A. BACKGROUND
1. On October 26, 1976 the Planning Commission approved a conditional use permit
(PCC-78-7) fora truck repair facility resently in operation at 1180 Walnut Avenue in
the I-L-P zone (see attached resolution and recommended approval of the precise plan
(PCM-78-7). The item is before the Council for precise plan approval..
2. An Initial Study (IS-78-21) on this project was certified by the Planning Conrnis-
sion and is herewith forwarded to the City Council.
B. DISCUSSION
Adjacent zoning and land use:
North I-L-P Vacant
South I-L-P Service station
East I-L-P Towing service and service station
West I-L-P I-5 freeway
2. Existing site characteristics.
The project site contains approximately .57 acres and is developed with a 2400 sq. ft.
concrete block building. Two access easements and a SDG&E easement traverse the westerly
and southerly portions of the site. The access road, located to the south and west of
the building is paved to an average width of 18 feet and serves an adjoining restaurant
and halfway house. The existing storage, parking and work areas are not enclosed or
screened and are generally unpaved. Walnut Street is not improved.

plan for development of the site for the truck repair facility at 1180 Walnut Avenue, in

3. Existing operation.
The applicant has been operating in violation of the zoning regulations for some time.
In December, 1476 the applicant was issued a zoning permit to conduct a truck repair
operation. Approval of the zoning permit was predicated on the condition that all work
was to be conducted within an enclosed building as required by Section 19.44.170 of the
zoning ordinance. Not only has the applicant been doing work outside the building, but
virtually the entire site, including the westerly access easement, has been used to park
trucks and trailers. This open storage of trailers has created a very cluttered and detri-
mental appearance for the entire area. The applicant has been offering 24 hour service,
which is allowable unless specifically restricted by the Planning Commission.
4. Precise Plan.
The applicant proposes to enclose the outside work area with a solid fence with gates
opening toward the easement and Walnut Avenue. Five customer parking spaces are provided
along the northerly property line and a total of six employee parking spaces provided on
the west and south sides of the building. The remaining area around the building will be
landscaped.
C. ANALYSIS
The conditions of approval of the conditional use permit and the recommended conditions for
the precise plan should result in a general upgrading of the area and protection of the
adjacent residential uses. The Department of Public Works has indicated that there are
enough existing and deferred improvements on Walnut Avenue to initiate a block act to have
the street improvements installed, which will also considerably upgrade the area.

RESOLUTION OF THE CITY PLANNING COMMISSION
GRANTING A CONDITIONAL USE PERMIT
WHEREAS, a duly verified application fora conditional use permit was filed
with the Planning Department on September 23, 1977 by Gary Iverson, and
WHEREAS, said application requested permission to conduct a 24 hour truck
repair business at 1180 Walnut Avenue in the I-L-P zone, and
WHEREAS, the Planning Commission set the time and place fora hearing on said
application and notice of said hearing was given by the mailing of a letter to property
owners within 300 feet of the exterior boundaries of the property at least ten days
prior to the hearing, and
WHEREAS, the hearing was held at the time and place, namely 7:00 p.m., October 26,
1977 in the Council Chamber, City Hall, 276 Fourth Avenue, before the Planning
Commission and said hearing was thereafter closed, and
WHEREAS, the Commission found that in accordance with the Negative Declaration
on IS-78-21 and the findings stated therein, approval of this use will have no
significant adverse environmental impact, and certified the Negative Declaration.
NOW THEREFORE BE IT RESOLED THAT THE CITY PLANNING COMMISSION finds as follows:
a. That the proposed use at the particular location is necessary or desirable to
provide a service or facility which will contribute to the general well being of the
neighborhood or the community.
The proposed use is located near a freeway interchange and will provide a
needed service to the community. In addition, the use is compatible with
other uses in the immediate area, namely the towing service and service station.
b. That such use will not, under the circumstances of the particular case, be detri-
mental to the health, safety or general welfare of persons residing or working in the
vicinity, or injurious to property or improvements in the vicinity.
The conditions of approval will ensure that the proposed use will not be
detrimental to the health, safety, or general welfare of persons or improve-
ments in the vicinity.
c. That the proposed use will comply with the regulations and conditions specified
in the code for such use.
Regulations specified in the code for a truck repair operation will be enforced.
d. That the granting of this conditional use will not adversely affect the general
plan of .the city or th.e adopted plan of any governmental agency.
This use is compatible with uses permitted in the General Plan designation
for the area.
BE IT FURTHER RESOLVED that the City Planning Commission grants a conditional
use permit to Gary Iverson for the operation of a truck repair business at 1180
Walnut Avenue in the I-L-P zone, subject to the following conditions:
1. No trucks or truck trailers shall be parked or stored on the private
road easement or on the public street.
2. All work shall be conducted within the building or within the area to be
fenced.
3. The hours of operation shall be between 8:00 a.m. and 6:00 p.m., Mondays
through Saturdays; however, emergency repair work is permitted during all
other hours, including Sundays.
4. All gates adjacent to 4lalnut Avenue shall be kept closed during hours of
operation except as necessary to allow vehicular ingress and egress,
This conditional use permit shall become ineffective and void if the same is not
utilized within one year from the date of this resolution in accordance with Section
19.14.260 of the Municipal Code.

RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE
CITY COUNCIL THE APPROVAL OF A PRECISE PLAN FOR A TRUCK REPAIR
FACILITY AT 1180 WALNUT AVENUE IN THE I-L-P ZONE
WHEREAS, Ordinance No. 1477, adopted by the City Council on July 24, 1973,
established the I-L-P zone on properties located on the east and west side of
Walnut Avenue, north of Palomar Street and south of the SDG&E easement, and
WHEREAS, on September 23, 1977 a precise plan was submitted by Gary Iverson
to develop the property at 1180 Walnut Avenue as a truck repair facility, and
WHEREAS, the City Planning Commission, at a duly advertised public hearing
held at 7:00 p.m., October 26, 1977 in the Council Chamber, City Hall, 276 Fourty
Avenue, considered the precise plan as submitted, and
WHEREAS, the Planning Commission found tha+. in accordance with the Negative
Declaration on IS-78-21 and the findings stated therein, this development plan
will have no significant adverse environmental impact and certified the Negative
Declaration.
NOW THEREFORE BE IT RESOLVED THAT THE CITY PLANNING COMMISSION finds as
follows:
a. That such plan will not, under the circumstances of the particular case, be
detrimental to the health, safety or general welfare of persons residing or working
in the vicinity, or injurious to property or improvements in the vicinity.
The applicant is required to provide fencing to screen the outside work
area and landscape the site.
b. That such plan satisfies the principles of the application of the "P" Modifying
District as set forth in Section 19.56.041.
The area is characterized by a mixture of commercial, industrial and residen-
tial land uses so that the application of the "P" Modifying District will
help to insure the compatibility of the various uses.
c. That any exceptions granted which deviate from the underlying zoning requirements
shall be warranted only when necessary to meet the purpose and application of the "P"
Precise Plan Modifying District.
Substitution of an 8 foot wall or fence for the requirement for an enclosed
building represents a reasonable solution under the circumstances of this case.
d. That approval of this plan will conform to the general plan and the adopted
policies of the city.
The general plan is not affected.
BE IT FURTHER RESOLVED that the City Planning Commission recommends that the
City Council approve the precise plan fora truck repair facility at 1180 Walnut
Avenue, including a freestanding sign, subject to the following conditions:
1. Permanent street improvements as stated below shall be provided on Walnut
Avenue by the applicant.
a. Monolithic curb, gutter and sidewalk in accordance with Standard
Drawing No. 103-A. The top of curb shall be 20 feet from the center-
line of the street.
b. Street pavement from the centerline of street to lip of gutter.
c. Portland cement concrete driveway approaches at all driveway locations.
d. An alley type approach shall be provided in accordance with Standard
Drawing No. 106 at the southerly end of the property where an existing
access road for adjacent property is located. The minimum width of
such approach shall be 24 feet.
2. Prior to issuance of permits for the proposed work, the applicant shall
submit a plan for the provision of sewer service to the property for
approval by the Director of Public Works.
3. All areas proposed for parking, storage, repair and access shall be paved
with 2" of asphalt concrete over 4" of aggregate base with seal coat.
4. A solid 8 foot high fence or wall shall be provided around the area.

5. A solid 6 foot high fence or wall shall be provided on the northerly
property line adjacent to the five customer parking spaces.
6. Wheel stops shall be provided.
7. A landscape and irrigation plan for all areas to be landscaped shall be
submitted for approval by the City's landscape architect.
