HomeMy WebLinkAboutReso 1977-8656RESOLUTION N0. 8656 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING PRECISE PLAN FOR DEVELOPMENT OF .44 ACRE AT THE NORTHWEST CORNER OF THIRD AVENUE AND KIMBALL TERRACE WITH FIVE APARTMENT UNITS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council of the City of Chula Vista has heretofore received the recommendation of the Planning Commission, as contained in their Resolution No. PCM-77-9, adopted on the 25th day of May, 1977, setting forth the precise plan for the develop- ment of .44 acre at the northwest corner of Third Avenue and Kimball Terrace with five apartment units, and WHEREAS, the City Council of the City of Chula Vista has heretofore held a public hearing to consider said precise plan on June 14, 1977, and has taken testimony and heard evidence thereon, and WHEREAS, the Negative Declaration on IS-77-11 has hereto- fore been reviewed and certified by the City Council in conjunction with the approval of the rezoning of the subject property. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby adopt the precise plan for .the development of .44 acre at the northwest corner of Third Avenue and Kimball Terrace with five apartment units in accordance with Resolution No. PCM-77-9 of the Chula Vista Planning Commission. PCM-77-9 ' RESOLUTION OF THE CITY PLANNING COMMISSION P,ECOMMENDING TO THE CITY COUNCIL THE APPROVr+L OF A PRECISE PLAN FOR DEVELOPMENT OF .44 ACRE AT THE NORTHWES~I CORNER OF THIRD AVENUE AND KIMBALL TERRACE WITH FIVE APARTMENT UNITS WHEREAS, in conjunction with an application for change of zone from R-1 to R-3-P-12 for the property at the northwest corner of Third Avenue and Kimball Terrace, a Precise Plan for development of the site with five apartment units was submitted by Michael J. Roark on Febr. 25, 1977, and WHEREAS, the City Planning Commission, at a duly advertised public hearing held at 7:00 p.m. March 23, 1977 and continued to April 20, 1977 and May 25, 1977, in the Council Chamber, City Hall, 276 fourth Avenue, considered the Precise Plan as submitted, and WHEREAS, on March 23, 1977 the Planning Commission certified the Negative Declaration on IS-77-11 for the proposed development. NOW THEREFORE BE IT RESOLVED THAT THE CITY PLANNING COMMISSION finds as follows: a. That such plan will not, under the circumstances of the particular case, be detrimental to the health, safety or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity. The proposed plan is a well designed project with ample setbacks and parking. The architecture has been made interesting through the use of offsets, balconies, and split level construction, and should therefore not be detri- mental to the health, safety or general welfare of persons or improvements in the area. b. That such plan satisfies the principle for the application of the "P" Modify- ing District. The proposed plan either meets or exceeds the precise plan guidelines per- taining to open space, setbacks and access. c. That any exceptions granted which deviate from the underlying zoning require- ments shall be warranted only when necessary to meet the purpose and application of the "P" Precise Plan Modifying District. The reduction of the required landscaped strip on Third Avenue from 10 feet to 5 feet is warranted because of the physical constraints of the property due to its steep topography and lot configuration. The granting of the exception will not adversely affect adjacent properties or impair sight distances. d. That the approval of this plan will conform to the General Plan and the adopted policies of the City. ' The approval of this project will not adversely affect the General Plan. BE IT FURTHER RESOLVED that the City Planning Commission recommends to the City Council the approval of the Precise Plan for the development of five apartment units at the northwest corner of Third Avenue and Kimball Terrace, subject to the following conditions: 1. Any proposed signs shall be subject to approval by the Zoning Administrator. 2. Low level planting shall be provided within the front 5 feet along Third Avenue. Any proposed trees within this area shall be selected for their high branching structure and shall be subject to approval by the Department of Public Works and the City Landscape Architect. 3. A.six foot high fence shall be located on the westerly property line and behind the front setbacks on Kimball .Terrace and'Third Avenue. 4. The paved access area leading to the parking stalls shall utilize textured paving in part to soften the exposed paving area in front.
