SUMMARY
On June 7, 2011, the City Council approved a resolution amending Chapter 7 (Recreation
Fees) of the City's Master Fee Schedule, which included increasing the hourly unlighted
ball field rental rate for members of the Youth Sports Council and Adults Sports City
League from $0 to $10 per hour. At its June 21, 2011 meeting, the City Council directed the
City Manager to return with an item reversing fee increase for ball field rentals. Approval of
the resolution will reverse the fee increase, returning the ball field rental rates for members
of the Youth Sports Council and Adults Sports City League to the structure in place prior to
the action taken on June 7, 2011.
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed activity for
compliance with the California Environmental Quality Act (CEQA) and has determined
that the activity is not a "Project" as defined under Section 15378(b)(4) of the State
CEQA Guidelines because it is a government fiscal activity; therefore, pursuant to
Section 15060(c)(3) of the State CEQA Guidelines this activity is not subject to CEQA.
Thus, no environmental review is necessary.
RECOMMENDATION
That Council adopt the resolution.

DISCUSSION
On June 7, 2011, the City Council approved Resolution 2011-100 amending Chapter 7
(Recreation Fees) of the City's Master Fee Schedule, which included increasing ball field
rental fees. The hourly unlighted ball field rental rates for members of the Youth Sports
Council were changed from $0 to $10 per hour. The amendment to this section also
included the addition of a specific rate for the Adult Sports, City League, which pays the
same rate as the Youth Sports Council.
At its June 2l, 2011 meeting, the City Council heard public comments from the Youth
Sports Council and further discussed the fee increases for the ball field rentals. The City
Council then directed the City Manager to return with an item reversing the fee increase
for ball field rentals. Approval of the resolution will reverse the fee increase, returning
the ball field rental rates for members of the Youth Sports Council and Adults Sports City
League to the structure in place prior to the action taken on June 7, 2011. This section of
the Master Fee Schedule will now read as follows:

The resolution approved by the City Council on June 7, 2011 increasing the ball field
rental rates for members of the Youth Sports Council and Adult Sports City League was
scheduled to go into effect 30 days after approval (July 7, 20] 1). On June21, 2011, the
City Council further directed the City Manager to defer the fee increase until the Council
could take formal action to reverse the fee increase. If approved, the proposed resolution
to reverse the fee increase will go into effect immediately. As a result, no fee payers will
be subject to the increased hourly rental rates previously approved.
City staff has met with the Youth Sports Council and will continue to work with them to
develop a plan to generate new revenues to better maintain ball fields. Staff will also
conduct outreach to the Adults Sports City League so that they are aware of any proposed
fee increases. As discussed in the June 7, 2011 agenda statement, the revenue generated
from the increase in ball field rental fees was intended to supplement the budget for
maintaining ball fields. This improved maintenance would both increase the availability
of the facilities for the users and avoid additional costs incurred to rehabilitate a damaged
sports field (as compared to the basic level of maintenance associated with non-sport
activities.) If improved maintenance is to be provided, identification of additional
resources will be necessary. Staff will continue to work with the community groups
impacted by the proposed fee increases to develop solutions to this issue.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is
not site specific and consequently the 500 foot rule found in California Code of
Regulations Section 18704.2(a)(1) is not applicable to this decision.
CURRENT YEAR FISCAL IMPACT
Approval of this resolution stops the City from collecting additional ball field rental
revenues that would have been generated by the new hourly unlighted ball field rental
rate. Revenues anticipated to result from the increased ball field rental rates for members
of the Youth Sports Council and Adult Sports City league, authorized by Council's action
on June 7, 2011 are not reflected in the Council adopted budget for fiscal year 2011-12.
The expenses associated with increased sports field maintenance (intended use of
increased ball field rental revenues) are also not reflected in the adopted budget for fiscal
year 2011-12. No net impact to the General Fund is anticipated in the current fiscal year.
ONGOING FISCAL IMPACT
No ongoing fiscal impacts are anticipated. If the City does not increase the ball field
rental rates, additional sports field maintenance will not be conducted, resulting in no
ongoing net impact to the General Fund. The sustained economic downturn experienced
by the City for the last few years has significantly reduced the discretionary revenues
available to provide public services. Any future increases in sports field maintenance,
without offsetting increases in fee revenues, will be considered in the context of
Council's funding priorities.

Recreation facilities are available to groups only when City programs are not scheduled. Policies and
regulations governing facility use permits are provided in Council Resolution 12343. An employee or City-
appointed representative must be present during use of listed facilities.
GENERAL FACILITIES -USE PERMIT
1. Group Priorities
Facilities are available for recreation activities
under the following order of priority based on
group classification.
The Facility Use Fee is charged on an hourly rental
rate basis, per the schedules below. Hourly Staff
Fees are also charged, at the prevailing hourly
staff rate, for any activities requiring supervision,
room or facility set-up, or custodial services. There
is an additional charge if special services are
required.
Non-resident surcharge is 100%
Classification 1: City programs. Non-resident
surcharge not applicable to City
sponsored uses.
Classification 2: Chula Vista community service
organizations related in purpose
to recreation and the
furtherance of community
leisure programs.
Classification 3: Chula Vista civic and social
organizations which are
democratic in character with
membership open to the general
public or designated elements
thereof.
Classification 4: Private resident groups requiring
large facilities far special events
not open to the general public.
If applicant is a Chula Vista
resident, the non-resident
surcharge does not apply.
Classification 5: Unions, employee associations
and special recreational groups
and non-residential groups
requiring public facilities
2. Basic Fee Schedule
The Basic Fee is based on the group's
classification as described in Section 1 for
Classifications 2 through 6, and includes a Facility
Use Fee and an Hourly Staff Fee.
There is no charge for groups in Classification 1.
Facilitv Use -Fee Schedule I
Community organizations in Classification 2 or 3
shall be granted use of facilities without charge if
no additional staff is required and if any
admissions fee/contribution is not collected. If
additional staff is required, the community
organization will be charged prevailing hourly staff
fees.
Facilitv Use -Fee Schedule II
Community organizations in Classification 2 or 3
can use facilities on an actual cost basis if a
contribution/fee is assessed for charitable
purposes.
Actual costs consist of hourly staff fees for
personnel and a minimum utility charge as shown
in Fee Schedule II on the reverse of this bulletin.
Facilitv Use -Fee Schedule III
Resident organizations and individuals in
Classification 4 not qualifying for Fee Schedule I or
II will be assessed the Facility Use Fee shown in
Fee Schedule III, plus the Hourly Staff Fee (Fee
Schedule II).
Facilitv Use -Fee Schedule IV
Those individuals or groups in Classification 5 and
6 will be assessed the Facility Use Fee based on
Fee Schedule IV, or 30% of gross receipts,
whichever is greater, plus the Hourly Staff Fee
(Fee Schedule II). A financial report must be
submitted one week after the activity is held if an
admission fee was charged. If applicant is a Chula
Vista resident, the Non-resident surcharge will not
apply. Nan-resident surcharge will be applied to
fee, or 30% of gross receipts, as applicable.

CHULA VISTA AMENDING CHAPTER 7 (RECREATION
FEES) SECTION 100 (PROGRAM FEES -AQUATICS) AND
SECTION 200 (GENERAL FACILITIES -USE PERMITS,
OTHER FACILITIES -USE PERMITS AND BALL FIELDS)
OF THE CITY'S MASTER FEE SCHEDULE
WHEREAS, in June, 2010, the City Council adopted the existing Chapter 7 (Recreation
Fees) of the City's Master Fee Schedule; and
WHEREAS, the Council wishes to amend Chapter 7 (Recreation Fees) Section 100
(Program Fees -Aquatics) and Section 200 (General Facilities -Use Permits, Other Facilities -
Use Permits and Ball Fields) of the Master Fee Schedule, as set forth in Exhibit 1, attached to
this resolution and incorporated by this reference as if set forth in full; and
WHEREAS, the proposed amendments will result in changes to fees imposed for the use
of, entrance to, or rental of city-owned property, only; and
WHEREAS, Article XIII C of the California Constitution requires a vote of the electorate
to increase any levy, chazge, or exaction imposed by a local government, unless specifically
exempted; and
• WHEREAS, the proposed fees are exempt from the vote requirement per Section 1(e)(4)
of Article XIII C, which exempts chazges imposed for entrance to or use of local government
property, or the purchase, rental or lease of local government property; and
WHEREAS, the proposed amendments to the Master Fee Schedule, Chapter 7, Sections
100 and 200, shall not become effective unti130 days after adoption of this resolution by the City
Council.

Fees for various Recreation Department programs
and classes shall be composed of fees applying to
legal residents of the City of Chula Vista and fees
for non-residenss.
A resident shall be considered any person residing
within the City limits, antl who ran show proof of

Recreation facilities are available to groups only when City programs are not scheduled. Policies and
regulations govemingfacility use permits are provided in Council Resolution 12343. An employee orCity-
appointed representative must be present during use of listed facilities.
GENERAL FACILITIES -USE PERMIT

2. Basic Fee Schedule
The Basic Fee is based on the group's
classification as described in Section 1 for
Classifications 2 through 6, and includes a Facility
Use Fee and an Hourly Staff Fee.
The Facility Use Fee is charged on an hourly rental
rate basis. per the schedules bebw. Hourly Staff
Fees are also charged, at the prevailing hourly
staff rate, for any activtties requiring supervision,
room or facility set-up, or wstodial services. There
is an addttional charge if special services are
required.
There is no charge for groups in Classification 1.

Actual costs consist of hourly stall fees for
personnel and a minimum utility charge as shown
in Fee Schedule II on the reverse of :his bulletin.
Facility Use -Fee Schedule III
Resident organizations and individuals in
Classification 4 not qualifying for Fee Schedule I or
II will be assessed the Facility Use Fee shown in
Fee Schedule III, plus the Hourly Staff Fee (Fee
Schedule II).
Facility Use -Fee Schedule IV
Those individuals or groups in Classification 5 and
6 will be assessed the Facility Use Fee based on
Fee Schedule IV, or 30% of gross receipts,
whichever is greater, plus the Hourly Staff Fee
(Fee Schedule II). A financial report must be
submitted one week after the actiVRy is held if an
admission fee was charged. If applipnt is a Chula
Vista resident, the Non-resident surcharge will not
appy. Non-resident surcharge will be applied to
fee, or 30% of gross receipts, as applicable.

Consumer Price Index (CPI, San Oiego All Urban
Consumers, in June of each year, rounded to the
nearest dollar, and effective for the start of the
summer class season.

RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CHULA VISTA AMENDING THE "BALL
FIELDS" FEES IN CHAPTER 7 (RECREATION
FEES) SECTION 200 (OTHER FACILITIES -USE
PERMITS AND BALL FIELDS) OF THE CITY'S
MASTER FEE SCHEDULE
WHEREAS, on June 7, 2011 the City Council approved various amendments to
Chapter 7 (Recreation Fees) of the City Master Fee Schedule including amendments to
Section 200 (General Facilities -Use Permits, Other Facilities -Use Permits and Ball
Fields); and
WHEREAS, Section 200 of the Master Fee Schedule includes the fee structure for
the rental of Ball Fields; and
WHEREAS, on June 21, 2011 the City Council heard public comments on the ball
field rental fee increases and directed staff to return to Council with an item, reversing the
ball field rental fee increases; and
WHEREAS, the City Council further directed the City Manager to defer the ball
field rental increases until the Council could take further action on this item; and
WHEREAS, the ball field rental fee increases approved on June 7, 2011 would
have gone into effect on July 7, 2011, but were deferred, resulting in no fee increases for
the sports field rentals; and
WHEREAS, the Council wishes to amend the "Ball Fields" fees in Chapter 7,
Section 200 of the Master Fee schedule to revert to the fee structure in place prior to June
7, 2011 which will reinstate the rental fee for Youth Sports Council, regular season fee for
Lighted Fields to $15 per hour and $0 for Unlighted Fields; and
WHEREAS, the June 7, 2011 amendment also formally set a rate for the Adults
Sports City league set equal to the rental fees for Youth Sports Council, the new
resolution to reverse the fee will also impact the Adults Sports City league but will keep
in place the inclusion of fees for the Adults Sports City league; and
WHEREAS, aredline/strikethrough version of these changes are attached to the
agenda statement for this item and is available in the City Clerk's Office; and
WHEREAS, staff will continue to work with Youth Sports Council and Adults
Sports City league and will return to Council in the Fall with a recommendation on
generating new revenues to maintain the ball fields.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Chula Vista does hereby amend Chapter 7 (Recreation Fees) Section 200 (Other Facilities
- Use Permits and Ball Fields), "Ball Fields," of the City's Master Fee Schedule to reflect
the following rental rates:
