HomeMy WebLinkAboutAgenda Statement 1978/01/03 Item 12CITY OF CHULA VISTA COUNCIL AGENDA STATEMENT Item No. 12 for meeting of 1-3-7 ITEM TITLE Resolution#8961: Declaring City's Intention to Vacate a Portion of Quintard Street between First Avenue and Tobias Drive ~, SUBMITTED BY Director of Public Works/City Engineer J; ITEM EXPLANATION (4/5TN'S VOTE REQUIRED YES- NO x) The property owners along the south side of Quintard Street between First Avenue and Tobias Drive have requested the vacation of the southerly 12 feet of Quintard Street adjacent to their properties. The present width of the southerly half of Quintard Street is 40 feet which is 12 feet in excess of that required by the adopted City standards for a residential collector street. The various utility companies have been notified and as long as easements for their existing facilities are provided, they had no objections to the vacation. Upon vacation, the underlying fee title to the vacated area will revert to the adjacent property owners. The Street Vacation Act of 1941, in accordance with the California Streets and Highways Code, requires that a public hearing be held to hear people in favor of or objecting to the uroposed street vacation. A transparency is available for Council viewing. The Commission made the following findings of fact with respect to the partial street vacation as requested: 1. The proposed vacation will bring the southerly half of Quintard Street into conformance with the City's adopted street standards fora residential collector street which requires a width of 56 feet. The existing width of the southerly half of Quintard Street right of way is 40 feet, or 12 feet more than required. 2. All of the public utility companies have been notified and no objections to the street vacation have been received. 3. The resulting street width of Quintard Street will be consistent with the standards established by the General Plan for residential collector streets. Based on these findings the Commission recommends that the southerly 12 feet of Quintard Street between First Avenue and Tobias Drive be vacated. ~~ ~ ~> ~~~~ _ __ D. J.
