RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA AUTHORIZING RANCHO DEL SUR TO
CONSTRUCT A PORTION OF TELEGRAPH CANYON ROAD
AND CERTAIN IMPROVEMENTS FROM 1-805 TO PASEO
LADERA AND RECEIVE CREDIT OR A CASH
REIMBURSEMENT AS DETERMINED BY THE CITY
AGAINST DEVELOPMENT IMPACT FEES REQUIRED BY
ORDINANCE NO. 2251 AT THE TIME BUILDING
PERMITS ARE ISSUED FOR THE DEVELOPER'S PROJECT
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Rancho del Sur has requested authorization to
construct a portion of Telegraph Canyon Road and certain
improvements from 1-805 to Paseo Ladera and receive credit or a
cash reimbursement against Development Impact Fees pursuant to
Ordinance No. 2251 adopted January 12, 1988, and
WHEREAS, Ordinance No. 2251 established a Development
Impact Fee to pay for transportation facilities in the eastern
territories of the City and provides that a developer may request
authorization from the City Council to construct one or more of
the transportation facilities listed in the ordinance.
WHEREAS, the segment of Telegraph Canyon Road from 1-805
and Paseo Ladera is one of the facilities listed in the ordinance.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby authorize Rancho del Sur to
construct a portion of Telegraph Canyon Road and certain
improvements from 1-805 and Paseo Ladera.
BE IT FURTHER RESOLVED that Rancho del Sur shall receive
credit or a cash reimbursement relative to the costs of the
construction referred to in the foregoing resolution in an amount
determined by the City of Chula Vista. Any such credit shall be
offset against Development Impact Fees required by Ordinance No.
2251 at the time building permits are issued for the Rancho del
Sur project; it being acknowledged that while Rancho del Sur
anticipates selling units of the its project to guest builders,
all such credits shall be applied only to Rancho del Sur and all
Development Impact Fees shall be accepted only through Rancho del
Sur and not directly from guest builders.

Reference: Eastern Area Development Impact Fee for
Transportation Facilities (Telegraph Canyon Road)
Dear John:
In accordance with Ordinance No.2251 adopted January 12, 1988
which establishes a Development Impact Fee to pay for
transportation facilities in the eastern territories, Rancho Del
Sur requests authority from the City Council to construct a
portion of a Transportation Facility which is to be financed by
the Development Impact Fee. We also wish to receive credit for
these construction expenditures as determined by the City
(including the $70,000.00 deposit for the traffic signal pursuant
to Resolution No.13539 of City Council) against Development
Impact Fees otherwise required at the time of issuance of
building permits in the Rancho Del Sur project (Tract 87-8, Phase
I, Units 1 through 5 [Sunbow]).
The transportation facility that we wish to receive credit for
Telegraph Canyon Road and that portion of the improvements to the
1-805 Interchange required as part of Rancho Del Sur, Units 1
through 5, Phase I, Tract 87-8. The facilities which we propose
to construct represent a portion of the improvements under
Section 3 (Item a-3) as indicated on Page 5 on Ordinance No.2251.
The following information is submitted as required:
1. A detailed description of the project with a
preliminary cost estimate is included as Exhibit "A"
(attached).
2. Rancho Del Sur has submitted and received approval of
the plans required to complete the work.
3. All necessary permits and environmental clearances on
the Telegraph Canyon work have been received. The
permits for the work under the 1-805 freeway are being
obtained.

4. All necessary right-of-way required for the Telegraph
Canyon improvements has been obtained.
5. Rancho Del Sur will pay all required permit and plan
check fees and post any security which is necessary for
the project.
6. The City will not be responsible for any of the costs
of constructing the project. All funds to construct
the project shall be advanced by the Rancho Del Sur
Partnership pursuant to Resolution No.13295 as part of
a "Facilities Benefit District".
7. Rancho Del Sur shall secure at least three (3)
qualified bids for work to be done. Any extra work or
charges during construction shall be justified and
-- shall be documented.
8. When all work has been completed to the satisfaction of
the City, Rancho Del Sur shall submit verification of
payments made for the construction of the project to
the City. The Director of Public Works shall make the
final determination on expenditures which are eligible
for credit or cash reimbursement.
9. Rancho Del Sur will receive a credit against required
Development Impact Fees at the time building permits
are issued on the project (Tract 87-8, Units 1 through
5). Please note that Rancho Del Sur anticipates
selling units of the project to guest builders, but all
credit reimbursements shall be applied only to Rancho
De Sur. All Development Impact Fees shall be accepted
only through Rancho Del Sur and not individual
builders.
10. If the total construction cost amounts to more than the
total Development Impact Fees which will be required
for the Rancho Del Sur project, then the amount in
excess of Development Impact Fees will be paid in cash
to Rancho Del Sur, when funds are available as
determined by the City Manager, or a reimbursement
agreement will be executed.

Pursuant to City Council's desire to expedite the improvements in
Telegraph Canyon Road, some of the construction work has already
been started in accordance with the approved Improvement Plans.
The remaining work will commence in approximately thirty (30)
days.
Your assistance in resolving this matter as quickly as possible
will be greatly appreciated.

DESCRIPTION OF FACILITIES .PROPOSED TO BE CONSTRUCTED
1. Improvement of Telegraph Canyon Road as indicated on Item
II-1 of the final draft of the "Interim Eastern Area
Development Impact Fees for Streets" dated November, 1987.
2. Improvements for the Telegraph Canyon Road and 1-805
Interchange as required by Conditions. #5 and #30 of the City
Council Resolution No.13111, dated July 27, 1987, and
amended by Resolution No.13539 dated May 2, 1988. The
amended Condition #30 has been satisfied by the deposit of
$70,000.00 with the City as part of these reimbursable
improvement costs.
3. The 1-805 and Telegraph Canyon Road Interchange will be
modified to allow an additional turn lane in east bound
Telegraph Canyon Road, onto the northbound on-ramp of 1-805.
This will be accompanied by modification of the traffic
signalization on the east side of the Interchange.
4. Telegraph Canyon Road will be improved to the limits
illustrated on Sheets 3, 4 and 5 of the Approved Plans for
the Improvement of Rancho Del Sur, Tract No.87-8, Phase I,
Units 1 through 5. Improvement on the Telegraph Canyon Road
will begin at approximately Sta.ll+00.00 and extend to
Sta.46+00.00. The Telegraph Canyon Road improvements will
include the modification of the traffic signalization at the
intersection of Telegraph Canyon Road and Medical Center
Drive.
5. Improvement to the aforementioned'transportation facilities
will include, but not be limited to, the following: curb,
gutter, AC berm, sidewalk, street lights, street light pull
boxes-conduit-trench, traffic signal modification,
guardposts, striping, AC paving, AC overlay.
6. These improvements will require demolition of certain
existing improvements, as well as grading and associated
drainage structures and piping. There will also be erosion
control applied to slopes and landscaping in the parkway.
7. The widening of Telegraph Canyon Road from Medical Center
Drive to Sta.46+00 will require the relocation of the SDG&E
Electrical Structure at Sta.41+02.
8. Traffic control and temporary construction detours
comsisting of paving, barricades, striping and cones.
