HomeMy WebLinkAboutAgenda Statement 1977/05/10 Item 17CITY OF CHULA VISTA COUNCIL AGENDA STATEMENT ITEM N0. 17 FOR MEETING OF: 5/10/77 ITEM TITLE: Resolution p~po~0 Declaring City' s Intention to Amend Spread of Assessment Against Properties within El Rancho del Rey, Unit No. 4 Subdivision for Maintenance of Open Space District No. 1 and Setting Public Hearing j SUBMITTED BY~ Director of Public Works/City Engineer ~~~ ~ C~ , ITEM EXPLANATION One of the conditions of approval for the Tentative Map of El Rancho del Rey, Unit No. 4 Subdivision was to amend the assessment against the property for the maintenance of slopes and natural open space within the boundaries of Chula Vista Open Space District No. 1. Pres- ently, the property contained within the boundaries of this subdivision is designated as Parcel "K" on the current assessment role for Open Space District No. 1, which was approved by the City Council on August 7, 1973 by Resolution 6965. The owners of Parcel "K" are presently paying an assessment of $598.22 per year which is for undeveloped property within the district. Developed property within the district is currently paying an assess- ment of $25.73 per year per residential lot or single family dwelling unit. Since the City Council is approving the Final Map for El Rancho del Rey, Unit No. 4 Subdivision at this meeting, it is appropriate for the City Council to adopt a resolution declaring the City's intention to amend and levy an assessment of $25.73 per year against each of the 83 lots in the subdivision. Section 17.08.390 of the Chula Vista Munici- pal Code requires that prior to any changes in an open space district that a public hearing be held to hear persons in favor of or objecting to the proposed changes. The developer will maintain these slopes within this development for a minimum period of one year or until acceptance of the landscaping and irrigation system by the district for maintenance. The estimated cost of maintaining the landscaped area within Chula Vista Open Space District No. 1 not including the slopes within E1 Rancho del Rey, Unit No. 4 Subdivision is $33,430 for Fiscal Year 1977-78. Sufficient revenues will be available to cover this maintenance cost for Fiscal Year 1977-78 without the need to increase the present assessment against all properties within the open space district. When the slopes within E1 Rancho del Rey, Unit No. 4 Subdivision are accepted by the district for maintenance the cost of maintenance for the entire district will increase to an estimated cost of $47,190. Therefore, the increase in maintenance cost being generated by this subdivision is $13,760. It is staff's intention in April of 1978 to initiate Council action to increase the assessments for Fiscal Year 1978-79 to cover the anticipated increase in maintenance costs. The City Clerk will mail notices of the public hearing to those persons whose names and addresses appear on the last equalized assessment roll owning property within the boundaries of E1 Rancho del Rey, Unit No. 4 Subdivision. The City Clerk will also publish the Resolution of Intention in accordance with Section 6.61 of the Government Code ten days prior to the date of the public hearing.
