HomeMy WebLinkAboutReso 1988-13687-- (g) RESOLUTION NO. 13687 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND ADULT PROTECTIVE SERVICES AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and ADULT PROTECTIVE SERVICES, in regard to the expenditure of City funds appropriated, dated the 19th day of july , 1988, a copy of which is attached~eto and incorporated herein,' the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. WITNESSETH WHEREAS, the City is currently involved in a Community Development Block Grant program, a principle goal of which is to benefit low and moderate income persons; and WHEREAS, the Grantee is equipped and willing to provide certain services to the City which will primarily benefit low and moderate income persons and has the necessary expertise in this field for completing the same; and, WHEREAS, the City is desirous of having those certain services, hereinafter enumerated, performed by the Grantee; and, WHEREAS, funding for the Grantee is contingent upon receipt of a Letter of Credit authorizing a drawdown of Block Grant funds from the U. S. Department of Housing and Urban Development (HUD); and WHEREAS, no expenditure may be made out of any appropriation awarded such a Grantee unless an agreement has been reached between the parties setting out the terms and obligations for the expenditure of such funds. NOW, THEREFORE, in consideration of the mutual obligations of the parties as herein expressed, the parties hereto agree as follows: 1. The term of this agreement shall be for a period of one (1) year, from July l, 1988, through June 30, 1989, unless further modified to include other permitted expenditures of funds that are appropriated by the City Council. 2. The administration of the Grantee agrees to expend City-appropriated funds to meet bona fide obligations incurred for transportation costs for clients of the South Bay Adult Day Health Care Center, for the period July 1, 1988, through June 30, 1989, for an amount not to exceed $8,000 as detailed in the attached budget (Exhibit A). 3. Payment of those City-appropriated funds shall be made to the Grantee monthly in arrears in roughly equal amounts following receipt by the City of expenditure reimbursement claim forms. 4. The Grantee shall maintain all financial records for three years following the year in which it was active. 5. In exchange for those City-appropriated funds, the Grantee agrees to provide transportation assistance for Chula Vista residents, who are disabled elderly, to be brought tothe Day Health Care Center by HandYtrans. Approximately 6,666 trips (at $1.20 each) are to be provided free to Grantee clients. 6. The Grantee shall provide the City with a quarterly report to include the following statistics relative to its clients: (1) Number of clients served (2) Gender of clients (3) Number of low income clients (4) Ethnicity of clients (5) Residency of client (6) Number of clients provided with transportation assistance (6) Amounts of subsidy provided for clients (7) Previous quarter's expenditures of Block Grant funds 7. Performance of this agreement may not, by subagreement, be assigned to any other entity without prior written consent of the City. 8. The City, at its discretion may require the Grantee to provide or allow the City to undertake a complete financial and program audit of its records. Those records shall contain, at a minimum, the following information for each client served: income, residency, gender and ethnicity. The records shall also contain documentation of subsidies provided to clients and rental payments. 9. The Director of Community Development, or his/her designated representative, shall represent the City in all matters pertaining to the services rendered pursuant to the agreement and shall administer this agreement on behalf of the City. 10. The Director of Adult Protective Services, or his/her designated representative, shall represent the Grantee in all matters pertaining to the services rendered pursuant to the agreement and shall administer this agreement on behalf of the Grantee. 11. The Grantee shall comply with Executive Order 11246, entitled "Equal Employment Opportunity," as amended by Executive Order 11375 and as supplemented in Department of Labor regulations 41 CFR Part 60. -2- 12. The Grantee agrees to abide by the requirements of OMB Circular iL~-- A-102, and specifically Attachment "0", Items 7 and 14. 13. The Grantee also agrees to comply with OMB Circular A-122 entitled "Cost Principles for Non-Profit Organizations." 14. The contract may be terminated or suspended by the City after 60 days notice to the Grantee due to default by the Grantee or the Grantee's inability to perform, regardless of whether such inability is due to circumstances within or beyond the grantee's control. Settlement of any disputes shall be based on the laws of the State of California. 15. The parties reserve the right to pursue any remedy provided under California law for remedy in instances where contractors violate or breach contract terms. 16. The Grantee shall account for the use of Block Grant funds separately from other funds, so as to demonstrate that the funds are used for their designated purposes. 17. Any program income derived from Block Grant funds must be reported to the City and can be used by Grantee only for activities approved ~ ~ by this contract. The Community Development Block Grant funds will be used to provide disabled elderly Chula Vista residents transportation to the South Bay Adult Day Health Care Center. Adult Protective Services, Inc. will furnish the Community Development Dept. Of the City of Chula Vista with quarterly reports on the characteristics of the persons served - number, gender, ethnicity and whether of low or lower income as defined for the San Diego Metropolitan Area. 100% will be disabled, over 60, residents of Chula Vista and within the income guidelines. The program serves 85 persons at any one time who are eligible for this assistance. However, the reports will be made on the actual numbers of people and the actual number of trips at approximately $1.20 each paid for with Block Grant funds. It is the objective of this program to restore as many disabled elderly as possible to an increased level of self-care so as to avoid both nursing home placement and the breakdown of home caregivers.
