PCS-76-3 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION MAP KNOWN AS PARKWAY PLACE WHEREAS, Royal Investment Properties, Ltd. submitted a tentative subdivision map to subdivide 3.08 acres of land located at 511 Park Way into five lots, to be known as Parkway Place, and WHEREAS, Section 66473.5 of the Government Code provides that approval of a subdivision map shall be based upon findings of consistency between the sub- division map and the adopted General Plan of the local jurisdiction, and WHEREAS, the Planning Commission set the time and place fora public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the City at least l0-days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., April 26, 1976 in the Council Chamber, City Hall, before the Planning Commission and said hearing was thereafter closed, and WHEREAS, on April 26, 1976 the Planning Commission adopted Resolution PCV-76-5 approving the creation of four lots with minimum frontage of 60 feet for the purpose of constructing a single family dwelling on each lot, and resulting in a density of one apartment unit per 820 sq. ft. on the fifth lot at 511 Park Way currently developed with 128 apartment units, and WHEREAS, the Commission found that in accordance with the Negative Declaration on IS-75-78, certified by the Commission on January 26, 1976, this project and the construction of four additional single family dwelling units will not have signif- icant impact on the environment. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Planning Commission, the Commission finds that the subdivision map known as Parkway Place is consistent with the General Plan for the City of Chula Vista as follows: a. Land Use Element - The General Plan designates this area as High Density Residential, 13-26 dwelling units per gross acre. Although Lot 5 will have a density of 53 units to the acre, the property is already established at that density. Construction of single family homes on the four lots will have the effect of bringing the property more closely into conformance with the General Plan. Lots 1-4 will be developed at a density of approximately 6 units per acre, well within the density designated by the General Plan. b. Circulation Element - The proposed project is served by existing streets. c. Housing Element - The proposed project will provide additional decent housing in the Central Area of Chula Vista, thereby providing residents a choice of living accommodations. d. Conservation, Open Space, and Parks & Recreation Elements - The developer will pay the required fees for the development of parks in the service area. e. Seismic Safety and Safety Elements - The proposed project is not close to any known geological hazard. f. Noise Element - The proposed project will not result in the genera- tion of substantial noise pollution nor will it be subject to unacceptable levels of noise. g. Bicycle Routes Element - The proposed project is not required to provide a bicycle route nor will it result in the interference of continuity of any proposed or existing routes. h. Public Building Element - The proposed project will not result in the relocation of any existing or proposed public facilities. 2. The Planning Commission recommends to the City Council that Tentative Map PCS-76-3 for Parkway Place be approved, subject to the following conditions: a. The developer shall be responsible for construction of improved drainage facilities from the northerly property line of Parcel 1 to the southerly property line of Parcel 5. The improved drainage facilities shall be capable of carrying a design flow of 586 cubic feet per second. The developer shall be responsible for designing the drainage system from the westerly right-of- way line of Fifth Avenut to Park Way. The developer shall show that any future extension of the drainage facilities will not conflict with the existing sewer in Park Way. The design shall be compatible with existing improvements and the downstream reach of the central basin. b. Improvement plans for the improved drainage facilities and the grading plan (if required) shall be submitted to the City Engineer prior to approval of the final map. c. The developer shall construct all drainage improvements. These improvements will consist of improved line channel or enclosed pipe or box, headwalls, wingwalls, transition structures satisfactory to the City Engineer, and off-site grading as required for the proper operation of the drainage system. The developer will be responsible for obtaining easements or permission to grade d. The. developer shall be responsible for planting a street tree along Fifth Avenue in front of Parcel 1. The specie of tree to be planted shall.be as specified by the Director of Public Works. The street tree is to be planted prior to the issuance of an occupancy permit for any structures on Parcel 1. If the street tree is not planted by this time, then the developer will be required to post a street tree deposit guaranteeing the installation with the City Finance Officer. e. The developer shall obtain a grading permit (if required) prior to the issuance of a building permit on Parcels 1 through 4 inclusive. f. The developer shall comply with all applicable sections of the Chula Vista Municipal Code prior to approval of the final parcel map. The final parcel map, improvement plans and grading plans shall be prepared in accordance with the Chula Vista Subdivision Manual. g. All utilities servinc Parcels 1 through 4 inclusive shall be under- grounded in accordance with the Chula Vista Municipal Code. 3. That this resolution be transmitted to the City Council, and a copy of this resolution be transmitted to the applicant.
