HomeMy WebLinkAboutAgenda Statement 1977/03/01 Item 07• CITY OF CHULA VISTA ITEM N0. 7 COUNCIL AGENDA STATEMENT ~ 3/1/77 FOR MEETING OF: ITEM TITLE: Resolution 8523 Accepting Grant Deed from JLEN Incorporated for Right of Way Along Telegraph Canyon Road SUBMITTED BY~ Director of Public Works/City Engineer ITEM EXPLANATION On August 10,.1976 the City Council, by resolution 8279, accepted a grant deed from Saratoga Development Corporation executed on June 22, 1976 for right of way along Telegraph Canyon Road. The City paid Saratoga Develop- ment Corporation the sum of $568 for the right of way. The deed executed by Saratoga Development Corporation was filed in the office of the County Recorder on August 17, 1976 as document number 76-266162. This right of way is required to accommodate the proposed widening of Telegraph Canyon Road between Halecrest Drive and Oleander Avenue. The City of Chula Vista on July 8, 1976 obtained a litigation guarantee, Guarantee number 303586-R, for a liability in the sum of $1,000 from Land Title Insurance Company. The litigation guarantee showed that as of July 8, 1976 the right of way purchased by the City was vested in Saratoga Develop- ment Corporation. The litigation guarantee, however, had 13 exceptions listed. At the time the litigation guarantee was issued, Saratoga Develop- ment Corporation was subject to the effect of the filing of a petition on May 20, 1975 under Chapter 11 of the Bankruptcy Act in the District Court, Southern District, California, case number 75-1446. Others having interest in the property at the time the litigation guarantee was issued are: First National Title Company; Property Lenders, Ltd; Marvin D. Mathon; Central National Bank of Houston; James E. Jones, County Tax Collector; L. Prickett. Form A-113 fRev 5-75) - Item No• -~ • Supplemental Page 2 Since the acceptance of the right of way by the City Council from Saratoga Development Corporation, the property has been sold to a new owner, JLEN Incorporated. It has been determined by JLEN Incorporated that the con- veyance of the right of way by Saratoga Development Corporation was invalid. JLEN Incorporated wishes to clear the title to the property. JLEN Incor- porated, therefore, has executed a Corporation Grant Deed re-conveying to the City the right of way that was conveyed by Saratoga Development Corporation. JLEN Incorporated is granting this right of way as a gift and is not requesting any additional compensation. It is appropriate, at this time, for the City Council to accept the Grant Deed executed by JLEN Incorporated on January 14, 1977. A transparency is available for Council viewing.
