The applicant is requesting approval of a precise plan in order to move an existing single family dwelling from 440 "L" Street onto the rear portion of a 9,495 sq, ft. parcel at 428 "L" Street in the R-3-P-14 zone. The parcel is presently developed with a single family dwelling. 2. This report involves the consideration of two separate items; the first being the precise plan, and the second involving the proposed move-on of an existing structure. Since the move-on cannot take place unless the precise plan is approved, the two items are considered together in this report. 3. The proposed project is categorically exempt from environmental review as a class 3a exemption. B. Site characteristics. The project site is a level parcel measuring 60' x 158' and containing 9,495 sq. ft. COUNCIL ACTION AGENDA dTEM N0. 4,4a Meeting of 11/1/77 Supplemental page No. 2 detached garage located on the easterly side of the property and to the rear of the dwelling. The original garage has been converted to living quarters. However, the concrete driveway and approach still exist in front of the dwelling. An additional concrete driveway, leading to the detached garage, is located just east of the original driveway. 3. Proposed move-on and precise plan. a. The proposed move-on is a single story wood frame and wood exterior single family structure located at 440 "L" Street. The dwelling is being moved in order to allow for the construction of 17 apartment units recently approved for that parcel. b. The applicant intends to place the move-on to the rear of the existing dwelling and remove the detached garage. The garage conversion will be reconverted into a garage in order to provide parking for the existing dwelling. The existing driveway will be extended to provide two offstreet parking spaces and a turnaround between the two dwellings. The move-on will be located 15 feet from the rear property line with a proposed 5' X 15' addition located 5 feet from the west property line. c. The applicant intends to reroof each dwelling with matching asphalt shingles and repaint the structures to match. Inasmuch as the two structures would be color coordinated and have matching roofs, the Planning Commission found the two structures to be architecturally compatible and recommended that the City Council approve the move-on. C. ANALYSIS 1. While the precise plan guidelines for this section attempted to encourage consolidation of lots, such consolidation was considered to be difficult because several lots now contain more than one dwelling unit and the cost of moving units in order to construct a fairly low density apartment is high. 2. The staff has held a meeting with the applicant and the owner of the parcel to the east to discuss a joint access driveway to serve the rear development of both parcels. Further testimony given by the applicant indicates an interest on the part of both property owners to cooperate and reach an agreement in the near future. The Planning Commission resolution requires that an agreement be reached by both parties, noting that failure to do so will result in further review by the Zoning Administrator. Access to the rear yard of the most easterly property is virtually impossible without such an agreement. In addition, joint driveways will minimize the number of curb cuts on "L" Street and create a better environment for the construction of units at the rear of these lots. It is proposed to widen the proposed access from 9'6" to 11'6" with the joint agreement. 3. The proposed plan either meets or exceeds the precise plan guidelines with the exception of the proposed addition to the move-on dwelling which will be located 5 feet from the side property line instead of 8 feet as required. Under the guidelines, the 8 feet may be reduced depending upon the orientation and length of the building. Since the proposed addition is a single story structure only 15 feet in length, the effect on the adjacent property would be negligible. RESOLUTION N0. PCM-78-5 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF A PRECISE PLAN FOR ADDITIONAL DEVELOPMENT OF THE PROPERTY AT 428 "L" STREET, INCLUDING THE MOVING OF AN EXISTING SINGLE FAMILY DWELLING ON TO THE SITE WHEREAS, Ordinance No. 1709, adopted by the City Council on October 26, 1976, established the zone for 8.4 acres on the south side of "L" Street between Fourth and Fifth Avenues as R-3-P-14, and WHEREAS, on September 12, 1977 a Precise Plan was submitted by T. R. and Doris T. Bradley for additional development of the property at 428 "L" Street, which is within the established R-3-P-14 zone, and WHEREAS, the Precise Plan proposes the moving of an existing single family dwelling from 440 "L" Street on to the rear portion of the 9,495 sq. ft. lot at 428 "L" Street, and WHEREAS, the proposed project is categorically exempt from environmental review as a class 3a exemption, and WHEREAS, the City Planning Commission, at a duly advertised public hearing held at 7:00 p.m., October 12, 1977 in the Council Chamber, City Hall, 276 Fourth Avenue, considered the Precise Plan for development as submitted. fdOW THEREFORE BE IT RESOLVED THAT THE CITY PLANNING COMPASSION finds as follows: a. That such plan will not, under the circumstances of the particular case, be detrimental to the health, safety or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity. The property will be developed at a density lower than the zoning would allow. The conditions of approval will ensure that the development will not be detri- mental or injurious to persons or property in the immediate vicinity. b. That such plan satisfies the principles of the application of the "P" P1odifying District as set forth in Section 19.46.041. The two structures will be made architecturally compatible through the use of matching roof materials and exterior colors. c. That any exceptions granted which deviate from the underlying zoning require- ments shall be warranted only when necessary to meet the purpose and application of the "P" Precise Plan Modifying District. The reduction of the 8 foot sideyard guideline to 5 feet should not affect adjacent properties. d. That approval of this plan will conform to the General Plan and the adopted policies of the city. - The plan conforms to the General Plan.. BE IT FURTHER RESOLVED that the City Planning Commission finds that the single family dwelling to be moved on to the site is architecturally compatible with the area and recommends to the City Council the approval of the Precise Plan for redevelopment of the property at 428 "L" Street, subject to the following conditions: 1. The existing converted garage shall be reconverted into a garage. 2. The two residential structures shall be reroofed with matching asphalt shingles and the exteriors shall be repainted with compatible color schemes. 3. Six foot high fencing shall be provided along the east, west, and south property lines, except within the front setback area. In the event any fencing is erected by any adjacent property owner prior to a request for occupancy, the fencing along that property line will be waived. 4. The move-on structure and any proposed additions may maintain a 5 foot minimum sideyard setback for a distance not to exceed 20 feet. (The guidelines specify an 8 foot setback in anticipation of multi-family development. 5. The applicant shall comply with all regulations of the Code and require- ments of the Building and Housing Department regarding the move-on. 6. The applicant shall pursue a joint access agreement with the adjacent property owner to the east. Failure to achieve a mutually agreed upon easement will necessitate further review by the Zoning Administrator prior to issuance of a building permit. BUILDING AND HOUSING DEPARTMENT September 14, 1977 pity o~ C~luQa vista CALIFORNIA INSPECTION REPORT ON HOUSE MOVE TO 428 "L" STREET PROPERTY RELOCATION ADDRESS: 426 "L" Street (Tentative), PRESENT ADDRESS: 440 "L" Street, Chula Vista APPLICATION BY: Doris Bradley (479-3120), Owner On September 13, 1977 an inspection was made of this 2 bedroom, one bath, 755 square foot wood framed dwelling at 440 "L" Street. The general features of this building are comparable to those at the relocation area, having gabled- roof, wood floor and vertical shingled siding and plastered interior walls. It is recommended that this move be approved subject to the following conditions: 1. New concrete foundation system. Soils conditions do not appear to be of expansive nature at relocation site - standard construction, including two #4 reinforcing bars in 12" x 12" footings are acceptable. 2. Provide new driveway and off-street parking conditions as required by City. 3. Remove detached garage and restore converted attached garage space at existing front dwelling (428 "L" Street), reducing present 25 foot driveways as required by City. 4. Provide the following plumbing systems: (a) New building sewer and building drainage systems to this building. (b) New water service to this building. Minimum 3/4" service with separate shut-off valve. (c) New gas system with separate shut-off valve to this building. (d) Water and drainage plumbing for a washing machine. (e) Reinstall hot water heater in a fully code conforming manner. 5. Provide the following electrical work: (a) Anew 100 amp 115/230 volt service at a location prescribed by the utility company (this service shall have a main switch). (b) Replace all existing circuits with grounded system/outlets. -2- (c) Add an additional small appliance circuit with additional outlets. (d) Provide additional outlets in one bedroom; in the bath, and one exterior outlet, both of which shall be on G.F.I. protection. (e) Provide a separate circuit fora washing machine and disposer. (f) -Replace kitchen ceiling light fixture and non-approved type wiring to rear porch light fixture. 6. Replace bathroom deteriorated window and kitchen entrance door. 7. Replace all broken glazing in windows and doors. Install screens throughout on exterior openings. 8. Install additional structural members at midspan of rafters to remove sag - such as a purlin system. 9. See that kitchen grease duct is complete to exterior and without grease en- trapment pockets - correct as necessary. 10. Patch and repair any damage to the building as a result of this move. 11. Install new underfloor access door a minimum of 24" x 18". 12. Install new heating system to replace outmoded floor furnace. 13. Owner's proposed 105 square foot kitchen addition shall be included in this project under required permits. 14. Provide a termite and fungus "Inspection Report" by a California licensed pest control agency and complete any required work recommended. 15. Repaint entire interior and exterior of the building upon completion of necessary work. 16. Deliver to the City a $5000 cash or Surety Bond in favor of the City prior to the moving to guarantee completion of work. 17.
