The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that those certain grants of easement
for sewer purposes for Bonita Point Shoppin~ Center at the north-
west corner of East "H" Street and Otay Lakes Road
executed by. Bonita Point Plaza Partnership and E1 Rancho Del
Rey Partnership
copies of which are attached hereto and by this reference made a
part hereof as though fully set forth herein, be and the same are
hereby accepted by the City of Chula Vista.
BE IT FURTHER RESOLVED that the City Clerk of the City
of Chula Vista be, and she is hereby authorized and directed to
record said easements in the office of the San Diego County
Recorder.

FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknow-
ledged, the undersigned do/does hereby grant to the City of Chula
Vista, in the County of San Diego, State of California, an easement
and right of way for, and the right. to construct, maintain, operate,
replace, remove, or enlarge a sanitary sewer and appurtenant
sturctures in, upon, over and across that certain real property
situated in the County of San Diego, State of California, and more
particularly described as follows:
SEE LEGAL DESCRIPTION ATTACHED HERETO AND MADE A PART THEREOF
Together with the right to enter upon and to pass and repass over and
along said easement and right of way and to deposit tools, implements
and other materials thereon by said City of Chula Vista, its officers,
agents, and employees and by any contractor, his agents and employees
engaged by said City, whenever and wherever necessary for the purposes
above set forth.
It is understood and agreed by the parties hereto that the Grantee
shall indemnify and hold the Grantor harmless against all claims for
damage or suits for loss, including costs and attorney's fees,
arising from injury to any person(s) or property or life, cased by
or resulting from acts, or omissions by the Grantee, its successors
or assigns, arising from the construction, operation or maintenace
of the aforementioned sanitary sewer or in using, operating or
traveling over the land ~ithin the hereinbefore described Grant of
Easement.
It is further understood and agreed by the parties hereto that the
aforementioned sanitary sewer and appurtenances thereto shall be
constructed, placed or laid below the grade of natural ground.

WHEREAS, the owner of that certain property hereinafter described has granted
to the City of Chula Vista, a municipal corporation, in the County of San
Diego, State of California, the permanent easement and right of way.

AND WHEREAS, Union Bank, A California Corporation
is hereinafter known as the BENEFICIARY; and Union Bank, A California Corporation
is hereinafter known as the TRUSTEE as of the date of this instrument under
that certain deed of trust executed by Bonita Pointe Plaza, A California Ltd. Partnershjp
to secure A note for ($ 2 625 000.00
with interest dated February 5, 1387 and recorded February 18, 1987
in Official Records of the San Diego County Recorder, covering the property
hereinabove described, as Instrument No. 87-086170 O.R.
AND WHEREAS, the BENEFICIARY affirms that they are the owners
and holdersof the hereinabove described trust deed note, and do
hereby direct and authorize said TRUSTEE to join in the execution of this
instrument.
NOW, THEREFORE, for and in consideration of the benefits to accrue to the
above described land by acceptance of said easement by said City of Chula

On November 4, 1987, the Public Works and Planning Departments conditionally
approved Tentative Parcel Map 88-3. Said parcel map involves the division of
one lot located at the northwest corner of Otay Lakes Road and East "H" Street
into 11 parcels zoned for commercial development. The proposed development is
the Bonita Point Shopping Center.
Conditions placed upon the Tentative Parcel map required the developer (Bonita
Point Plaza Partnership) to grant easements for street, tree, sewer, access,
hike path and traffic control purposes.

RECOMMENDATION: That Council adopt resolutions "a' through ,f, as listed in
the item title of this report.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The street and street tree easements are normal requirements for Tentative
Parcel Maps. The bikeway easement is to provide a separate path for bicycles
traveling on East "H" Street along the subject property. A concrete
meandering bike path will be provided along the project frontage. The
easements described in Item "e' are to provide access for City forces to
maintain the sewer pump station located just westerly of the property. The
easements for traffic control are to allow for the installation of traffic
signals on East "H" Street and Otay Lakes Road for ingress and egress to the
shopping center.
The documents granting the easements have been properly executed and
notarized, and submitted herewith for acceptance by the City Council. A plat
is available for Council viewing.
