CalRecycle's Rubberized Asphalt Concrete (RAC) grant program is designed to encourage activities that promote reducing the number of waste tires going to landfills for disposal. The program provides assistance to local governments to fund rubberized asphalt concrete (RAC) projects including hot mix asphalt concrete and chip seal. There were two types of grants: (1) Targeted Rubberized Asphalt Concrete Incentive (Targeted) and (2) Rubberized Asphalt Concrete Chip Seal (Chip Seal) of which there is available funding. The City received notification of award for both grants via letter dated May 31, 2011 for a total of $500,000. ENVIRONMENTAL REVIEW The Development Services Director has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1 categorical exemption pursuant to Section 15301(Existing Facilities) of the State CEQA Guidelines because the proposal consists of appropriating State funds for street maintenance projects. Thus, no further environmental review is necessary. 4-1 8/02/11, Item Page 2 of 3 RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSIONS Not applicable. DISCUSSION The California Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California Integrated Waste Management Board (CIWMB), provides the Rubberized Asphalt Concrete (RAC) Grant Program to promote markets for recycled-content surfacing products derived from waste tires generated in California and decrease the adverse environmental impacts created by unlawful disposal and stockpiling of waste tires. For fiscal year 2010-2011, a total of $3,509,334 was available for the Targeted RAC Grant and $2,000,000 was available for the Chip Seal Grant. The City applied for and was awarded funding for both grants in the amount of $250,000 for each grant. Staff is recommending accepting these funds for expenditure in the Capital Improvement Program. Eligible costs include expenditures incurred during the grant term that are directly related to the project(s) rubberized paving material and its installation. All projects are subject to the following requirements: One hundred percent (100%) California-generated waste tires must be used in the rubber portion of the project(s). ^ Reimbursement will not exceed the amount stated on the Grant Agreement Cover Sheet (CalRecycle 110). Construction of the RAC portion of any project must commence on or after the date indicated in the Notice to Proceed and be completed by April 1, 2013. The binder material must contain a minimum of 300 pounds (equivalent to 15 percent by weight) of the tire-derived crumb rubber per ton of rubberized binder. For Targeted RAC Incentive Grant, project(s) must use a minimum of 3,500 tons of RAC. For RAC Chip Seal Grant, project(s) must use a minimum area of 35,000 square yards of RAC chip seal material. A copy of the completed application is attached for reference. There are two existing pavement-related projects in the City's Capital Improvement Program that will utilize these materials, STL371 and STL373. In an effort to expend the grant funds according to the grant guidelines and in a timely manner, staff is recommending appropriating the grant funds to these two projects for expenditure. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the properties, which are the subject of this action. 4-2 8/02/11, Item Page 3 of 3 CURRENT YEAR FISCAL IMPACT The RAC Grant funds will pay direct costs related to the rubberized paving material and its installation on a reimbursement basis not to exceed $250,000 for each project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby authorize the submittal of application to CalRecycle for any and all grants for which the City of Chula Vista is eligible during the current grant cycle. "LTte comparison takes into consideration, to the extent feasible, raw materials acquisition, production, manufacturing, packagin„ distribution, reuse, operation, maintenance, disposal, energy efficiency, product performance, durability, safety, the needs of the purchaser, and cost. "Extended Producer Responsibility" means the extension of the responsibility of producers, and all entities involved in the product chain, to'reduce the impacts of a product and its packaging. `'Total Cost of Ownership" means a summary of all gurchase, operating, and related costs far a product or service, including the acquisition, transportation, receiving, inspection, training, maintenance, operating, energy use, and disposal costs. REPORTS: Departments shall provide the City Manager with regorts regazding purchase of environmentally referable roducts in such form and at such times as the City ltilanager may direct. 11 4-16 RESOLUTION NO. 2011- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING RUBBERIZED ASPHALT CONCRETE (RAC) GRANT FUNDS IN THE AMOUNT OF $500,000, AMENDING THE FY 2011-12 STATE GRANTS' FUND BY APPROPRIATING SAID GRANT FUNDS TO TWO EXISTING PAVEMENT-RELATED CAPITAL IMPROVEMENT PROJECTS, "PAVEMENT REHAB (OVERLAY)" CIP STL371 AND "PAVEMENT REHAB (CHIP SEAL)" CIP STL373, IN THE AMOUNT OF $250,000 FOR EACH PROJECT, AND AMENDING THE FY 2011-12 CIP BUDGET WHEREAS, on February 1, 2011, by Resolution 2011-014, Council approved the application for Rubberized Asphalt Concrete Grant Funds; and WHEREAS, CalRecycle's Rubberized Asphalt Concrete (RAC) grant program is designed to encourage activities that promote reducing the number of waste tires going to landfills for disposal and provides assistance to local governments to fund rubberized asphalt concrete (RAC) projects including hot mix and chip seal; and WHEREAS, the City received notification of award for Targeted Rubberized Asphalt Concrete ($250,000) and Incentive Rubberized Asphalt Concrete Chip Seal ($250,000) grants via letters dated May 31, 2011, for a total of $500,000; and WHEREAS, all projects funded by the grants aze subject to the following requirements: • One hundred percent (100%) California-generated waste tires must be used in the rubber portion of the project(s). Reimbursement will not exceed the amount stated on the Grant Agreement Cover Sheet (CalRecycle 110). ^ Construction of the RAC portion of any project must commence on or after the date indicated in the Notice to Proceed and be completed by April 1, 2013. The binder material must contain a minimum of 300 pounds (equivalent to 15 percent by weight) of the tire-derived crumb rubber per ton of rubberized binder; and WHEREAS, there are two existing pavement-related projects in the City's Capital Improvement Program (CIP) that will utilize these materials, "Pavement Rehab (Overlay)" STL371 and "Pavement Rehab (Chip Seal)" STL373; and WHEREAS, staff recommends that the City Council accept the grant funds for expenditure in the Capital Improvement Program, appropriate the grant funds to the two, above- mentioned projects for expenditure, amend the FY 2011-12 State Grants' Fund; and, amend the FY 2011-12 CIP Budget. 4-17 Resolution No. Page 2 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby accept grant funds for Rubberized Asphalt Concrete (RAC) in the amount of $500,000 and amend the FY2011-12 State Grant Fund by appropriating said grant firnds to two existing pavement related capital improvement projects - "Pavement Rehab (Overlay)" CIP STL371 and "Pavement Rehab (Chip Seal)" CIP STL373 in the amount of $250,000 for each project.
