HomeMy WebLinkAboutReso 1988-13674 RESOLUTION NO. 13674 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING NEGATIVE DECLARATION IS-89-3 AND AUTHORIZING THE ISSUANCE OF COASTAL DEVELOPMENT PERMIT #033 TO SANTA FE LAND IMPROVEMENT COMPANY FOR DEMOLITION AND REMOVAL OF GREENHOUSES, PACKING SHED, ACCESSORY STRUCTURES AND RESIDUAL DEBRIS FROM THE CENTRAL PORTION OF THE MIDBAYFRONT SUBJECT TO THE REQUIREMENTS IN FINDING #1 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, in accordance with the California Environmental Quality Act, environmental review has been completed on the proposed project and Negative Declaration IS-89-3 has been issued; and, WHEREAS, The Chula Vista Bayfront Local Coastal Program/LCP) was certified by the California Coastal Commission; and, WHEREAS, said 'LCP' includes coastal development permitting ~_procedures determined by the Coastal Commission to be legally adequate for ssuance of Coastal Development Permits; and, WHEREAS, the City of Chula Vista has assumed permit authority over the Chula Vista Coastal Zone; and, WHEREAS, a public hearing was held on July 19, 1988, in accordance with said permitting procedures; and, WHEREAS, the City Council of the City of Chula Vista, as approving authority, has reviewed the proposal for demolition and removal of the greenhouses, packing shed, accessory structures, and residual debris from the Midbayfront. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista finds, based on the following findings, in accordance with the Section 13311 of the California Administrative Code, that the demolition of the greenhouses, packing shed, accessory structures, and residual debris from the Midbayfront and their removal is consistent with the policies of the Chula Vista Bayfront LCP. 1. Consistent with the grading and drainage requirements in Section 19.87.07 of the Specific Plan, siltation in wetland areas resulting from site runoff will be minimized by requiring the applicant to conduct any backfilling that may be required between April 1 and November 1. In addition, the disturbed area will be required to be planted within 60 days of initial ~'isturbance and prior to November 1. Finally, the planting shall be done under the supervision of a licensed landscape architect and will provide seeding, mulching, fertilization, and irrigation adequate to provide 90 percent coverage within 90 days (planting will be repeated if adequate coverage is not established). In addition, if the removal of fuel storage tanks is required, the applicant shall obtain permits from the City Fire Department and the County Health Department and shall comply with any special conditions in those permits. 2. The dilapidated structures are located on the portion of the Midbayfront zoned for office park and highway commercial use. Removal of the proposed structures is consistent with the planned use of the site. 3. The demolition of the area would improve the visual quality of the Midbayfront and thus is consistent with LCP form and appearance guideline which states: "Improve the visual quality of the shoreline by promoting public and private uses which provide proper restoration, landscaping, and maintenance of shoreline areas." 4. The demolition of the greenhouses, packing shed, accessory structures, and residual debris would also remove a blighting influence on the area consistent with the form and appearance guideline which states: "Remove, or mitigate by landscaping, structures or conditions which have a blighting ~"influence on the area." BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista hereby adopts Negative Declaration IS-89-3 and finds that issuance of Coastal Development Permit #033 will have no significant impacts on the environment. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista hereby issues Coastal Development Permit #033 for the demolition and removal of greenhouses, packing shed, accessory structures, and residual debris from the central portion of the Midbayfront subject to the requirements in Finding #1.
