HomeMy WebLinkAboutReso 1977-8775 RESOLUTION NO, 8775 ~- .8/10/77 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA URGING THE LEAGUE OF CALIFORNIA CITIES TO STRONGLY SUPPORT ADYENDMENTS TO THE BROZ~1 ACT BROADEPIIPIG THE RIGIiT OF CITY COUNCILS TO HOLD EXECUTIVE SESSIONS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the present interpretation of Section 54957 of the Government Code of the State of California would prohibit City Councils from conducting an executive session for any purpose other than the consideration of the appointment, employment or dismissal of the City Manager, City Attorney or the City Clerk, or in those cases where department heads are directly appointed by the Council, department heads as well, or to consider complaints or charges brought against such employees and officials, and WHEREAS, such a restrictive provision makes no real contri- bution to the highly desirable goal of insuring that the public's business be conducted in public, but rather constitutes a frustration upon the part of the Council from making legitimate inquiries into a broader range of problems affecting the public interest, and WHEREAS, it is desirable that Section 54957 of the Govern- ment Code be amended to authorize the City Council to meet in execu- tive session with such officials for the purpose of discussing personnel problems which may affect the operation of municipal government, and WHEREAS, it is desired that the section be drafted in such a manner so that there will be no continued confusion as to the obli- gations of the City Councils in regard to the holding of executive sessions. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that it is recommended that Section 54957 of the Government Code be amended to authorize the City Council to hold executive sessions with the City PR.anager, County Administrator, City Attorney, County Counsel or a department head or other similar admini- strative officer appointed by the legislative body for the purpose of considering the appointment, employment or dismissal of such public employee or to discuss the adverse performance of said employees. Further, the City Council may meet in executive session with said employees to discuss the appointment, employment or dismissal of those department heads directly responsib]_e to and appointed by said employees, They may also .meet in executive session to hear charges brought against said employees by another person or employee unless such employee requests a public hearing. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to forward a certified copy of this resolution to the League of California Cities.
