ITEM TITLE: Resolution ~~~•~'~- Approving Agreement and Appropriating $5, 000 for the National Institute of Municipal Law Officers Litigation Fund to Test the Constitutionality of the Unemployment Compensation Act of 1976 SUBMITTED BY~ City Attorney ITEM EXPLANATION: As the City Council is aware as of January 1, 1978, municipal employees will receive unemployment compensation pursuant to the Unemployment Com- pensation Act of 1976 adopted by the federal government. The National Institute of Municipal Law Officers intends to institute litigation to test the constitutionality of the Act. Council has pre- viously been informed that the cost to the City will exceed $70,000 for a six-month period. Therefore, it is certainly to the interests of the City to test the constitutionality of the Act and it is, therefore, recommended by the City Attorney's office that the Council appropriate necessary monies as requested by the National Institute of Municipal Law Officers to enable them to undertake the exceedingly expensive litigation that is contemplated. The expected cost i~ $300,000 which the Institute hopes to raise by May 15. It is suggested that for cities between 50,000 and 200,000 population, that a sum of $5,000 be contri- buted. The City of San Diego is contributing $15,000 and the City of Imperial Beach is contributing $2,500 and I am sure that most of the cities will join in the litigation and make an appropriate contribution. FINANCIAL STATEMENT: Appropriate $5,000 from the unappropriated reserve of the General Fund The agreement for this resolution calls for the appropriation of $5,000; however, the Council approved $1,000 only awaiting further information as to the participation of other cities. At the Council meeting of July 29, 1977, the Council again adopted another Resolution-No.~- appropriating the additional sum of $4,000.
