RESOLUIION OF THE CIIY COUNCIL OF THE CIIY OF CHULA
VISTA AUTHORIZING THE ISSUANCE OF COASTAL DEVELOPMENT
PERMIT #041 TO SDG&E FOR SITE PREPARATION FOR WASTE-
WATER TANKS SUBJECT TO THE CONDITIONS OF APPROVAL IN
ATTACHMENT A
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Chula Vista Bayfront Local Coastal Program (LCP)
was certified by the California Coastal Commission; and,
WHEREAS, said LCP includes coastal development permitting
procedures determined by the Coastal Commission to be legally adequate
for issuance of Coastal Development Permits; and,
WHEREAS, the City of Chula Vista has assumed permit authority
over the Chula Vista Coastal Zone; and,
WHEREAS, a public hearing was held on August 23, 1988, in
accordance with said permitting procedures; and,
WHEREAS, the City Council of the City of Chula Vista, as
approving authority has reviewed the proposal for grading, pavement,
and containment wall construction on a 46,500 square foot area on the
South Bay Power Plant site.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Chula Vista finds, based on the following findings, in
accordance with Section 13311 of the California Administrative Code,
that the site preparation for wastewater tanks is consistent with the
policies of the Chula Vista Bayfront LCP.
1. The land use and zoning designations for the SDG&E
property are Industrial General. The use of a portion of
a property as a site for wastewater tanks is consistent with
the provision in Section 19.82.35 for allowing "other
accessory uses and buildings customarily appurtenant to a
permitted [industrial[ use".
2. Condition of Approval #1 prohibits grading for site
preparation between November i and April I consistent with
Section 19.87.08, Grading and Drainage, of the Bayfront
Specific Plan.
3. The project site is owned by a public utility company which
has a need for restricted access, therefore, the opportunity
for public access to the bay from this site for recreational
use is restricted and not inconsistent with the public access
policies of the certified LCP.
4. Statewide and regional interpretive guidelines have been
reviewed and the proposed project has been found to be in
conformance with the public access and public recreational
policies of Chapter 3 of the Public Resources Code.
BE IT FURTHER RESOLVED that the City Council of the City of
Chula Vista hereby issues Coastal Development Permit #041 for the site
preparation for wastewater tanks on the SDG&E South Bay Power Plant
site subject to the Conditions of Approval in Attachment A.

ATTACHMENT A
CONDITIONS OF APPROVAL
1. Grading for site preparation is prohibited between November I and
April 1. If the portion of the site preparation which requires grading
is partially done, but not expected to be completed by November 1, the
site shall be planted for temporary (until April) erosion control. Such
planting shall be accomplished under the supervision of a licensed
landscape architect and shall consist of seeding, mulching,
fertilization and irrigation adequate to provide 90% coverage within
90 days. Planting shall be repeated if the required levels of coverage
are not established.
