RESOLUTION NO. 8475
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA SETTING FORTH TERMS AND CONDITIONS REGARDING
THE MAILING OF CANDIDATES' STATEMENTS AND CAMPAIGN
MATERIALS, AND DETERMINING THAT THE COSTS OF SAID
CANDIDATES' STATEMENTS SHALL BE BORNE BY THE CITY
OF CHULA VISTA AND APPROPRIATING FUNDS THEREFOR
IN ACCORDANCE WITH THE TERMS AND CONDITIONS SET
FORTH HEREIN
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the general municipal election for the City of
Chula Vista will be held on April 12, 1977, and
WHEREAS, any candidate for municipal office must file
no later than 12 o'clock noon on February 8, 1977, and
WHEREAS, at such time as nomination papers are taken out
by various candidates, said candidates may prepare a candidate's
statement on an appropriate form as provided by the City Clerk in
accordance with Section 10012 of the Elections Code of the State
of California, including the name, age, occupation of said candi-
date and a brief description of no more than 200 words of the
candidate's education and qualifications, and
WHEREAS, the City of Chula Vista, although authorized to
bill each candidate availing himself of the services provided
in the printing, handling and translating of said candidate's
statement if a candidate chooses to prepare said statement, has
determined that the cost of such printing, handling and translating
constitutes an undue burden upon those candidates unable to pay
such costs prior to the commencement of a campaign to raise funds
for the conduct of his election campaign, and
WHEREAS, the City Council desires to relieve the candidate
of such expenditure and to include the costs of printing, handling
and translating such statement as a cost of a general municipal
election, and
WHEREAS, the City shall pay the expenditures of candi-
dates based upon a payment of one-third of the cost thereof for
each 100 signatures obtained by said candidate and submitted at
the time of filing of nomination papers, and
WHEREAS, the City Council of the City of Chula Vista is
authorized to adopt regulations to permit each candidate for elec-
tive office to prepare separately other materials to be sent to
each voter in addition to the sample ballot and voter's pamphlet,
and
WHEREAS, any costs incurred in the handling of such other
materials shall be borne fully and exclusively by the candidate.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that the following regulations are adopted as
the regulations of the City of Chula Vista pursuant to Section
10012 of the Elections Code of the State of California:
1. Each candidate shall be allowed to prepare a candi-
date's statement on a form provided by the City Clerk of the City
of Chula Vista not to exceed 200 words in accordance with the
Elections Code provisions set forth above.

2. The City does hereby accept the costs of printing,
handling and translating said candidates' statements, provided
that the City's payment of the costs of printing, handling and
translating of Candidates' statements shall be accepted based
upon the submission of petitions in the form provided by the
City Clerk which shall indicate that for each 100 signatures
obtained on said petitions, one-third of the total cost of the
handling of said candidates' statements shall be borne by the
City.
3. The City Clerk shall carefully screen such statements
and shall reject any statement which makes references to partisan
political affiliation which does not conform fully to the require-
ments of uniformity of size, darkness and spacing of type and
which contains any obscene, vulgar, profane, scandalous, libelous
or defamatory matter, or any language which in any way incites,
counsels, promotes or advocates hatred, abuse, violence or hostility
toward, or which tends to cast ridicule or shame upon any person
or group or persons by reason of sex, race, color, religion or
manner of worship, or any language or matter the circulation of
which through the mails is prohibited by Congress.
4. The City Clerk is hereby empowered to proceed in
Small Claims Court as necessary to secure payment of any sum owing
to the City of Chula Vista by virtue of the services provided
herein fifteen days following the mailing of the charges levied
with respect to the candidate's statement.
5. The City Clerk is authorized to bill each candidate
providing a candidate's statement for the services set forth
above on the fifteenth day following the date on which the City
Clerk receives the actual cost breakdo~,m of said printing, handling
and translating of a candidate's statement, subject to the reduction
in cost of said services based upon the submission of a petition
as provided herein.
6. Each candidate wishing to transmit campaign materials
shall hereby be allowed to transmit one (1) sheet of 20 or 24 pound
stock paper, printed on one or both sides, the dimensions of 8-1/2"
x 11", to be folded evenly to 8-1/2" x 5-1/2". Each campaign
mailer shall be prefolded upon submission to the City Clerk to the
size specified, in accordance with the instructions of the City
Clerk or County Registrar of Voters. Each candidate wishing to
send a campaign mailer shall submit to the City Clerk, prior to
the insertion of said campaign mailer, the pro rata cost of stuffing
and mailing said material, as determined by the City Clerk.
7. These regulations shall apply equally to all candi-
dates.
BE IT FURTHER RESOLVED that the City Clerk of the City
of Chula Vista is authorized and hereby directed to undertake all
other activities necessary to comply with the provisins set forth
above.
BE IT FURTHER RESOLVED that the City Council does hereby
appropriate the sum of $3,000 from the unappropriated surplus of
the General Fund to cover the estimated cost of the printing,
handling and translating of candidates' statements of qualification.
