ITEM TITLE: Resolution 8524: Approving Encroachment Permit for Third Avenue

ITEM EXPLANATION
Mr. Dale Ohlau has submitted plans for the remodeling of the building
front for the Phoenix Institute at 307 Third Avenue. The remodeling
involves the construction of a permanent canopy over-hang to be attached
to the front of the building. This canopy, which is a cantilever construc-
tion, requires the support of four 6" x 12" vertical wood columns which
will be placed against the existing store front. The four beams will
be placed within the public right of way. The encroachment consists
of approximately 9 inches.
The Chula Vista Municipal Code requires that the City Council approve
all permanent encroachments within the public right of way. The Engineer-
ing staff has reviewed the plans and recommends that the encroachment
be approved.
The City Council, in adopting this resolution, is only authorizing the
issuance of an encroachment permit by the Director of Public Works.
Council's action does not approve the project which will be submitted
to the Redevelopment Agency for approval sometime in the near future.
Approval of the encroachment permit will be conditioned as follows:
1. Installation of the encroachment shall not interfere with any existing

STAFF RECOMMENDATION:
1. City Council adopt Resolution
2. City Council authorize Director of Public Works to issue encroachment
permit.

utility. Any changes of any utilities due to the installation shall
be at the sole expense of the permittee.
2. Maintenance, removal or relocation of the encroachment shall be the
sole responsibility of the permittee at no expense to the City.
3. Installation of the encroachment shall conform to the standards of
the City of Chula Vista and shall be in conformance with the Town
Centre Design Manual and current building standards of the Building
Code.
