CITY OF CHULA VISTA COUNCIL AGENDA STATEMENT ITEM NO 10 b FOR MEETING OF: 4/20/76 I• ITEM TITLE: Resolution #8132: Accepting Bids and Awarding Contract for the Mueller Neighborhood Park SUBMITTED BY~ Director of Public Works/City Engineer ITEM EXPLANATION The Director of Public Works received bids for the construction of the Mueller Neighborhood Park, Phase I, on March 25, 1976 at 11:00 A.M. in the City Council Confere:,ce Room. Bids were received from five contractors as follows: Walt's Blacktop & Paving, Bonita $61,062.00 T. B. Penick & Sons, Inc., San Diego 65,429.70 Landscape Irrigation Specialists, Inc., El Cajon 66,583.75 Valley Crest Landscape, Inc., San Diego 69,680.81 Roczey Grading & Demolition, Inc., El Cajon 69,733.50 It is recommended that T. B. Penick & Sons, Inc., the second-low bidder, be awarded the contract for the construction of this project. This company has a valid General Engineering Contractor "A" license. This license is most appropriate for the job involved. The project involves grading, parking lot paving, sidewalk construction, play equipment erection, landscaping and irrigation and sprinkler systems. A General Engineering Contractor is a ~ contractor whose principal contracting business involves skills for tree construction of many items, including parks, playgrounds, recreational works, ` grading, trenching, paving and concrete work. T. B. Fenick & Sons, Inc. also has a valid C-27 license for doing landscaping. Penick & Sons, Inc. and his subcontractors are certified by the Department of Housing and Urban Development. ' 2. A General Building Contractor is a contractor whose principal contracting business is in connection with any structure built, being built or to be built essentially for the support, shelter and enclosure of persons, animals and chattels. Approximately 400 of the work to be constructed by dollar value consists of landscaping and irrigation systems, an element which was not covered by either of the licenses held by Walt's Blacktop & Paving. It is my opinion therefore, that the low bidder with the most appropriate license to construct the project is T. B. Penick & Sons, Inc. of San Diego. Mr. Walt Selph, owner of Walt's Blacktop & Paving, and his attorney, Mr. Bendickson, were informed during the week of April 5 that it was my intention to recommend award of the contract to the next lowest bidder since he did not hold the most appropriate license. Subsequent to this disclosure, Mr. Selph has obtained, with another person, an "A" license. If he had had the "A" license prior to the opening of the sealed bids, it would be my recommendation to award the contract to Walt's Blacktop and Paving. However, it seems to me that the City's bid opening process is to some extent compromised if a contractor is permitted to get the proper license after the opening of the sealed bids. The City Attorney has advised that while it would be legal to award the bid to Walt's Blacktop & Paving, the procurement of the desired license subsequent to the bid opening would constitute an irregularity and he would-advise against awarding the contract to the low bidder for this reason. The bid of T. B. Penick & Sons is $4,367.70 greater than Walt's Blacktop & Paving and $13,851.70 (270) above the estimate prepared by the consultant, Steve Halsey Associates. The two low bids have been analyzed by the Engineering Division and the landscape planner and are acceptable. This project, which is funded by Block Grant funds, requires that the con- tractor and his contractors must be certified by the Department of Housing and Urban Development prior to execution of the contract by the City. The bid of T. B. Penick & Sons, Inc. and contingencies amount to $72,000. This is $21,500 in excess of the available funds in Account 24-1740-5569-BG4. ' There is an agenda item to be acted upon by the City Council at this meeting, N initiated by the Community Development Director, requesting authorization to transfer $21,500 into this account.
