DATED __________..- :~ - ~ ~ Ca.t~y Clerk , 43 AGREEMENT FOR THE DEFERRAL OF THE INSTALLATION OF CERTAIN PUBLIC IMPROVEN~ENTS ADJACENT TO PROPERTY AT 165 SECOND AVENUE OWNED BY MICHAEL LoCICERO, RAREFY GEERDES, GEORGE BARRETT, ARMANDO PING AND TERRY ZANKIEWICZ AND ACCEPTANCE OF FAITHFUL PERFORMANCE BOND r THIS AGREEMENT, made and entered into this 7/~/R ~ day of .J~ (U 4~. ~}-{~ +~ , 1977, by and between THE CITY OF CHULA VISTA, a municipal c rporation, hereinafter referred to as "City", and MICHAEL LoCICERO, RAREFY GEERDES, GEORGE BARRETT, ARMANDO PING and TERRY ZANKIEWICZ, 531 Orange Avenue, Chula Vista, California 92011, hereinafter referred to as "Property Owners"; W I T N E S S E T H WHEREAS, as a condition of approval of Tentative Map 12-76, the Property Owners are required to improve the public alley between Second Avenue and Minot Avenue, adjacent to the property at 165 Second Avenue, more particularly known at County Tax Parcel No. 566-310-04, and WHEREAS, it is desired by Property Owners to defer the installation of said improvements for a period of one (1) year. NOW, THEREFORE, IT IS b'lUTUALLY AGREED by and between the parties hereto as follows: 1. Property Owners agree to install the following public improvements for 165 Second Avenue (County Tax Parcel No. 566-310-04) in the City of Chula Vista: Type "G" curb and gutter, 65 L.F. @ $5.00/L.F. $ 325 Sidewalk, 250 S.F, @ $1.20/S.F. 300 Driveway approach, 130 S.F. @ $1,80/S.F. 234 A.C, pavement, 1100 S.F. @ $0.65/S.F. 715 Roadway excavation, Lump Sum 500 Storm Drain, 27" RCP, 65 L.F. @ $28/L.F. x 1/2 910 $2,984 Engineering preparation of plans & const. staking 316 3,300 Contingencies 350 Attorney's Fees 350 Total Cost $4,000 2. Property Owners have deposited with the City of Chula Vista a faithful performance bond in the amount of FOUR THOUSAND DOLLARS APdD NO/CENTS ($4,000.00) to secure said improvements, the condition of said bond being that if Property Owners have not installed said improvements one (1) year from the date of execution of this agreement, that City is authorized to cause said improvements to be installed and to utilize necessary funds from the security as deposited. 3. It is further underst:ocd and agreed that Owners and/or their heirs, assignees or successors in interest shall at such time as a 1911 or 1913 Act petition is circulated, sign said petition and that said parties do hereby waive all rights to protest in the event such a 1911 or 1913 Act proceeding is instituted. - 1 - 44 IN WITNESS WHEREOF, the parties hereto have caused this agreement to be executed the day and year first hereinabove set forth.
