The attached revision to Civil Service Rule VIII incorporates changes that were
required based on court cases - notably the Skelley decision. The Revision
includes procedures to insure more safeguards and appellate rights for classified
employees.
The revised rule was submitted to and approved by the Civil Service Commission at
their November meeting and is presented for your review and approval.

SECTION 1, CAUSE FOR SUSPENSION, DEMOTION OR REMOVAL

SECTION 3. PROCEDURE FOR DISCIPLINARY ACTION AND APPEAL
Replaces old (a) The appointing authority may, for disciplinary purposes
Sections 4,5,6,7, suspend without salary any officer or employee holdina
8,10,& 12 a position in the classified service for not more than
an aggregate of ninety (901 days in a celender year.
(b1 Employees suspended, demoted or discharged shall be given
a pre-disciplinary hearing, including advance notification
and an opportunity to respond. The administrative pro-
cedures required for the conduct of a pre-disciplinary
hearing, and the safeguards insuring due process to each
employee are codified in full as Section 209 of the
Administrative Manual.
(c1 Fequired Notice: Upon completion of the pre-disciplinary
hearing, and upon determination that probable cause exists
for disciplinary action, a rJritten statement constituting
the notice and order of .ouch action shall irmnediately be
served on the employee, with copies to the Director of
Personnel and the City Manager. The notice shall advise
the employee of his or her right to appeal ~ the employee
has attained permanent status in the Classified Service of
the City.
(d) ~veaZ and Request fer ,iearinq: If an employee, with appeal
rights, having been issued the notice of disciplinary action,
desires to appeal the action, he or she shall with
ten CZO) calendar days from the date of receiving the
charges, appeal to the Cormnission by filing a written an-
swer to the charges and a request for hearing. The appeal
shall be filed in the offzee of the City Clerk and with
the Co~mnission, with copies to the disciplinary authar-
itu Cdepartment Head) and the Director of Personnel.
Ce1Time for HAarinq: The Corruaission shall, within a re-
sonabZe'tim~ not to exceed thirty C30) calendar days
from the filing of the appeal, convnence the hearing
thereof, and shall, without delay, fully hear and deter-
mine the matter, and either affirm, modify or revoke
such order. Any employee, having filed an appeal with
the Commission and having been notified of the time and
place of the hearing, who fails to make an appearance
before the Co~mnission, either in person or through an
attorney, may be deemed to have abandoned his or her
appeal, In this event, the Commission may, at its
discretion, dismiss the appeal.

SECTION ~, CONDUCT OF THE HEARING
Replaces old AZZ hearings and investigation before the Commission shall be

conduct thereof the Commission shall not be bound by technical
rules of evidence, nor shall informaZitu in any of the pro-

evidence in support of the charges and subsequent
disciplinary actions.
C21 The employee shall produce such evidence as he
or she may desire to offer in defense.
(3) The parties in interest may offer rebuttal evidence.
(e) Testimony taken at the hearing shall be under oath and
shall be recorded by the secretary. The secretary shall
administer the oath, and shall be responsible for tre-
paring and certifying a transcript of all proceedings
and testimony of material witness(es) so that copies
may be provided any principal to the action.

SECTION ~4. FINDINGS AND DECISIONS

Replaces old The findings and decision of the Commission shall be in
Section 14 and 15 writing and shall state as to each charge whether or not
such charge is sustained. The Commission shall also set
forth in writing its conclusions and recommendations based
upon such findings and within ten (10) oa?endar days after
concluding the hearing, ~t shall certify its findings,
conclusions and recommendations to the appointing authority,
