On May 14, 1976, Tom Silvers of Tucker, Sadler and Associates, on behalf
of Adma Company, Inc., owners of the properties at the southwest corner
of Otay Lakes Road and Bonita Road, submitted an application with the
required $50 fee to request a deferral of undergrounding the 12 KV power
lines along the west side of Otay Lakes Road, in accordance with Section
15.32.040 of the Chula Vista Municipal Code. Plans have been submitted
by Adma Company, Inc., to develop their property into a shopping center.
Section 15.32 of the City Code requires the undergrounding of power trans-
mission lines up to 60,000 volts within new developments. In this instance,
the 12 KV power lines are on the same pole as the existing 69 KV lines.
Section 15.32.040 of the City Code provides that the Council may defer the
requirements of undergrounding existing utility lines, if the Council finds
evidence presented at the Public Hearing that all of the following facts
exist:
1. That extraordinary conditions exist to the extent that enforcement of
this subsection would result in unnecessary hardship to the owners or
the utility company.

STAFF RECOMMENDATION:
City Council set June 22, 1976 as the date for a Public Hearing to consider
the deferral of undergrounding the 12 KV power line at the southwest
corner of Otay Lakes Road and Bonita Road, in accordance with Section
15.32.040 of the Chula Vista Municipal Code.
