HomeMy WebLinkAboutReso 1977-8496RESOLUTION NO. 8496 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING PRECISE PLAN FOR PROPERTY AT 635 TELEGRAPH CANYON ROAD IN C-C-P ZONE, AND CERTIFYING THE NEGATIVE DECLARATIOPI The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission has heretofore conducted a public hearing on January 12, 1977 to consider the approval of a precise plan for property located at 635 Telegraph Canyon Road in the C-C-P zone at the conclusion of which hearing, the Planning Commission failed to approve the precise plan by a 3-3 vote, and WHEREAS, the negative vote for approval of the precise plan related to the proposed use as opposed to the elements of the plan itself, although the Commission was informed that such use was a permitted use in the C-C zone, and WHEREAS, the Planning Commission did vote to recommend that the City Council certify the Negative Declaration, and WHEREAS, the City Council of the City of Chula Vista has heretofore held a public hearing to consider said precise plan on February 8, 1977 and has taken testimony and heard evidence thereon, and WHEREAS, a notice of the proposed negative declaration on the development of a real estate office at 635 Telegraph Canyon Road in the C-C-P zone was given in accordance with the Environmental Review Policy, and WHEREAS, the Environmental Review Committee found that said precise plan would have no possible significant impact on the environment and forwarded the attached Negative Declaration, IS-76-115, to the City Council of the City of Chula Vista for their considera- tion, and WHEREAS, said Negative Declaration has been available to agencies having jurisdiction by law, all responsible agencies, and to the public for an adequate period of time for their review and comment, and WHEREAS, the information contained in said negative declar- ation has been considered by the City Council of the City of Chula Vista prior to its action on the discretionary item before the City Council. NOW, THEREFORE, the City Council of the City of Chula Vista finds as follows: 1. That the City Council of the City of Chula Vista adopts as its record of this finding of no possible significant impact the Council agenda statement on this agenda item and all of the attach- ments thereto. 2. That the City Council of the City of Chula Vista finds in accordance with the recommendation of the Environmental Review Committee and the attached Negative Declaration that said precise plan will not have any possible significant impact on the environ- ment, and the attached Negative Declaration, incorporated herein by reference as if set forth fully, has been prepared in accordance with the California Environmental Quality Act of 1970, as amended. - 1 - 3. That the Environmental Review Coordinator is hereby authorized and directed to file said rdegative Declaration with the County Clerk of the County of San Diego subsequent to the prepara- tion of a notice of determination on this project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve and adopt the precise plan for the conversion of a residential garage to a real estate office at 635 Telegraph Canyon Road in the C-C-P zone subject to the follow- ing conditions: 1. The applicant shall stipulate that he will not object to the formation of any assessment district or reimbursement process providing for the improvement of Telegraph Canyon Road and the drain- age channel. 2. The lower branches of the existing pepper trees adjacent to the street shall be trimmed up to provide a minimum clear height of ten feet above the ground to provide adequate traffic sight lines. All ground cover and shrubs shall be maintained at a maximum height of 30 inches in areas requiring clear sight distance. 3. The southernmost panel of each of the existing wood fences adjacent to the driveway shall be removed to provide improved sight distance along Telegraph Canyon Road. 4. The proposed sign, ground mounted west of the driveway, shall be located at least 10 feet from the front property line. 5. A sufficient area of pavement (approximately 100 feet in length) shall be constructed along the north side of Telegraph Canyon Road to provide a safe acceleration lane for vehicles entering the westbound lane of this road. Background The project involves a residential garage conversion within a C-C-P zone for use as a real estate office. The General Plan designation foY this property is "b?odium Density P.esidentiai". The zoning requires that a precise plan be approved prior to impien~~entation of the project. B. Recommendation Adopt this staff report and evaluation form and recommend that th` Planning Com.*rtission and the City Council find that. i:.he project will not result in any substantial adverse effect on the environment in accordance with the attached Negative Declaration and. the findings therein. C. Project Setting The project site involves approximatel~~ 22,000 sq. ft. of property located at 635 Telegraph Canyon Rd. The site is developed with one single family dwelling, garage and ornamental landscaping. Adjacent land uses include vacant property to the north and south, vacant land and single- family residence to the north and northwest and the E~r_chway Inn to the east. _ There are no known significant natural or man-:Wade resources on-site nor are there a.ny geological izazards present.. ~cwever, there is one }cnocan fault and several inferred faults located approximately 2000 ft. from t17e property.
