HomeMy WebLinkAboutReso 1977-8615~' RESOLUTION NO. 8615 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ELECTING TO PROCEED UNDER THE PROVISIONS OF THE PUBLIC SERVICE EASEMENT VACATION LAW OF THE STATE OF CALIFORNIA, DECLARING THE CITY'S INTENTION TO VACATE A SEWER EASEMENT IN LOT 14, QUARTER SECTION 136, C~-:ULA VISTA MAP 505, AND FIXING A TIP~lE AND PLACE FOR HEARING THEREON The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Bill Gentry, the developer of the proposed Gentry Glen Condominiums has submitted plans which in order to build in conformance with the approved precise plan requires the relocation of an existing sewer main through the site at 75 Third Avenue, and WHEREAS, the City Council has heretofore accepted for dedication a new easement for sewer purposes in conjunction with the filing of a parcel map for the site, and WHEREAS, the engineer for the developer has requested vaca- tion of a sewer easement in Lot 14, Quarter Section 136, Chula Vista Map 505 under the provisions of the Public Service Easement Vacation Law of the State of California, and WHEREAS, the City Council of the City of Chula Vista has determined that the public interest and convenience of said City require the vacation of said sewer easement, more particularly des- cribed in Exhibit "A", attached hereto and incorporated herein by reference as if set forth in full. I1OW, THEREFORE, BE IT RESOLVED that it is the intention of the City Council to order the vacation of a sewer easement in Lot 14, Quarter Section 136, Chula Vista Map 505, more particularly described in Exhibit "A". BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista hereby elects to proceed in making said vacation under the provisions of the Public Service Easement Vacation Law of the State of California, and hereby fixes Tuesday, the 24th day of May, 1977 at 7:00 p.m., in the Council Chambers of City Hall, 276 Fourth Avenue, Chula Vista, California, as the time and place for hearing all persons interested in or objecting to the proposed vacation. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby directed to cause a copy of this resolution to be published once in the Chula Vista Star News, a newspaper of general circulation, and to cause notices of the passage of this resolution to be posted in the manner and form required by law. City Clerk LEGAL DESCRIPTION VACATION OF EXISTING SANITARY SEWER EASEMENT All of that portion of Lot 14, 1 /4 Section 136, Rancho de la Nation, Map No. 505, Records of San Diego County, California, lying within a strip of land 6 feet in width, the side lines of which are 3 feet measured at right angles from the center line and its prologations, said center line being decribed as follows: Beginning at a point in the Northerly line of said Lot 14, said point being distant 95.43 feet Northeasterly from the Northwesterly corner of said Lot 14, thence South ?1° 23145" East, 122. 36 feet to the True Point of Beginning; ,thence Northeasterly 435.24 feet more or less to the Northeasterly corner of said Lot 14, as granted to the City of Chula Vista by deed recorded August 26, 1948 as File No. 86260.
