acquisition of this property, including environmental review, funding of consistency ~::ith the City's General. Plan, and setting a Public Hearing regarding the City's intent to acquire said property ti.rou~n condemnation. 3. Direct Staff to return to Council after receipt of an appraisal report for anpropriation of sufficient funds to cover the act of acquisition. III BACKGP.OUND AND DISCUSSION: The City Council has approved an agreement between the City and Wilsey and Ham, Consulting L•'ngineers. That agreement provided for the development of conceptual plans for Telegraph Canyon Road ar,a Channel. Preliminary plans for that improvement project have bt;c,~i received. however, the final report has not yet been submitted. Consequen%ly, the alignment and profi-le for the project facilities have not been approved. Nor i~as the hnvironmental Impact Report been conpl.cted. The preliminary plan closely agrees with the desires of this De- partment and it i_s expected that the final plan we reconrrrend for Council approval will be in substantial accord with the pr.elimin;.,-y plan alr.cady received. Exhibit 1, attached, shows the general location of two parcels o land, upon which the owners propose to build single f~r,Iily homes. As may be seen, on this cxhibi.t, appro:;i- mately half. of Assessor's Parcel 640-070-13 and all of Parcel 640-070-14 arc within the proposed construction area. Consequcn=~ly, if these properties are imaroved, and if the roadway/channel ,:rcjec(- is approved anci construc'~ed, it will be necessary to acquire ti,:. newly improve~i~properties. P.egardl.ess of the final valuation of the lapel, it is expected i:i:aL- the overall cost of these properties will increase c'.ramatically because of the construction of the proposed horses. If the C.ily's project is constructed as shoom on Exhibit 2 after. the homes are completed and occupied, it should be expected that acquisitio:i cost: would be even further increased because of relocation assistz:nce and legal costs associated with occupied property. No funds are presently budgeted for this acquisition. The project would be eligible for Gas Tax monies, but other demands on Ccas ^a== funds are anticipated now because of cost increases and other considerations. IV CONCLUSIONS: Acquisition of these properties is required now to avoid mu^1'~ i~iuhar costs later, o:hen they have been built upon. Althouq_h only a port._o!' of Parcel 650-070-13 caill be needed by the City, all of t::e ^nrc^1 should be taken to avoid social and economic costs which mig.~t .._sul because of the proximity of the property to the City's conscracL-:ion project.
