That agreement set forth the conditions of FAU improvements, right of way, fiscal provisions, miscellaneous provisions and maintenance. On July 19, 1977, the Director of Public Works submitted a report to the Council in which Council was advised that FAU funding for the "F" Street widening project would be withheld unless the uniform widening of the roadway to 64 feet extended all the way to Fourth Avenue. Sub- sequently, the Federal Highway Administration agreed to approve the project as originally proposed on the basis that "the City will agree to remove the trees and further widen the street to its full of width of 64 feet when the accident rate at the intersection of Fourth Avenue and "F" Street reaches 1.5 accidents per million vehicles entering." Program Supplement No. 2 (Exhibit B) incorporates that commitment into the Local Agency-State Agreement No. 7. It also adds Exhibit "C" to the Agreement. Exhibit "C" makes several modifications based on cur- rent Federal requirements which provide for mass transit projects to be covered by the Agreement. Approval of this supplement will allow approximately $209,000 of FAU funds to be used for the proposed widening of "F" Street. Should it become necessary to remove the trees along the Library frontage and widen that portion of "F" Street as a future project, it is estimated that such work would cost approximately $21,000. Such work would be at the City's expense. It is proposed that no funds be budgeted until the need for this additional widening work has been demonstrated. If this supplemental agreement is not approved, however, it should be expected that $209,000 in federal funds would not be made available for the "F" Street project. In this event, the entire project cost would have to be borne by the-City. STAFF RECOMMENDATION Approve Program Supplement No. 2 to Local Agency-State Agreement No. 7 incorporating covenants as specified within said supplement into Agree- ment No. 7.
