RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA WAIVING PROCEDURAL REQUIREMENTS
FOR SALE OF SURPLUS REAL PROPERTY, ACCEPTING A
BID THEREFOR AND AUTHORIZING THE MAYOR TO
EXECUTE A GRANT DEED THEREFOR
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Chula Vista Municipal Code Section 2.56.230
authorizes the sale of excess real property declared by the City
Council to have no present or future use for public purposes in
accordance with certain procedures depending on the appraised or
estimated value of the property, and
WHEREAS, Chula Vista Municipal Code Section 2.56.070
requires that surplus real property of an estimated value in
excess of ,16,000 be sold by competitive bidding unless the City
Council finds by resolution expressed in its official minutes,
that competitive bidding is impractical or impossible, and
WHEREAS, the excess real property became so as the
result of a conditional vacation of a public street at the
northwest corner of the intersection of Broadway and Anita
Street, which resolution of conditional vacation is adopted
simultaneously herewith, and
WHEREAS, pursuant to Council direction, staff has
negotiated with the adjacent property owner and other persons
expressing interest in potential acquisition of the site and
negotiated sale of the surplus real property to the adjacent
property owner subject to the conditions set forth in the
resolution of conditional vacation of the street, including
inclusion of the surplus property in the entire parcel as part of
the developed lot, and
WHEREAS, notice of such sale has been published at least
once in a newspaper of general circulation in the City prior to
sale.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that competitive bidding is impractical
under the circumstances, the negotiated sale procedure followed
by staff at the direction of the City Council is the substantial
equivalent of competitive bidding, and the competitive bidding
procedural requirements of Chula Vista Municipal Code Sections
2.56.070 and 2.56.230 are hereby waived.
BE IT FURTHER RESOLVED that the City Council does hereby
accept the offer of William Perkins in the amount of $39,911.75
for t~e purchase of said surplus real property subject to the
other terms and conditions set forth in the resolution of
conditional vacation.
BE IT FURTHER RESOLVED that the City agrees to share
equally the cost of the traffic study and appraisal with the
purchaser, and thereby reduce the amount to be paid by $2,400 to
a net $37,511.75.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized and directed to
execute the corporation grant deed attached hereto as Exhibit A,
conveying said property to William Perkins upon satisfaction of
all the conditions set forth in the resolution of conditional
vacation.
