CITY OF CHULA VISTA ITEM N~O. 8 ` ~~ COUNCIL AGENDA STATEMENT FOR MEETING OF: 2/8/77 ITEM TITLE: Resolution - Approving Real Property Contract and Agreement Accepting Grant Deed for Edgemere Avenue Right of Way from Vista Hill Psychiatric Foundation} SUBMITTED BY~ Director of Public Works/City Engineerp~ ITEM EXPLANATION GG The City Council, by Resolution No. 6866 on May 22, 1973, approved an Agreement between the City of Chula Vista and the County of San Diego to realign and improve Edgemere Avenue. In accordance with the terms of the Agreement, paragraph 2(d), the County shall acquire all right of way and the City shall, upon demand, reimburse the County for the right of way that must be purchased or condemned. The realignment of Edgemere Avenue requires the acquisition of right of way and slope rights from property owned by Vista Hill Psychiatric Foundation. The right of way and slope rights to be acquired are designated as parcels 74-2488A and 74-2488B-1 as shown on the approved right of way map on file in the office of the City Engineer. In accordance with the agreement between the City and the County of San Diego, the County Department of Real Property has prepared an appraisal report for the subject parcels and has negotiated the acqui- stion of the parcels. The County's appraisal has determined that the fair market value of the taking is $29,500 for the property (which lies east of the existing right of way for Edgemere Avenue) to be acquired from Vista Hill Psychiatric Foundation. City Council approve Real Property Contract and Agreement. 2. City Council accept Grant Deed conveying to the City of Chula Vista parcels No. 74-2488A and 74-2488B-1. 3. City Council authorize the conveyance of the parcel described in Exhibit "B" attached to the Real Property Contract and Agreement upon completion and acceptance of the project by the City Council to Vista Hill Psychiatric Foundation; authorize the Mayor to execute the docu- ment conveying said parcels to Vista Hill Psychiatric Foundation. 4. City Council authorize release of lien in the amount of $8,200 re- corded in file/page 77138, series 9, book 1968, on May 18, 1968 in the official records of San Diego County Recorder. BOARD/COPrIi~SISSION RECOru~ENDATION: COUNCIL ACTIOPI: Form A-113 (Rev 5 - 75) ~upplemental'Page 2 Item No. 8 The City Council, on March 12, 1968, adopted Resolution 4713 which granted a deferral and approved a lien agreement for the construction of certain improvements along Edgemere Avenue fronting the Vista Hill Psychiatric Foundation property. The improvements consisting of 1031 lineal feet of Portland Cement concrete curb and gutter, five foot wide sidewalk and AC pavement were required as a condition of the City approving the expan- sion of the hospital in 1968. Vista Hill Psychiatric Foundation executed a lien agreement in the amount of $8,200 to guarantee the installation of these improvements. The lien was recorded in file/page number 77138, series 9, book 1968, on May 8, 1968 in the official records of the San Diego County Recorder. Prior to negotiations with Vista Hill Psychiatric Foundation for the acquisition of right of way, the Engineering staff determined that the estimated cost for construction of the obligated improvements as listed in the deferral and lien agreement was $27,100. On January 17, 1977, Vista Hill Psychiatric Foundation executed a Grant Deed and Real Property Contract and Agreement conveying the right of way and slope rights to the City of Chula Vista. The terms of the Real Property Contract and Agreement state that: 1. Vista hill Psychiatric Foundation agree to convey to the City of Chula Vista the right of way and slope rights appraised at a fair market value of $29,500. The parcels conveyed are described in Exhibit "A" attached to the Real Property Contract and Agreement. 2. City agrees to install the improvements as listed in the deferral and lien agreement adopted by Council Resolution 4713 on March 12, 1968; estimated construction costs to be $27,100. 3. The City upon completion of Gas Tax Project 58, realignment of Edgemere Avenue, will convey a portion of excess right of way to Vista Hill Psychiatric Foundation. This portion of excess right of way is a remnant of parcel 74-2489A which was accepted by City Council on January 25, 1977 by Resolution No. 8483 and is described in Exhibit "B" attached to the Real Property Contract and Agreement. The value of this portion of excess right of way to be conveyed to Vista Hill Psychiatric Foundation has an estimated market value of $2,600. 4. The City of Chula Vista in exchange for the granting of parcel 74-2488A and 74-2488B-1 will cancel the lien agreement approved by Council's Resolution No. 4713 and release the lien in the amount of $8,200 which is recorded in the office of the San Diego County Recorder at file and page number 77138. The Real Property Contract and Agreement also grants permission to the City, or its authorized agent, to enter upon Vista Hill Psychiatric Foundation property for purposes of relocating, constructing or connecting any existing driveways and to reconstruct sewer laterals as necessary. Continued on Page 3 Supplemental Page'3 Item No. 8 approval of this Real Property Contract and Agreement and acceptance of the Grant Deed for parcels 74-2488A and 74-2488B-1 completes the acqui- sition of right of way for Edgemere Avenue project. A total of $101,000 was budgeted as Gas Tax Project No. 14 for the acqui- sition of right of way. The acquisition of this right of way from Vista Hill Psychiatric Foundation involves no direct cash payment to Vista Hill. The Real Property Contract and Agreement negotiated with Vista Hill grants to the City of Chula Vista the required right of way in exchange for the City's installation of public improvements adjacent to Vista Hill property as part of the improvements to be constructed with the project and the conveyance of a portion of excess right of way to Vista Bill Psychiatric Foundation. There remains a balance in Account 250-2501-GT14, in the amount of $46,066.64. The balance remaining in this account will be used as payment to the County for their costs in acquiring the right of way for this project. Any remaining funds for the acquisition of right of way will be applied to the cost of constructing the improvements lying adjacent to Vista Eiill property along the east side of Edgemere Avenue. A transparency is available for Council viewing.
