HomeMy WebLinkAboutAgenda Statement 1978/01/03 Item 11CITY OF CHULA VISTA COUNCIL AGENDA STATEMENT Item No. 11 For meeting of 1-3-7~ ITEM TITLE Resolution Declaring City's Intention to Vacate a Portion of Moss Street SUBMITTED BY Director of Public Works/City Engineer /1~;~~~ ITEM EXPLANATION (4/STN'S VOTE REQUIRED YES- NO x ) Mr. James Yamate, 724 Moss Street, Chula Vista 92011, has requested the vacation of Moss Street between Industrial Boulevard and the I-5 freeway. Vacating the street will allow full utilization of the applicant's property since he owns the property lying on both sides of Moss Street. Upon vaca- tion, the underlying fee title will revert to Mr. Yamate. The street is unimproved and has not been used by the public since the Montgomery Freeway was built in the early 1950's. This portion of Moss Street is not shown on the circulation element of the Chula Vista General Plan. All utility companies have been notified of the proposed vacation and no objections were received. xowever, both Pacific Telephone and Sweetwater Authority requested that easements be reserved for their facilities. The Street Vacation Act of 1941, in accordance with the California Streets and Highways Code, requires that a public hearing be held to hear people in favor of, or objecting to, the proposed vacation. The Commission made the following findings of fact with respect to the Vacation as requested: The proposed vacation will allow full utilization of the applicant's property since he owns the property lying on both sides of Moss Street. Upon vacation the underlying fee will revert to Mr. Yamate. 2. The utility companies have expressed no objection to this street vacation provided easements are preserved for the existing facilities lying within that portion of Moss Street to be vacated. 3. The street has not been improved nor used by the public since Montgomery Freeway was constructed in the early 1950's. 4. This section of Moss Street is not shown on the circulation plan of the City of Chula Vista General Plan. Based on these findings the Commission recommends that the portion of Moss Street lying between Industrial Boulevard and I-5 freeway be vacated subject to the condition that easements are provided for the public utilj-ty~companies as requested. <4-3 .
