The City Council approved the first phase of the Master Fee Schedule update at its June 8, 2010 meeting. In conjunction with the Council's consideration of the City Manager's Proposed Operating Budget for fiscal year 2011-12 at tonight's meeting, a limited number of fee updates are recommended, including adjustments to parking and 11-1 JiJNE 7, 2011, Item Page 2 of 12 recreation fees included in chapters 7 and 13 of the Fee Schedule. The proposed fee adjustments are not reflected in the City Manager's Proposed Budget for fiscal year 2011- 12. ENVIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as defined under Section 15378(b)(4) of the State CEQA Guidelines because it is a government fiscal activity; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION That Council adopt the resolutions. BOARDS/COMMISSION RECOMMENDATION None. DISCUSSION On January 20, 2009, the City Council endorsed the City Manager's Fiscal Health Plan which included the review of the City's Master Fee Schedule to identify potential additional fee revenues. Council approved Phase I at its June 8, 2010 meeting. In conjunction with the Council's consideration of the City Manager's Proposed Operating budget for fiscal year 2011-12 at tonight's meeting, a limited number of fee updates are recommended, including adjustments to parking and recreation fees included in chapters 7 and 13 of the Fee Schedule. Staff will return to Council with Phase II of the Master Fee Schedule update at its July 12, 2011 meeting. Phase II of the Master Fee Schedule review will include updates to all development and construction related processing/ review fees. The final phase of the Master Fee Schedule update will be presented to Council this fall and will include comprehensive review of all fees associated with the Recreation, Library, Animal Shelter, Police, Fire and Public Works departments. Master Fee Schedule -Current Action Staff has identified a limited number of fees recommended for adjustment at this time. These include fees for use of government property for recreation purposes and State/ County pass-through fees for processing parking citations. 11-2 JtINE 7, 2011, Item__I ~__ Page 3 of 12 Chapter 7 -Recreation The Recreation fees recommended for update at this time include only those fees associated with the use of, or entrance to, or rental of, government property. Specifically, the fees to be updated at this time include: 1. Recreation facility rentals, general 2. Fitness center memberships 3. Aquatic facility rentals 4. Swim passes 5. Ball field rentals 6. Picnic shelter rentals Attachment A details the recommended modifications to Chapter 7 of the Master Fee Schedule, in redline/ strikethrough format. Recreation Facility Rentals, General The City allows individuals and groups to rent spaces at Recreation facilities for public and private purposes. These rentals are charged on an hourly basis, with the hourly rate varying based upon the user group, as detailed in the Master Fee Schedule. Based on the input of potential and actual customers, a combination of new fees and adjustments to existing rental Fees are recommended. Table 1 outlines the proposed new fees; Table 2 details the proposed fee adjustments. The proposed fees are intended to maximize the revenue generated by these rentals. In some instances the recommended adjustments include fee reductions, with the expectation that a reduced fee will result in increased volumes, generating increased revenues. These memberships allow for use of the fitness centers and equipment fora 12-week session. The Recreation Department has received input from holders of fitness center memberships that the current fee schedule is not competitive with other market options. In order to increase overall revenues, a reduction in the fee per 12-week session is recommended for the Otay Recreation Center and Salt Creek Center facilities. No adjustments to the membership fees for the Norman Park Center are recommended. It should be noted that the Otay Recreation Center and Salt Creek Facilities are only open to fitness center members two days per week. Norman Park Center fitness center members have access to their facility five days per week. It is anticipated that the reduction in the membership fee will result in increased membership volumes, resulting in increased revenues. The non-resident surcharge for fitness memberships is 100%, as reflected in the table below. Minor increases to these hourly rental rates are recommended, as detailed in the table below. The current Master Fee Schedule includes Daily Passes, Ten-Swim Passes, Summer Passes (Memorial Day through Labor Day) and Quarterly Passes (3 months per pass). Staff recommends the elimination of the Summer Pass and Quarterly Pass programs. In place of these long term passes, staff recommends the creation of a Twenty-Swim Pass, along with some minor adjustments to the rates for Daily Passes and Ten-Swim Passes. The proposed swim pass fee schedule is summarized in the table below. The rental fee is charged on an hourly basis, and varies based on the size of the rental (full field or half field), the field amenities (lighted or unlighted field), and the user group (private adult leagues, members of the Youth Sports Council, and the City's adult sports league). The City's current ball field rental fees, per hour, are summarized in Table 7 below. As a result of recent budget reductions, the City is unable to adequately maintain its sports fields. This reduced maintenance impacts the condition, and ultimately, the usability of the fields for sports. Occasionally, field conditions degenerate so significantly that the City is forced to remove the field from use. This decision may be based upon the safety of the field, or to prevent permanent damage resulting from continued play without sufficient maintenance. This reduction in facility availability directly impacts the teams that regularly use the fields. Increased ball field rental revenues would allow the City to improve the maintenance of the ball fields. This improved maintenance would both increase the availability of facilities for the users and avoid additional costs incurred to rehabilitate a damaged sports field (as compared to the basic level of maintenance associated with non-sport activities). 11-6 J[JNE 7, 2011, Item_~_~_ Page 7 of 12 In considering a fee increase for the ball field rentals, staff first considered charging the members of the Youth Sports Council and the City's adult sports league the same fees currently charged to private adult leagues ($25/$40 per hour for full field, unlighted and lighted). If adopted, this change would generate approximately $900,000 in additional revenues annually (assuming no significant reduction in field usage). The estimated impact to both Youth Sports Council members and participants in the City's adult sports league are summarized in Table 8 below. Instead, staff recommends collecting $10 for unlighted fields and $25 for lighted fields, with no modification to the rental rates for private adult leagues. The proposed ball field rental fees, per hour, are summarized in Table 9 below. No appropriation of these revenues is recommended at this 11-7 JUNE 7, 2011, Item ~ Page8of12 time. Instead, it is recommended that the proposed fees be implemented, with staff returning to Council for amid-year appropriation based upon actual team registrations (scheduled for August/ September). At that time, it is recommended that these additional revenues be appropriated to the Public Works Department to increase ball field maintenance services. The Public Works Department estimates that the projected revenues will be adequate to fund a reasonable maintenance level for the ball fields, improving their availability for users and avoiding rehabilitation costs resulting from lack of field maintenance. The estimated impact of this proposal to both Youth Sports Council members and participants in the City's adult sports league are summarized in Table 10 below. This is not a field rental or maintenance fee, and goes to partially offset the costs of staff support of the Youth Sports Council, including allocation of ball fields. Participants in the City's adult sports league pay a number of fees, in addition to the ball field rental rate (currently $15 for lighted fields only). These fees are collected from each team at registration, and are summarized in Table 11 below. The Recreation Department recommends the creation of a Tournament Rental Fee, for use of multiple fields. This fee will only be applicable at the new Mt. San Miguel Community Park. Fees for day time use and night time use are proposed, with a minimum rental period of 6 hours per day. This new ball field rental fee is detailed in the table below. These shelters generate approximately 2,700 rentals annually. Staff has compared picnic shelter rental/ reservation fees charged by the City and other local jurisdictions. Based upon this market review, staff is recommending increased hourly rental rates as detailed in Table 13 below. Table 9 below compares the current Chula Vista rate for small/ picnic size facilities, the proposed Chula Vista rate for small/ picnic size facilities, and the current rates of other local jurisdictions for similarly sized facilities. It is important to note that the Chula Vista rental rate is a daily rate, not an hourly rate. Several local jurisdictions charge picnic shelter rentals on an hourly basis. For comparison purposes, 4 hours of use has been assumed in place of a daily rate for all 11-9 JiJNE 7, 2011, Item Page 10 of 12 jurisdictions renting on an hourly basis. These jurisdictions are identified with an asterisk (*) in Table 14 below. The proposed fees are projected to generate approximately $150,000 in additional revenues to the City. This projection assumes no reduction in the annual number of rentals, and no significant change in the mix of rentals (large versus medium versus small). If the proposed increase to the picnic shelter rental fee is approved by Council, it is recommended that these additional revenues be allocated to the Public Works Department in order to restore the recently eliminated Park Rangers program. The City's Park Ranger program was eliminated in conjunction with the budget reduction plan implemented in January 2011. This reduction in staff has resulted in complaints from the community regarding lack of oversight and enforcement of picnic shelter reservations. With the approximately $150,000 projected to be generated by this fee increase, the Public Works Department has estimated that they could restore a minimal Park Ranger program utilizing volunteers and hourly staff (164 hours per week of Park Ranger services). A resolution including this $150,000 additional hourly personnel funding in the Public Works Department's fiscal year 2011-12 budget will be presented to Council in conjunction with the public hearing on the City Manager's Proposed Budget for fiscal year 2011-12 later this evening. 11-10 JiJNE 7, 2011, Item ( ~ Page I 1 of 12 Chapter 13 - Parlting The State of California and County of San Diego charge the City fees for the processing of parking citations by the South Bay Court. Historically, the City has absorbed this cost. It is recommended that these fees be treated as apass-through fee, and be authorized for collection in addition to the City's parking citation amounts. The State and County pass-through fees to be collected on each parking citation are summarized in the table below. These fees are also recommended for inclusion in the Master Fee Schedule as apass-through fee, in addition to the established citation fine amount. Tonight's action will not increase the City's parking citation fine amounts. It will instead treat the State and County mandated processing fees as apass-through, and authorize their collection in addition to the City's parking citation fines. Attachment B details the recommended modifications to Chapter 13 of the Master Fee Schedule, in redline/ strikethrough format. Next Steps The next phase of the Master Fee Schedule review will include all development and construction related processing/ review fees. This update is planned for consideration by the Council at its July 12, 2011 meeting. The final phase of the Master Fee Schedule review will include all remaining public safety, community service, and administrative fees. Future fee reviews and updates will be conducted in accordance with the Citywide Cost Recovery Policy, as adopted. 11-11 JiINE 7, 2011, Item Page 12 of 12 DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500 foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. CURRENT YEAR FISCAL IMPACT The proposed fees will become effective 30 days after adoption. As a result, the fees will not go into effect until next fiscal year. ONGOING FISCAL IMPACT The proposed fees will become effective in July of 2011. Approval of Resolutions A and B, amending the Chapter 7 of the Master Fee Schedule (Recreation Fees) is estimated to generate annual ongoing revenues of approximately $571,000, as summarized in the table below. The adjustment to fitness center memberships is not anticipated to generate additional revenues; but is instead recommended to support the revenues assumed in the proposed fiscal year 2011-12 budget. Approval of Resolution C, amending Chapter 13 of the Master Fee Schedule (Parking Fees) is estimated to generate annual ongoing revenues of approximately $75,000. The actual revenues to be generated will vary based on the number of parking citations issued by Chula Vista and processed by the South Bay Court. Approval of the resolution mitigates the impact of State and County processing fees charged to the City, and does not increase the City's parking citation amounts. Policies and regulations governing facility use permits are provided in Council Resolution 12343. An employee or City- appointed representative must be present during use of listed facilities. GENERAL FACILITIES -USE PERMIT 1. Group Priorities Facilities are available for recreation activities under the following order of priority based on group classification. Non-resident surcharge is 100%. Classification 1: City programs. Non-resident surcharge not applicable to City sponsored uses. Classification 2: Chula Vista community service organizations related in purpose to recreation and the furtherance of community leisure programs. Classification 3: Chula Vista civic and social organizations which are democratic in character with membership open to the general public or designated elements thereof. Classification 4: Private resident groups requiring large facilities for special events not open to the general public. If applicant is a Chula Vista resident, the non-resident surcharge does not apply. Classification 5: Unions, employee associations and special recreational groups and non-residential groups requiring public facilities 2. Basic Fee Schedule The Basic Fee is based on the group's classification as described in Section 1 for Classifications 2 through 6, and includes a Facility Use Fee and an Hourly Staff Fee. The Facility Use Fee is charged on an hourly rental rate basis, per the schedules below. Hourly Staff Fees are also charged, at the prevailing hourly staff rate, for any activities requiring supervision, room or facility set-u p, or custodial services. There is an additional charge if special services are required. There is no charge for groups in Classification 1. Facility Use -Fee Schedule I Community organizations in Classification 2 or 3 shall be granted use of facilities without charge if no additional staff is required and if any admissions fee/contribution is not collected. If additional staff is required, the community organization will be charged prevailing hourly staff fees. Facility Use -Fee Schedule II Community organizations in Classification 2 or 3 can use facilities on an actual cost basis if a contribution/fee is assessed for charitable purposes. Actual costs consist of hourly staff fees for personnel and a minimum utility charge as shown in Fee Schedule II on the reverse of this bulletin. Facility Use -Fee Schedule III Resident organizations and individuals in Classification 4 not qualifying for Fee Schedule I or II will be assessed the Facility Use Fee shown in Fee Schedule III, plus the Hourly Staff Fee (Fee Schedule II). Facility Use -Fee Schedule IV Those individuals or groups in Classification 5 and 6 will be assessed the Facility Use Fee based on Fee Schedule IV, or 30% of gross receipts, whichever is greater, plus the Hourly Staff Fee (Fee Schedule II). A financial report must be submitted one week after the activity is held if an admission fee was charged. If applicant is a Chula Vista resident, the Non-resident surcharge will not apply. Hourly Staff Fees are also charged, at the prevailing hourly staff rate, for any activities requiring supervision, room or facility set-up, or custodial services. There is an additional charge if special services are required. There is no charge for groups in Classification 1. Facilitv Use -Fee Schedule I Community organizations in Classification 2 or 3 shall be granted use of facilities without charge if no additional staff is required and if any admissions fee/contribution is not collected. If additional staff is required, the community organization will be charged prevailing hourly staff fees. Facilitv Use -Fee Schedule II Community organizations in Classification 2 or 3 can use facilities on an actual cost basis if a contribution/fee is assessed for charitable purposes. Actual costs consist of hourly staff fees for personnel and a minimum utility charge as shown in Fee Schedule II on the reverse of this bulletin. Facilitv Use -Fee Schedule III Resident organizations and individuals in Classification 4 not qualifying for Fee Schedule I or II will be assessed the Facility Use Fee shown in Fee Schedule III, plus the Hourly Staff Fee (Fee Schedule II). RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING CHAPTER 13 (PARKING FEES) SECTION 100 (PARKING METER CITATIONS) OF THE CITY'S MASTER FEE SCHEDULE WHEREAS, in June, 2010, the City Council adopted the existing Chapter 13 (Parking Fees) of the City's Master Fee Schedule; and WHEREAS, the Council wishes to amend Chapter 13 (Pazking Fees) Section 100 (Parking Meter Citations) of the Master Fee Schedule, as set forth in Exhibit 1, attached to this Resolution and incorporated by reference as if set forth in full; and WHEREAS, the amendments would result in the pass-through by the City of fees imposed by other governmental agencies; and WHEREAS, Article XIII C of the California Constitution requires a vote of the electorate to increase any levy, charge, or exaction imposed by a local government, unless specifically exempted; and WHEREAS, the proposed pass-through fees are not imposed by the City but by other governmental agencies and also fall within the definition of fines, penalties, or other monetary charges imposed by the judicial branch of government or a local government, as a result of a violation of law, which aze exempted from the vote requirement pursuant to Article XIII C Section 1(e)(5); and WHEREAS, the proposed amendments to the Master Fee Schedule, Chapter 13, Section 100, shall not become effective until 30 days after adoption of this Resolution by the City Council.
