Home My WebLink AboutReso 1977-8536RESOLUTION NO. 8536 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA RELEASING DETROIT (LAWLESS) DIESEL FROM AN OBLIGATION TO D'IAINTAIN A PRIVATE SEWER LINE UPON CERTAIN PROPERTIES WITfiIN TFiE CITY The City Council of the City of Chula Vista does hereby resolve as follows: G~IHEREAS,in 1954 pursuant to the direction of the City Council of the City of Chula Vista, the owner of certain property more specifically described in the agreement attached hereto and incorporated as Exhibit "A" fronting upon Bay Boulevard, recorded a document agreeing to maintain sewer laterals upon a parcel split for reasons of development, and WHEREAS, since the time of the original division of the parcel located upon Bay Boulevard, the property has been brought under unified ownership, the grantee being Detroit (Lawless) Diesel, and WHEREAS, said agreement to maintain separate and individual sewer laterals on the parcel brought under unified ownership clouds the title of the present grantee and provides no needed protection to the Chula Vista sewer system. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby release Detroit (Lawless) Diesel from the obligations set forth in that certain agreement marked as Exhibit "A", previously recorded on Book 5215, Page 12 in the office of the San Diego County Recorder dated April 22, 1954. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to forward a certified copy of this resolution to the San Diego County Recorder.
