SUMMARY
On June 1, 2011, the Director of Public Works received sealed bids for the "Otay Water District
Facility Relocation" Project (STM355). The work to be done consists of installing a new large
diameter service lateral from Otay Water District's water main on the east side of Otay Lakes
Road to the new City right-of-way line on the west side of the street, and installing two new
backflow preventers to serve Southwestern College (SWC) in preparation far roadway widening
in Summer 2012. This work will be performed during SWC's Summer 2011 break. Under an
existing agreement with the Otay Water District (OWD), OWD will pay for all pipeline and
associated work between the water main on the east side Otay Lakes Road and the water meter
serving SWC. The proposed action would award the contract to RMV, Inc. and increase the
Director of Public Works authority to approve change orders, as necessary, up to the contingency
amount.
ENVIRONMENTAL REVIEW
The Director of Development Services has reviewed the proposed project for compliance with
the California Environmental Quality Act (CEQA) and has determined that the project falls
under the statutory exemption pursuant for relocation of pipelines of less than one mile in
accordance with Section 21080.21 of the State CEQA Guidelines. Thus, no further
environmental review is necessary.

DISCUSSION
On June 1, 2011, the Director of Public works received at total of five (5) bids to relocate the two
back flow preventers along Otay Lakes Road that serve SWC. Under existing agreements with
SWC and OWD, the City is required to relocate the backflow preventers on behalf of SWC and
OWD will pay for all work between the water main on the east side of Otay Lakes Road and the
water meter at the new property line; SWC dedicated, at no cost to the City, right-of-way for the
widening of the roadway (see Attachment 1).
The five (5) bids received to perform the work are as follows:

The low bid by RMV, Inc. of San Diego is $12,223 (12%) below the Engineer's estimate of
$100,000. The Engineer's estimate was based on average prices for similar types of work
completed during the last two years. Staff verified the references provided by the contractor;
their work record has been satisfactory. After reviewing the low bid, staff recommends awarding
a contract to RMV, Inc. of San Diego, California.
Approval of the proposed resolution will award the contract to RMV, Inc. and will authorize the
Director of Public Works to expend all available contingency funds and increase the value of the
contract, as necessary, due to circumstances that could not have been anticipated prior to
excavation or special conditions that might arise during construction. According to City Council
Policy No. 574-01, if a change order exceeds the cumulative contract change order aggregate
amount allowable to be approved by the Director of Public Works Operations, City Council
approval is required. Under said City Council Policy the amount would be $8,777.70. However,
approval of the proposed resolution will increase the Director of Public Works authority to
approve change orders as necessary up to the contingency amount of $21,943.

Wa>?e Statement
The contractors who bid on this project were not required to pay prevailing wages to persons
employed by them for the work performed under this project. No special minority or women-
owned business requirements were necessary as part of the bid. However, a "Notice to
Contractors" was sent to various trade publications in order to encourage disadvantaged
businesses to bid on the project.
DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundaries of the properties, which are the subject of this action.
CURRENT YEAR FISCAL IMPACT
A breakdown of the project construction costs is as follows:

There are sufficient funds in the Capital Improvement Program (CIP) Project No. STM-355,
"Otay Lakes Road Widening." Otay Water District deposit funds will be used to reimburse the
project account for a portion of the work (water main to water meter) up to $68,842 plus any
change order costs due to quantity adjustments and/or unforeseen conditions that might arise
during construction.
ONGOING FISCAL IMPACT
There will be no ongoing costs to the City, as the improvements will be maintained by the Otay
Water District and Southwestern College upon completion of the improvements.

Vista does hereby accept bids and award contract to RMV, Inc. in the amount of $87,777 for the
"Otay Water District Facility Relocation, Otay Lakes Road/Gotham Street/Southwestern College
Driveway" (STM355) in the City of Chula Vista, CA and authorize the Director of Public Works
to expend all available contingency funds.
