ITEM TITLE Resolution H8906: Approving Agreement between Robinhood Homes,
Inc. and the City of Chula Vista for Partici-
pating in the Improvement of Brandywine Avenue

A condition on the tentative map for the entire Robinhood Point Subdivision
was to construct half of Brandywine Avenue across the entire frontage
of the Subdivision. There will then be remaining a 4' segment of pavement
needed in order to finish the existing improvements on the westerly side
of Brandywine Avenue. It was required that the developer enter into an
agreement with the City of Chula Vista to construct the improvements with
financial participation from the City to pay for this 4' wide strip. The
City had budgeted $4,200 to pay for this project.
Phase 1 of the City's participation of improving Brandywine Avenue adja-
cent to Robinhood Point, Unit 1, as approved by Resolution No. 8291 has
been constructed and completed at a cost of $1,500.
Phase 2 is Unit 3 on this tentative map and is now ready for development,
and the developer will be improving Brandywine Avenue north of Sequoia
Street. The 4' wide strip to be paid for by the City adjacent to Unit 3
is estimated at a cost of $4,000. The attached agreement provides that the
City will pay the subdivider for the construction of these improvements
adjacent to Unit 3 in accordance with the actual contract unit prices as
bid, upon receipt of a verified contract document and invoice for work
completed. It further provides that the City will not pay more than $4,200
for the improvements adjacent to Unit 3 of the Subdivision.
Robinhood Point Unit No. 3 will complete the full improvements of Brandywine
Avenue within the entire Robinhood Point Subdivision. This agreement will
complete the participation of the City towards the improvement of Brandywine
Avenue and the condition of the approval of the tentative map.

FINANCIAL IMPACT
Project will be financed with city Gas Tax funds. City will assume cost
of maintaining improvements upon acceptance of City Council. Council
will need to appropriate an additional $1,500 to this project.
STAFF RECOMMENDATION
1. City Council approve agreement.
2. City Council appropriate $1,500 from the unappropriated balance of
Gas Tax Fund 2106 and transfer to Brandywine Avenue Project GT-11.
3. City Council authorize expenditure of $4,200 from Brandywine Avenue
Project GT-11.

to be incurred by the contract or agreement authorized by the
attached resolution can be incurred without the violation of any
of the provisions of the Charter of the City of Chula Vista, or
the Constitution or the laws of the State of California, that
sufficient monies have been appropriated for the purpose of said
contract, that sufficient monies to meet the obligations of the
contract are actually in the Treasury, or are anticipated to come
into the Treasury to the credit of the appropriation from which
the same are to be drawn, and that said monies now actually in
the Treasury, together with the monies anticipated to come into
the Treasury, to the credit of said appropriation are otherwise
unencumbered.
