RESOLUTION NO. 13786
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING THE PROPOSED "EASTLAKE
BUSINESS PARK ANNEXATION"
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, pursuant to the Cortese/Knox Local Government
Reorganization Act of 1985, commencing with Section 56000 of the
Government Code, the Local Agency Formation Commission has
received a petition and application from the McKinley Group for
the EastLake Development Company for the annexation of
approximately 1.1 acres of uninhabited territory to the City of
Chula Vista, and
WHEREAS, all owners of said land have consented in
writing to the annexation, and
WHEREAS, the subject territory is a triangularly shaped
parcel located northerly of the intersection of Boswell Road and
Miller Drive (Exhibit A) and bordered by the City of Chula Vista
and its EastLake Business Park on the south (Exhibit B), and
WHEREAS, the proposed reorganization is sanctioned by
the adopted Sphere-of-Influence of the City of Chula Vista, and
WHEREAS, an Initial Study, IS-88-86 of the possible
adverse impacts of the project was conducted as part of the
prezoning by the Environmental Review Coordinator on July 1,
1988, who concluded that there would be no significant
environmental effects, and
WHEREAS, on September 12, 1988, the Local Agency
Formation Commission, adopted a resolution approving the proposed
reorganization (Reference No. CA-88-2), and
WHEREAS, in accordance with the regulations of the
Cortese Knox Local Government Reorganization Act of 1985, the
Local Agency Formation Commission has referred the matter to the
City of Chula Vista for its action, and
WHEREAS, the purpose of the annexation is to provide
expanded lot depths to existing industrial lots in the EastLake
Industrial Park, which lots will be subsequently consolidated
into one new lot, and Miller Drive north of Boswell Road would be
vacated, and
WHEREAS, the property to be annexed shall be taxed for
general bonded indebtedness of Chula Vista, and

WHEREAS, the regular County assessment roll shall be
utilized, and
WHEREAS, the matter was discussed at a Council meeting
on September 20, 1988 at 7:00 p.m. in the Council Chambers in the
manner required by law.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista approves the annexation with boundaries
as described in Exhibit C (metes and bounds and map as approved
by LAFCO Commission, September 12, 1988) attached hereto, subject
to the following terms and conditions:
1. (a) Petitioners shall pay the following to the Otay
Water District:
(1) Standard processing fee in the amount of ~500.
(2) Annexation fees in the amount of $4,217 for
annexation to Improvement District No. 22.
(3) State Board of Equalization filing fee in the
amount of ~160.
(4) All other applicable local or state agency
fees.
(b) The taxable property in the area to be annexed
shall be subject to taxation after annexation thereof for the
purposes of the improvement district, including the payment of
the principal and interest on bonds and other obligations of the
improvement district, authorized and outstanding at the time of
annexation, as if the annexed property had always been a part of
the improvement district.
2. The boundaries of the territory as described in
Exhibit C are definite and certain.
3. The boundaries of the territory do not conform to
the lines of assessment and ownership.
4. The City Council does hereby approve the proposed
EastLake Business Park Annexation consisting of approximately 1.1
acres from the County of San Diego to the City of Chula Vista,
pursuant to Government Code Section 57002.
5. The City of Chula Vista does hereby order said
annexation.

6. The City Clerk of the City of Chula Vista be, and
she is hereby authorized and directed to transmit a certified
copy of this resolution in accordance with Section 57200 of the
Government Code.

RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSH}N
OF THE COUNTY OF SAN DIEGO
MAKING DETERMINATIONS AND APPROVING THE
"EASTLAKE BUSINESS PARK ANNEXATION"
TO THE CITY OF CHULA VISTA
On motion of Commissioner Hostler, seconded by Commissioner Hersore, the
following resolution is adopted:
WHEREAS, a petition was submitted to this Commission for annexation of territory
to the City of Chula Vista, which petition was certified sufficient by the Executive
Officer on August 15, 1988; and
WHEREAS, the territory proposed for annexation is as described in the application
on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on said
annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that it has reviewed and considered the information
contained in the Negative Declaration prepared by the City of Chula Vista.
(2) The Commission hereby approves the annexation with boundaries, as described
in Exhibit A attached hereto, subject to the following terms and conditions:
a) Petitioners shall pay the following to the Otay Water District;
