ITEM TITLE: RESOLUTION#8138: Appx'oving Final Map of Windsor Views Subdivision

ITEM EXPLANATION
The final map of Windsor Views Subdivision has been checked by the
Engineering Division and found to be generally in conformance with the
tentative map approved by the City Council on July 9, 1974 by Resolution
No. 7365. Sesame Street and a portion of Telegraph Canyon Road are being
offered for dedication on the map.
On September 16, 1975, the City Council by Resolution No. 7891, approved
the final map on the condition that the developer posted the required
surety instruments within 60 days of approval of the final map as per-
mitted by Section 18.16.100 of the City Code. Because of difficulty in
obtaining satisfactory financial arrangements with a lending institution,
the developer was unable to comply with this requirement before the dead-
line date of November 15, 1975. On November 25, 1975, the City Council
denied a request from Windsor Park Enterprises to extend the 60 day time
limit. However, the Council, under the same action, granted an extension
of 18 months to the developerb approved tentative map. The tentative map
will expire on July 9, 1977.
On April 7, 1976, the Director of Public Works received a request from
Windsor Park Enterprises to submit the final map fox Windsor Views Sub-
division for City Council approval at their meeting of April 27, 1976.
The developer has tentatively reached agreement with his lending institu-
tion and is assured of receiving the required fcontinuedwonhSupplemental

STAFF RECOMMENDATION:
City Council approve final map, subject to the condition that the
developer submit required bonds, fees and documents within 60 days
of approval.

after approval of the final map by the City Council. The developer is
requesting Council approval of the final map subject to his posting the
surety instruments within 60 days of approval, as permitted by Section
18.16.100 of the City Code.
In addition to the subdivision bonds, there are several items normally
provided at this time which the developer now proposes to provide
within 60 days. They are:
1) The filing of the condemnation fee and immediate pos-
session of Paseo Ladera and the portion of Sesame Street
outside the subdivision boundary.
2) Certain required fees.
3) Letter from the Otay Municipal Water District stating that
satisfactory financial arrangements- have been made to provide
service to each lot.
Provision of the items above to the City appears to be dependent upon
payments by the developer. The developer states that he is unable to
make these payments (.and post his bond) until he receives his loan -
but the loan is dependent upon City Council approval of the final map.
Because certain security documents and fees have not been submitted at
this time, T have elected to withhold my signature from the final map
and do not intend to sign the final map until all requirements have been
fulfilled. Although this is not in conformance with the City Code, it
is the practice of the State Map Act and is the practice of many cities.
A transparency of the subdivision, which encompasses 18.34 acres and
consists of 58 lots, is available for Council viewing.
