Home My WebLink AboutReso 1977-8818RESOLUTION NO. 881$ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING RESOLUTION NO. 7868 OF THE CITY COUNCIL WHICH ESTABLISHED AN UNDERGROUND UTILITY DISTRICT ON MAIN STREET AND OTAY VALLEY ROAD FROM BEYER WAY TO 2100 FEET EAST OF HILLTOP DRIVE The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, it is now desired to amend Resolution No. 7868 to exempt certain electrical services from the undergrounding require- ment as established therein. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that Resolution No. 7868 be, and the same is hereby amended by adding thereto the following BE IT FURTHER RESOLVED clause: BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does hereby exempt from the undergrounding requirement for that underground utility district marked Exhibit "A" the coversion of the three 12 KV overhead circuits crossing Main Street which lead into the Albany Avenue Substation and the removal of the two poles lying within the City of Chula Vista on the north side of Main Street. NOW, THEP.EI'ORE, BE IT RESOLVED that the City Council of the. City of C}lula Vista hereby finds and determiize~ that the public health, safety and welfare requires the removal o poles, overhead taires and associated struc~ures, and the undergro~:=d installation of Z•;ires and facilities for supplying electric, c~-nunication or similar associated services, the above-described area is hereby declared an Underground Utility District, and is designated as such in the City of Chula Vista. Attached hereto, marked Exhibit "A", and incorporated herein by reference is a map delineating the boundaries of said District. BE ZT FURTHER RESOLVED that the City Con:,^il Shall, by subsequent resolution, fix the date on which affec:.-ed property owners must be ready to receive underground services, and does hereby order the removal of all poles, overhead wires and associated over- head structures and the underground installation o~ taires and faci- lities for supplying electric, communication or smilar associated service within. said Underground Utility District. BE IT FURTIIER RESOLVED that the City Clerk is hereby instructed to notify all affected utilities and al's persons o~•ming real property within said Underground Utility District of the adoption of this resolution t•:ithin ten (10) days azter the date of said adoption. Said City Clerk shall .further n:~t-ify said property o~:rncrs of: t},~ necessity that, if they o2: 4n}l person occup;•ing such property desires to co.~tinue to receive electric, communication or ofl:c~r similar or associated service, they, or .. ~~F) such occupant shall, by the date fixed in a :subsequent resolution provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to the applicable rules, regu- lations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California as of the date of adoption of this resolution. Such notification shall be made by mailing a copy of this resolution to affected property owners as shown on the last equalized assessment roll and to the affected utility companies. BE IT ~'URT}iER RESOLVED that the City Council hereby finds that the Underground Utility District herein created is in the general public interest for the following reasons: 1. That the undergrounding to be accomplished will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. 2. That the streets, roads or rights-of-way in the District are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic.
