HomeMy WebLinkAboutReso 1988-13574 RESOLUTION NO. 13574 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA, ORDERING THE CITY ENGINEER TO PREPARE AND FILE A REPORT IN ACCORDANCE WITH THE "LANDSCAPING AND LIGHTING ACT OF 1972," FOR THE BAY BOULEVARD STREET LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT FOR THE FISCAL YEAR COMMENCING JULY 1, 1988, AND ENDING JUNE 30, 1989 WHEREAS, the City Council of the City of Chula Vista, California proposes to form an assessment district pursuant to the "Landscaping and Lighting Act of 1972," being Division 15, Part 2, of the Streets and Highways Code of the State of California; and WHEREAS, the said assessment district shall include all parcels of and within the said District and shall be designated as the Chula Vista Bay Boulevard Street Lighting and Landscaping Maintenance District NO. 1988-1989, and shall include all street light and landscaping maintenance areas within said District, as shown on Plan No. 1988-89 of Chula Vista Bay Boulevard Street and Lighting Maintenance District No. 1988-89; and WHEREAS, it is proposed to furnish electrical energy and landscaping maintenance on the said streets as shown on Plan and Diagram No. 1988-89, (also as shown on Plan and Diagram No. 1988-89, designating the boundaries of the District); all street lights and landscaping maintenance areas within said District, all as shown on Plan No. 1988-89; and WHEREAS, it is proposed to furnish the energy and to maintain the lighting system and to maintain the landscaping; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHULA VISTA DOES HEREBY RESOLVE, DETERMINE AND ORDERAS FOLLOWS: SECTION 1. That the City Engineer is hereby ordered to prepare and file a report in accordance with Article 4, Chapter 1, Part 2, "Landscaping and Lighting Act of 1972," being Division 15, Part 2, Streets and Highways Code of the State of California, for the furnishing of a electrical energy, replacement and the maintenance of street lighting fixtures and appliances and the landscaping maintenance as shown on Plan No. 1988-89, for the fiscal year cormmencing July 1, 1988, and ending June 30, 1989, in this resolution. SECTION 2. That a certified copy of this resolution be presented to the said City Engineer for his information and guidance. -1- SECTION 3. The City Clerk shall certify to the passage and adoption of this resolution; shall cause the same to be entered among the original resolutions of said City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted. Renewal of the assessment district for the next fiscal year is required. RECOMNDATION: That Council adopt the subject resolution ordering the City Engineer's report. BOARDS/CfM~ISSIONS ~ECOMMENDATION: Not applicable DISCUSSION: The Bay Boulevard Lighting and Landscape Maintenance District was formed in 1982 to pay the costs of maintaining the landscaping and providing energy for the street lights along Bay Boulevard between "E" and "F" Streets. According to Article 4, Chapter 1, Part 2, "Landscaping and Lighting Act of 1972" being Division 15, Part 2 of the California Streets and Highways C~de, the City Engineer must prepare and file a report to begin the renewal process for the assessment district each year. The City Engineer will prepare his report for Council's consideration and approval and a public hearing will be held at a later date to confirm the assessments.
