The City Council by Resolution No. 8419 on November 16, 1976 approved the
tentative map of E1 Rancho del Rey, Unit No. 5. Within the subdivision,
there are two overhead distribution lines of 12KV each traversing the
subdivision. These existing overhead lines are shown on attached sketch
as line A-B and C-E. Another distribution line is located on the south
side of Telegraph Canyon Road and designated as line B-C.
Chapter 15.32 of the Chula Vista Municipal Code requires that subdividers
underground existing overhead distribution facilities within the boundaries
of any subdivision.
On October 17, 1977, Mr. D. L. Clemens, President of Utility Consultants,
Inc., on behalf of his client, E1 Rancho del Rey Corporation, submitted
an application for deferral of undergrounding the existing overhead dis-
tribution lines along the 250 foot easement of S.D.G.& E. Co. shown as
Line C-E on the plat. The subdivider is to remove the overhead line A-B
and convert to underground by a route along the proposed streets in the
subdivision as shown as line D-A. To convert the overhead to underground
as shown as Line C-E, the estimated cost is approximately $50 per foot for
1400 lineal feet which amounts to $70,000. With 340 lots in the subdivi-
sion, the cost per lot to underground the existing overhead line is approxi-
mately $206. The overhead transmission facilities along the south side of
Telegraph Canyon Road shown as line B-C is exempt from the requirements
of undergrounding because its location is not contiguous to the boundary
of the subdivision.
Section 15.32.040 of the Chula Vista Municipal Code requires that a public
hearing be held to hear persons speaking in favor of or objecting to the

STAFF RECOMMENDATION City Council set November 29, 1977 at 7:00 pm in the
Council Chambers as the time and place for public hearing to consider the
deferral of undergrounding overhead facilities along the 250 foot easement
of S.D.G.& E. Co. within the E1 Rancho del Rey, Unit No. 5 Subdivision.

deferral of undergrounding overhead facilities as referenced to in the
application for deferral.
At the public hearing the Council may defer the requirements to underground
existing overhead facilities if they find from the evidence presented
in the hearing that all the following facts exist:
a. That extraordinary conditions exist to the extent that enforce-
ment of this subsection would result in unnecessary hardship to
the subdivider or the utility company.
b. That such deferral will not, under the circumstances of the par-
ticular case, be detrimental to the health, safety or general
welfare of the neighborhood.
A transparency is available for Council viewing.
