HomeMy WebLinkAboutReso 2011-108RESOLUTION NO. 2011-108 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN SAN DIEGO ASSOCIATION OF GOVERNMENTS AND THE CITY OF CHULA VISTA REGARDING LIGHT RAIL TROLLEY IMPROVEMENT STUDY AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE THE MEMORANDUM OF UNDERSTANDING WHEREAS, on September 15, 2009, per Resolution No. 2009-220, Chula Vista accepted a grant of $237,000 from the Transportation, Community, and System Preservation (TCSP) Program for a Light Rail Trolley Improvement Study (LRT Study); and WHEREAS, the Chula Vista TCSP grant application estimated the LRT Study to cost $300,000 with grant funds to be $237,500 (79%) and a local match of $62,500 (21 %); and WHEREAS, on October 15, 2009, the Federal Highway Administration (FHWA) reduced the TCSP grant amount for the LRT Study to $222,300; and WHEREAS, on September 15, 2009, per Resolution No. 2009-220, Chula Vista appropriated said grant funds to existing Capital Improvement Project STM361, Interstate 5 Multimodal Corridor Improvement Study and authorized an interproject transfer from existing CIP STL298 to STM361 in the amount of $16,175 as necessary to meet the minimum local match requirement of 20%; and WHEREAS, on April 20, 2010, per Resolution No. 2010-088, Chula Vista approved a Memorandum of Understanding (MOU) with San Diego Association of Governments (SANDAG) for the purpose of conducting a Light Rail Trolley Improvement Study LRT Study; and WHEREAS, due to certain intervening events, the City and SANDAG did not execute the approved MOU; and WHEREAS, SANDAG has provided the City with an updated version of the MOU for approval and execution; and WHEREAS, the MOU identifies SANDAG as the lead agency and provides that it will administer the LRT Study in cooperation with Chula Vista, MTS, and Caltrans; and WHEREAS, SANDAG intends to utilize its on-call engineering services consultants to complete the LRT Study as described in this MOU; and Resolution No. 2011-108 Page 2 WHEREAS, funding for the LRT Study from the federal discretionary funds will be paid to Caltrans via a Federal Fund Transfer Agreement (FFTA), and Chula Vista and Caltrans intend to enter into an agreement to authorize Caltrans to reimburse SANDAG for all Study costs from funds provided by the FFTA; and WHEREAS, part of the LRT Study, at least three rail grade separation projects, possibly more, will be considered; and WHEREAS, each rail grade separation project and commensurate transit station improvements aze estimated to cost approximately $40 million, representing a future construction cost for the local agency, region, State and Federal agencies of approximately $120 million, it is imperative that the design elements and potential construction impediments be identified eazly in the process, so that decisions can be made to minimize construction costs; and WHEREAS, the TCSP grant will be used to determine specific design features for future light rail trolley grade separation projects within the City of Chula Vista such as at E Street, H Street and Palomar Street; and WHEREAS, it was necessary to complete the Interstate-5 Multi-modal Corridor Study, prior to the commencement of the LRT Study; and WHEREAS, the Interstate-5 Multi-modal Corridor Study was just recently completed on December 27, 2010; and WHEREAS, if executed, the term of the previously approved MOU would have ended on December 31, 2011; and WHEREAS, if the previously approved MOU is now executed, the City and SANDAG would have insufficient time to complete the LRT Study; and WHEREAS, the new MOU has some minor changes from the previously approved, but unexecuted, MOU, of which the most important is the extension of the term of the MOU from December 31, 2011 to September 30, 2012. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the Memorandum of Understanding between the San Diego Association of Governments and the City of Chula Vista regazding Light Rail Trolley Improvement study and authorizing the Director of Public Works to execute the Memorandum of Understanding.
