STM370" PROJECT TO CMT ENGINEERING, INC. IhI THE AMOUNT OF $81,695 AND AUTHORIZING THE EXPENDITURE OF ALL AVAILABLE FUNDS IN THE PROJ CT SUBMITTED BY: DIRECTOR OF PUBLIC WORKS 4:ASSISTANT DIRECT R OF ENG E ING REVIEWED BIIY: CITY MANAGE ASSISTANT CIT MANAGER S%- 4/STHS VOTE: YES ^ NO SUMMARY On July 6, 2011, the Director of Public Works received five (5) sealed bids for the "Northeast Comer of North Fourth Avenue and Brisbane Street Improvements CIP No. STM370". The proposed work consists of the installation of curb, gutter and sidewalk improvements, driveway, pedestrian ramps, enhanced traffic signal facilities, signage, striping, and other miscellaneous work to complete the project at the intersection of North Fourth Avenue and Brisbane Street. The proposed action would award the contract to CMT Engineering, Inc. and authorize the expenditure of available funds for completion of construction. ENVIRONMENTAL REVIEW The Director of Development Services has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1 categorical exemption pursuant to Section 15301(Existing Facilities) of the State CEQA Guidelines because the project will improve and reconstruct existing street facilities. Thus, no further environmental review is necessary. RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable. 5-1 8/02/11, Item Page 2 of 3 DISCUSSION One of the purposes of this project is to provide a safer and accessible vehicular travel path through the northeast corner of North Fourth Avenue and Brisbane Street. Project design staff prepared engineering plans and specifications and advertised the project on June 16, 2011. On July 6, 2011, the Director of Public Works received five (5) sealed bids. The following bids were received: CONTRACTOR BID AMOUNT 1. CMT Engineering, Inc. -San Diego, CA $81,695 2. Palm Engineering Construction Company, Inc. -San Diego, CA $82,080 3. PAL General Engineering, Inc. -San Diego, CA $83,714 4. HTA Engineering & Construction -Poway, CA $86,740 5. Ramona Paving & Construction -Ramona, CA $94,500 The low bid submitted by CMT Engineering, Inc. is below the Engineer's estimate of $85,000 by $3,305 (4% below the Engineer's estimate); Design staff has verified the references provided by the contractor and has determined that the contractor has performed satisfactorily for those references. The Contractor's License No. 949176A is current and active. The proposed resolution would also authorize the Director of Public Works to approve change orders over and above existing policy limits. Under City Council Policy No. 574-01, if an individual change order causes the cumulative increase in change orders to exceed the Director's authority ("Maximum Aggregate Increase in Change Orders"), then City Council approval is required. The corresponding maximum aggregate contract increase that maybe approved by the Director of Public Works under Policy No. 574-01 is $8,170. Approval of tonight's resolution would increase the Director of Public Works' authority to approve change orders, as necessary, up to the contingency amount of $20,425, an increase of $12,255 over Policy No. 574-O1. Increasing the contingency funds will allow staff to continue the project without delay should unforeseen circumstances resulting in increased project costs arise during the course of construction, as well as make adjustments to bid item quantities. Unforeseen conditions include such items as utility conflicts, hazardous materials, unexpected underground conflicts, etc. If the contingency funds are not used, then they will be returned to the project fund balance. Disclosure Statement Attached is a copy of the contractor's Disclosure Statement as Attachment 1. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the properties, which are the subject of this action. 5-2 8/02/11, Item S Page 3 of 3 CURRENT YEAR FISCAL IMPACT A breakdown of the project costs is as follows: FUNDS REQUIRED FOR CONSTRUCTION A. Contract Amount B. Contingencies (25%) $ 81,695 $ 20,425 TOTAL FUNDS REQUIRED FOR CONSTRUCTION $ 102,120 Sufficient funds are available in the STM370 project account to complete construction. ON-GOING FISCAL IMPACT: Upon completion of the project, the improvements will require only routine City maintenance totaling $500 annually. ATTACHMENTS 1. Ramona Paving & Construction -Ramona, CA $94,500 WHEREAS, the low bid submitted by CMT Engineering, Inc. is below the Engineer's Estimate of $85,000 by $3,305 or approximately 4%; and WHEREAS, design staff has verified the references provided by the contractor and has determined that the contractor has performed satisfactorily for those references; and WHEREAS, staff has reviewed the low bid and recommends awarding the contract to CMT Engineering, Inc. of San Diego, California; and WHEREAS, in order to approve change orders as necessary, staff is requesting City Council waive Council Policy No. 574-01. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does award the contract for the "Northeast Corner of Fourth Avenue and Brisbane Street Improvements CIP No. STM370" project to CMT Engineering, Inc. in the amount of $81,695. 5-6 Resolution Page 2 BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does hereby waive Council Policy 574-01 and authorize the Director of Public Works to approve change orders, as necessary, up to the contingency amount of $20,425 and expen 11 'ale funds in the project. ~ Presented by to Richard A.
