HomeMy WebLinkAboutReso 1988-13651 88 35297'2 ECORDINO REQUESTED B~ v v i. 3 · NO FEE RESOLUTION NO. 13651 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING GRANT DEED TO CERTAIN REAL PROPERTY FROM SOUTHWESTERN COMMUNITY COLLEGE DISTRICT FOR TRAFFIC CONTROL EASEMENT FOR BONITA POINT SHOPPING CENTER LOCATED AT THE NORTHWEST CORNER OF EAST "H" STREET AND OTAY LAKES ROAD The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT ~ESOLVED that that certain grant of real property, made by grant deed executed by Southwestern Community College District for traffic control easement for Bonita Point Shopping Center at the NW corner of East "H" Street and Otay Lakes Road dated the 15th day of June , 19 88 , to the CITY OF CHULA VISTA, a copy of which is attached hereto and by this reference made a part hereof, the same as though fully set forth herein be, and the same is hereby accepted by the City of Chula Vista as a grant in BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be,and she is hereby authorized and directed to record said grant deed on behalf of the City in the office of the San Diego County Recorder. I4. 5GG. tO D~Wl, J B~:R.f: ~TITLE,: TRAFFIC EASEMENT FOR SIGNAL MAINTENANCE AIJD COIq~TRUCTIOM AT OFAY [AKE9 ROAD D~TE: 4-eo-~ AMD ~HOPPlHG CENTER DRIVEWAY RESOLUTION NO. 901 RESOLUTION DEDICATING REAL PROPERTY OWNED BY THE SOUTHWESTERN COMMUNITY COLLEGE DISTRICT TO THE CITY OF CHULAVISTA FOR TRAFFIC EASEMENT FOR CONSTRUCTION AND MAINTENANCE OF SIGNAL LIGHT On motion of Member Blank, seconded by Member Neves-Perman, the following resolution is adopted: WHEREAS, this Board on May 10, 1988, adopted a Resolution of Intention to Dedicate to the City of Chula Vista a traffic easement for construction and maintenance of a signal light at East 'H' Street and Shopping Center Driveway; and WHEREAS, said Resolution of Intention provided that a public hearing on the question of making such dedication be held by this Board at the regular place of meeting on June 14, 1988 at 7:30 p.m. at which time and place all persons interested might appear and show cause, if any they had, why said dedication should not be made, and WHEREAS, notice of adoption of said Resolution of Intention was duly given as provided by law, all of which appears by the affidavits !f posting and publication on file in the office of this Board; and WHEREAS, this Board formally convened at the time and place set forth in said Resolution of Intention, and no person appeared to object to or protest either verbally or in writing against the dedication of easement described in said Resolution; and WHEREAS, in the judgment of this Board it is expedient and in the best interests of this District that said dedication be made; NOW THEREFORE BE IT RESOLVED by the Governing Board of the Southwestern Community College District of San Diego County, California: That a traffic easement for construction and maintenance of a signal light at East 'H' Street and Shopping Center Driveway, and more particularly described in said Resolution of Intention, is hereby dedicated to the City of Chula Vista for said purpose. BE IT FURTHER RESOLVED that the Superintendent/President of Southwestern Community College District is hereby authorized and directed to execute and deliver a Grant Deed for the easement described in said Resolution of Intention to said City. Moved by GRIFFITH , seconded by PERMAN , the following resolution is adopted: WHEREAS, the City of Chula Vista, County of San Diego, State of California, has requested the transfer of land belonging to the Southwestern Community College District for a traffic easement for construction and maintenance of a signal light at East 'H' Street and Shopping Center Driveway; and WHEREAS, in the judgment of this Board, public convenience and necessity, make it expedient to dedicate to the said city land adequate to provide construction and maintenance of a signal light at East 'H' Street and Shopping Center Driveway; and WHEREAS, it is the judgment of this Board that the dedication of the land as aforesaid will be of direct benefit to this District in providing safety for community residents; NOW THEREFORE BE IT RESOLVED AND DETERMINED that pursuant to Education Code Section 81310, eto seq., this Board declares its intention to dedicate to the City Of Chula Vista the following described real property: Being a portion of Parcel 1 of Parcel Map No. 5481 on file in the Office of the County Recorder of San Diego County, in the City of Chula Vista, County of San Diego, State of California, more particularly described as follows: Beginning at the Westerly point of said Parcel 1, said point being on the Southerly right-of-way line of East 'H' Street as shown on · said parcel map No. 5481; thence along said right-of-way line 1. BE IT FURTHER RESOLVED that the Grantee shall indemnify and hold the Grantor harmless against all claims for damage or suits for loss, including costs and attorney's fees, arising from injury to any person(s) or property or life, caused by or resulting from acts, or omissions by the Grantee, its successors or assigns, arising from the construction, operation or maintenance of the aforementioned traffic signal. BE IT FURTHER RESOLVED AND ORDERED that a public meeting of this Board be held at its regular place of meeting, to wit, Room 214, Southwestern College, on June 14, 1988, at 7:30 p.m. for a public hearing on the question of making the dedication as aforesaid in order that persons desiring to protest against the proposed dedication may appear and be heard and may file with the Governing Board any petitions of protest as provided in Section 81314 of the Education Code. BE IT FURTHER RESOLVED AND ORDERED that notice of the adoption of this resolution and of the time and place of holding the public eeting described in the preceding paragraph shall be given by posting copies of this resolution signed by the members of this Board, or by a majority hereof, in three public places in the District not Iess than ten (10) days before the date of the public meeting and by publishing a notice once not less than five (5) days before the date of the meeting, in the Chula Vista Star News, a newspaper of general circulation published in the District.
