ITEM TITLE Resolution 8483: Accepting Quitclaim Deed from County of San Diego
Edgemere Avenue Right of Way

ITEM EXPLANATION
The City Council, by Resolution P1o. 6866, on May 22, 1973, approved an
agreement between the City of Chula Vista and County of San Diego to realign
and improve Edgemere Avenue. In accordance with the terms of the agreement,
Para.2~c1)The County shall acquire all right of way and the City shall,
upon demand, reimburse the County for the necessary right of
way that must be purchased or condemned.
On August 13, 1976, the County Board of Supervisors authorized the purchase
of Parcels 74-2489A and 74-2489B,as shown on the right of way map on file
in the office of the City Engineer, from the property owner, Trousdale
Enterprises Inc. This property, which lies west of the existing right of way
for Edgemere Avenue, was purchased from Trousdale Enterprises Inc. for the
amount of $41,400. The purchase price is in accordance with an appraisal
report prepared by the County Department of Real Property. The purchase of
these two parcels will provide a portion of the needed right of way and slope
rights for the realignment and construction of Edgemere Avenue.
On December 22, 1976, the County Board of Supervisors passed a resolution
conveying by quitclaim deed to the City of Chula Vista Parcels 74-2489A and
74-2489B. The City Engineer has received the document conveying these
parcels to the City of Chula Vista. It is therefore appropriate for the City
Council at this time to accept this quitclaim deed. Upon acceptance of the
quitclaim deed by the City Council, the City Clerk will record said deed in

in the office of the County Recorder and transmit a copy of the recorded ~
document and certified copy of the resolution of City Council's acceptance
to the County of San Diego, Department of Real Property.
The property being conveyed by the County via this quitclaim deed presently
has a single family residential structure consisting of five rooms (three
bedrooms) situated upon it. This structure is presently occupied by
tenants who have been renting the structure for the past 14 years. These
tenants have been renting the structure for $35.00 per month in addition to
being responsible for the maintenance of all improvements upon the property.
The County of San Diego is presently in the process of locating decent, safe,
sanitary and compatible housing in accordance with California Relocation
Assistance and Real Property Guidelines as required by the California Admini-
strative Code, Title 25, Chapter 6.
Under the Relocation Assistance Requirements the County must either find
compatible housing or pay the tenants relocation assistance. The cost of
relocation assistance for tenants can not exceed $4,500.00
The existing tenants have been given 90 days notice to vacate in accordance
with Relocation Assistance requirements. The tenants are entitled to a
30 day notice before they must vacate. This 30 day notice will not be given
until all right of way has been acquired for the project. Engineering staff
feels that it is in the City's best interests to allow the tenants to remain
until the City is prepared to advertise for bids and is ready to sell or
raze the structure. Presence of the tenants serves as a deterent of vandal-
ism of the property which would occur if the structure was unoccupied. The
tenants are continuing to pay the $35.00 per month rent.
Upon acceptance of this quitclaim deed from the County, the City will have
obtained two of the three parcels required as right of way for the re-
alignment of Edgemere Avenue. The County is presently negotiating with
Vista Hill Foundation Hospital for the remaining right of way and in fact
has delivered deeds and right of way agreement to Vista Hill Foundation
Hospital for execution. It is anticipated that the County will have acquired
the remaining right of way in the very near future.
A total of $101,000 was budgeted as Gas Tax Project #14 for the acquisition of
right of way. Presently there is an unencumbered balance of $88,066.64
in Account 250-2501-GT14. The cost of these parcels will leave a balance
of $46,666.64 in this account which, at this time, appears to be sufficient
funds to cover the cost of acquiring the right of way from Vista Hill
Foundation hospital and payment to the County for their costs spent in
acquiring the right of way.
